A SUKAH UNDER A TREE AND A SUKAH ON A SUKAH (Yerushalmi Halachah 3 Daf 4b)

משנה העושה סוכתו תחת האילן כאילו עשאה בתוך הבית

(a)

(Mishnah): One who build a Sukah under a tree it is as if he built it inside a house [and it is invalid].

סוכ' ע"ג סוכה העליונה כשירה והתחתונה פסולה

(b)

If there is a Sukah on top of another Sukah, the upper one is valid and the lower one is invalid.

ר' יהוד' אומר אם אין דיורין בעליונה התחתונה כשירה

R. Yehuda says - if there is nobody occupying the upper one, the lower one is valid.

[דף ה עמוד א] גמרא שני סככין זה על גבי זה העליון חמתו מרובה מצילתו התחתון אין חמתו מרובה מצילתו ע"י זה וע"י זה צילתן מרובה מחמתן

(Gemara): If there were two Schachs one on top of the other, (even) if the upper one provides more sun than shade and the lower one does not provide more sun than shade (i.e. it has more shade than sun), they combine to validate the lower Sukah. (Note: This follows the explanation of Rav Chaim Kanievski.)

Question: How far apart can they be for the two Schachs to still combine?

תרין אמורין חד אמר עשרה וחורנה אמר ארבעה

There was a dispute between two Amoraim - one said ten Tefachim (as a height of ten Tefachim is a separate domain) and one said four Tefachim (as a height of four is considered a place of significance).

מתיב מ"ד עשרה למאן דאמר ארבעה משום אהל מצאנו אוהל שהוא טפח

Question (The one who said ten against the one who said four): Why do you say four (meaning that four creates a separate domain as it is considered a 'tent')? Do we not find that the minimum Halachic size of a tent is one Tefach? (This question remains unresolved.)

רבי יהודה אומר אם אין דיורין בעליונה התחתונה כשירה

The Mishnah had taught: R. Yehuda says - if there is nobody occupying the upper one, the lower one is valid.

מה דיורין ממש או אפי' ראויה לדיורין

Query: Does R. Yehuda mean that people actually occupy it or does he mean that it is suitable for people to occupy it?

מן מה דתנא חד סב קומי רבי זעירא ואפילו התחתונה כשירה לית בר נש אמר אפי' אלא דהוא מודה על קדמייתא הדא אמרה דיורין ממש

Answer: From the way that one Sage taught the Mishnah in front of R. Zeira - "[if there is nobody occupying the upper one] even the lower is valid" - no-one uses the word "even" unless he agrees with the previous statement - this shows that he agrees that the upper one is also valid, and if the upper one is not suitable for people to occupy it, why would it be valid? We can therefore conclude that R. Yehuda was referring to people actually occupying it.

A COVERING ABOVE OR BELOW THE SCHACH (Yerushalmi Halachah 4 Daf 5a)

משנה פירס עליה סדין מפני החמה או תחתיה מפני הנשר או שפירס ע"ג הקינוף פסולה

(a)

(Mishnah): If a person spread out a sheet above the Schach to protect from the sun or below the Schach to protect from the fallout of the Schach; or if he spread a sheet over posts to make a four-poster bed (under the Schach), it is invalid.

אבל פורס הוא על נקליטי המטה

(b)

However, he may spread a sheet as a two-poster bed (a pole is inserted at the head and foot of the bed in the middle of each side with a rail connecting them on top and a sheet spread over them).

גמרא תני תולה בה קיטיות כשירה

(c)

(Gemara - Beraisa): If a person hung embroidered curtains in the Sukah it is valid.

א"ר חנניה הדא דאת אמר מן הצד הא מלמעלן פסולה

(d)

R. Chananya: This only applies when it is hung on the side, but on top (below the Schach) it is invalid.

או תחתיה מפני הנשר

The Mishnah had taught: [If he spread a sheet] below the Schach to protect from the fallout of the Schach...[it is invalid].

א"ר יוסה לא אמרו אלא מפני הנשר הא שלא מפני הנשר כשירה

R. Yosa: This only applies when he spread it to protect from the fallout but if not to protect from the fallout (but rather for decoration), it is valid.

אבל פורש הוא על ניקליטי המיטה

The Mishnah had taught: However, he may spread a sheet as a two-poster bed.

רבי ביבי בשם רבי יוחנן שכן הוא עושה חלל באצילי ידיו

(h)

R. Baybai quoting R. Yochanan: Just as if a person lifts his arms when sleeping under a sheet, even though the sheet becomes a tent above him, it is insignificant; so here, the tent of a two-poster bed is insignificant.
