PREPARING A ROOF TO USE AS SCHACH (Yerushalmi Halachah 10 Daf 7a)

משנה המשלשל דפנות מלמעלן למטן אם גבוה מן הארץ ג' טפחים פסולה

(a)

(Mishnah): If a person wove walls downwards from the top of the Sukah, if they do not reach within three Tefachim of the ground, it is invalid.

מלמטן למעלן אם גבוה מן הארץ י' טפחים כשירה

(b)

If they are woven upwards from the ground, if they are ten Tefachim tall, it is valid.

ר' יוסי אומר כשם שמלמטן למעלן י' טפחים כך מלמעלן למטן י' טפחים

R. Yosi says - just as upwards the walls must be ten Tefachim, so from the top downwards, if they are ten Tefachim, it is valid (as a suspended partition is valid)

הרחיק את הסיכוך מן הדפנות שלשה טפחים פסולה

If the Schach was distanced three Tefachim from the walls (horizontally), it is invalid.

גמרא אמר ר' יוחנן לא א"ר יוסה אלא לעניין סוכה אבל לעניין שבת אף ר' יוסי מודה

(e)

(Gemara - R. Yochanan): R. Yosi only ruled this way for a Sukah (as it is a 'mere' positive commandment), but for Shabbos laws (which are a negative commandment that can involve the punishment of Kares), even R. Yosi agrees (that such a wall is invalid).

מילתיה דר' חנינא אמר אף לעניין שבת

The case said by R. Chanina shows that he understands that R. Yosi rules this way even for Shabbos laws -

דאמר רבי חנינא שלטון בא לציפורין ותלו בו קיטיות והתיר ר' ישמעאל בי ר' יוסי לטלטל תחתיהן בשיטת אביו

R. Chanina said that a government minister once came to Tzipurin and they sectioned off part of a Mavoi using sheets that they hung from pillars (in his honor). R. Yishmael followed the opinion of his father by permitting the people to carry there on Shabbos.

R. Yosi Bei R. Bun quoting R. Shmuel bar Rav Yitschak: R. Yosi ben Chanina follows the opinion of R. Chanina and they both disagree with R. Yochanan -

דא"ר (יוחנן)[יוסי בר חנינה] רבי יודה ור' יוסה ור' חנניה בן עקביא שלשתן אמרו דבר אחד

As R. Yosi bar Chanina said that R. Yehuda, R. Yosa and R. Chananya ben Akavya share the same opinion (that a suspended partition is valid) -

רבי יודה דגשרים המפולין

i.

R. Yehuda said - bridges underneath which a road passes (that have two walls underneath, one on either side) - one may carry underneath them on Shabbos. (If he permits this, he certainly permits suspended partitions.)

R. Yosi appears in our Mishnah.

ר' חנניה בן עקביה דתני ג' דברים התיר רבי חנניה התיר עצה שבים והתיר כצוצרה והתיר הבאת לונטיות

R. Chananya ben Akavya - as the Beraisa teaches - R. Chananya permitted three things - canes in the sea (even though they are wet, one could hide fruits inside them it does not be Machshir the fruit to contract Tumah); a balcony protruding over water that extends from a house (one may lower a bucket into the water to fill it, as long as ten Tefach walls surround it); bringing home a towel from the bathhouse on Shabbos (he was not concerned that one might come to squeeze it).
