THERE MUST BE A CLAIM OF MAMON (Yerushalmi Halachah 6 Daf 21b)

מתני' משביע אני עליכם אם לא תבואו ותעידוני שאני כהן שאני לוי שאיני בן גרושה ושאיני בן חלוצה ושאיש פלוני כהן שאיש פלוני לוי שאינו בן גרושה שאינו בן חלוצה שאנס איש פלוני ופיתה את בתו ושחבל בי בני ושהדליק גדישי בשבת הרי אילו פטורין:

(a)

(Mishnah): If he said "I impose a Shevu'ah on you if you will not come and testify for me that am a Kohen, or a Levi, or (regarding a Kohen) that my mother was not divorced or a Chalutzah, or that Ploni is a Kohen, or a Levi, or that his mother was not divorced or a Chalutzah, or that Reuven raped or enticed Shimon's daughter, or that my son wounded me, or that Shimon wounded me or burned my stack on Shabbos" [even if they knew testimony and refused to testify], they are exempt.

גמ' [ויקרא ה א] נפש כי תחטא [שם כא] נפש כי תחטא לגזרה שוה מה נפש כי תחטא שנאמר להלן תבועת ממון ויש לו אף נפש כי תחטא שנאמר כאן תביעת ממון ויש לו.

(b)

(Gemara): We learn from a Gezeirah Shavah "Nefesh Ki Secheta-Nefesh Ki Secheta". Just like Nefesh Ki Secheta said below [regarding Shevu'as ha'Pikadon] refers to a claim of money, and it is owed to him [the claimant], also Nefesh Ki Secheta said here refers to a claim of money, and it is owed to him.

לית הדא פליגא על ריש לקיש דאמר אין ממון אצל מכות

(c)

Question: Is this unlike Reish Lakish, who said that there is no money where there are lashes [for one who was warned]?

פתר לה כר' מאיר דאמר לוקה ומשלם.

(d)

Answer: We can explain like R. Meir, who said that he is lashed and pays.

מ"מ לא הפסידו ממון.

(e)

Question: [Mishnah 5 said that they are liable for a claim of Kefel, four or five, i.e. even if the principal was returned. What is the reason? Even though the defendant was obligated,] in any case [not testifying about the fine] did not cause a loss of Mamon! (We learn from Shevu'as ha'Pikadon, in which he lost the principal!)

כיון דהלה הוה בעי מיתן ליה ולא יהב ליה כמי שהפסידו ממון:

(f)

Answer: Since he needed to pay him [and the testimony would have obligated him, and now that he did not testify] he did not give to him, it is as if he made him lose Mamon. (We explained this like MEICHAL HA'MAYIM; NO'AM YERUSHALMI explains similarly.)
