מתני' הקש שעל גבי המטה לא ינענענו בידו אבל מנענעו בגופו

(a)

(Mishnah): One may not use his hand to move straw on a bed, but he may move it with his body;

אם היה מאכל בהמה או שהיה עליו כר או סדין מנענעו בידו

If the straw was food for animals, or if a sheet or blanket was spread over it [before Shabbos], he may move it with his hand.

One may open a commoner's press (a pair of boards between which clothes are pressed), but he may not close it [on clothes];

R. Yehudah says, if it was [slightly] open from before Shabbos, he may open it entirely and remove the garment.

(Gemara): Our Mishnah discusses when he did not sleep on it [before Shabbos], but if he slept on it, it is like [the bed - RADAL] itself.

Remark (R. Yanai): [This is like people say -] tear out hair of one who has a bald patch [so he will be totally bald]. If robbers robbed someone, they take from him what remained. Pour cold water on one who is chilled. If one's house fell [and the boundary is not clear], his neighbor widens his boundary [and takes from him. Also here, poverty pursues the poor - perhaps we are stringent on this poor man who lacks a proper bed, and sleeps on straw!]

(Beraisa): Chachamim agree with R. Meir about ropes tied on covers over land, that one may move [the knot to cause it to open], unravel, untie and cut them [on Yom Tov]; on Shabbos one may move, but not unravel, untie or cut;

Ropes tied on Kelim, on Shabbos it is permitted, and there is no need to teach [that it is permitted] on Yom Tov.

CARRYING ISUR TOGETHER WITH HETER ON SHABBOS (Yerushalmi Perek 21 Halachah 1 Daf 92a)

מתני' נוטל אדם את בנו והאבן בידו, וכלכלה והאבן בתוכה.

(a)

(Mishnah): One may carry a child holding a rock, or a basket with a rock inside;

ומטלטלין תרומה טמאה עם הטהורה ועם החלין.

(b)

One may move Tamei Terumah with Tahor Terumah or with Chulin;

רבי יהודה אומר: אף מעלין את המדמע באחד ומאה.

(c)

(Meduma is a mixture of Terumah and Chulin. If there is least 100 times as much Chulin as Terumah, we Ma'aleh (remove) an amount equal to the Terumah, consider it to be Terumah, and the rest is permitted like Chulin.) R. Yehudah says, we may even Ma'aleh Meduma if there is at least 101 [volumes of mixture per volume of Terumah].

REMOVING ISUR FROM HETER ON SHABBOS (Yerushalmi Perek 21 Halachah 2 Daf 92a)

מתני' האבן שעל פי החבית מטה על צדה והיא נופלת.

(a)

(Mishnah): If a rock is on a barrel, one tilts the barrel and the rock falls;

היתה בין החביות מגביהה ומטה על צדה והיא נופלת.

(b)

If [he cannot do so because] it is between other barrels, he picks it up and tilts it and the rock falls.

מעות שעל הכר נוער את הכר והן נופלות.

(c)

If coins are on a pillow, he shakes the pillow and they fall off.

היתה עליו לשלשת מקנחה בסמרטוט. היתה של עור נותנין עליה מים עד שתכלה.

(d)

If there was filth on the pillow, he may clean it with a rag;

If it is of leather, he may pour water on it until it is clean (but does not properly wash it).

SOMETHING THAT USED TO BE PART OF A FOOD (Yerushalmi Perek 21 Halachah 3 Daf 92a)

מתני' בית הלל אומרים: מגביהין מן השלחן עצמות וקלפין.

(a)

(Mishnah - Beis Hillel): We may remove bones and peels from the table;

ובית שמאי אומרים: נוטל את הטבלה כלה ונוערה.

(b)

Beis Shamai say, we take the entire Tavla (a board placed over the table), and shake it (casting them off).

מעבירין מלפני השלחן פרורין פחות מכזית, ושער של אפונין ושער של עדשים, מפני שהוא מאכל בהמה.

