DIFFERENCES BETWEEN R. AKIVA AND RABANAN (Yerushalmi Halachah 1 Daf 12a)

(a)

Question: What [else] do [R. Akiva and Rabanan] argue about?

שבועה שאוכל ככר זו ואכלה חסר כל שהוא על דעתיה דר' עקיבה חייב על דעתיה דרבנין פטור.

(b)

Answer: He swore "I will eat this loaf", and he ate all of it, except for Kolshehu. According to R. Akiva he is liable (he did not fulfill his oath), and according to Rabanan he is exempt;

שלא אוכל ככר זה ואכלה חסר כל שהוא על דעתיה דרבי עקיבה פטור על דעתין דרבנין חייב.

[If he swore] "I will not eat this loaf", and he ate all of it, except for Kolshehu. According to R. Akiva he is exempt, and according to Rabanan he is liable.

אף (בשבועת ביטוי כן שבועה) [צ"ל קונמות כן קונם - קרבן העדה] אשתי נהנית לי אם אוכל ככר זו ואכלה חסר כל שהוא על דעתיה דרבי עקיבה אשתו (אסורה על דעתיה דרבנין אשתו מותרת) [צ"ל מותרת ע"ד דרבנן אסורה - קרבן העדה]

(c)

Consequence: Also Konamos [forbidding through vows] is like this. "Konam (is forbidden like a Korban) benefit that my wife will get from me if I eat this loaf", and he ate it, except for Kolshehu - according to R. Akiva his wife is permitted, and according to Rabanan she is forbidden.

Note: We must discuss benefit that he is not obligated to give to her. Alternatively, he forbids himself to benefit from her.

(d)

Also [forbidding] property [through Konam] is like this. "His property is Konam to me if I eat this loaf", and he ate it, except for Kolshehu - according to R. Akiva his property is permitted, and according to Rabanan it is forbidden.