(c)

We remove from the table crumbs less than a k'Zayis, and the pods (Aruch - and chaff and sprigs) of peas and of lentils, for animals eat them.

ספוג, אם יש לו עור בית אחיזה מקנחין בו; ואם לאו אין מקנחין בו. וחכמים אומרים בין כך ובין כך נטל בשבת, ואינו מקבל טמאה.

(d)

If a sponge has a leather handle, one may clean with it; if not, not (he would surely squeeze between his fingers);

(e)

Version #1: In either case one may take it on Shabbos; it is not Mekabel Tum'ah.

וחכמים אומרים: בין כך ובין כך נטל בשבת, ואינו מקבל טמאה.

Version #2: Chachamim say, in either case one may use and take it on Shabbos; it is not Mekabel Tum'ah.

SQUEEZING FRUIT (Yerushalmi Perek 22 Halachah 1 Daf 92a)

[דף קיב עמוד ב (עוז והדר)] מתני' חבית שנשברה מצילין הימנה מזון של ש סעודות. ואומר לאחרים: בואו והצילו לכם, ובלבד שלא יספג.

(a)

(Mishnah): If a barrel broke, one may save food for three meals; he may tell others to save for themselves, as long as he does not soak up.

אין סוחטין את הפרות להוציא מהן משקין; ואם יצאו מעצמן אסורין.

(b)

We may not squeeze fruit to extract the juice; if the juice came out by itself, it is forbidden [on Shabbos];

רבי יהודה אומר: אם לאכלין היוצא מהן מתר, ואם למשקין היוצא מהן אסור.

(c)

R. Yehudah says, if the owner planned to eat the fruit, the juice is permitted; if he planned to extract the juice, it is forbidden.

(d)

If cakes of honey were crushed before Shabbos and the honey flowed out on Shabbos, it is forbidden;

SOAKING FOOD IN HOT WATER (Yerushalmi Perek 22 Halachah 2 Daf 92a)

מתני' כל שבא בחמין מערב שבת שורין אותו בחמין בשבת;

(a)

(Mishnah): If any food was soaked [and fully cooked] in hot water [in a Kli Rishon] before Shabbos, one may soak it in hot water on Shabbos;

וכל שלא בא בחמין מערב שבת מדיחין אותו בחמין בשבת; חוץ מן המליח הישן ודגים מלוחים קטנים וקוליס האספנין, שהדחתן זו היא גמר מלאכתן.

(b)

If it was not soaked in hot water before Shabbos, one may pour hot water over it (Rashbam - from a Kli Rishon; R. Tam - from a Kli Sheni) on Shabbos, except for old salted fish or tuna fish, for rinsing them is their final Melachah (preparation).

OPENING A BARREL ON SHABBOS (Yerushalmi Perek 22 Halachah 3 Daf 92a)

מתני' שובר אדם את החבית לאכל הימנה גרוגרות, ובלבד שלא יתכון לעשות כלי.

(a)

(Mishnah): One may break a barrel to eat the dry figs inside, as long as he does not intend to make a Kli (i.e. a nice opening);

ואין נוקבים מגופה של חבית; דברי רבי יהודה.

(b)

R. Yehudah says, one may not puncture the cork of a barrel;

וחכמים מתירין.

(c)

Chachamim permit.

ולא יקבנה מצדה;

(d)

One may not puncture it from the side;

ואם היתה נקובה לא יתן עליה שעוה, מפני שהוא ממרח.

(e)

If it was punctured, one may not place wax on it because he smoothens it [the Melachah of Memarei'ach).

אמר רבי יהודה: מעשה בא לפני רבן יוחנן בן זכאי בערב, ואמר: חוששני לו מחטאת.

(f)

R. Yehudah says, a case occurred - R. Yochanan ben Zakai said that he suspects that he is Chayav Chatas.

8)

THINGS WE DO NOT DECREE AGAINST ON SHABBOS (Yerushalmi Perek 22 Halachah 4 Daf 92a)

מתני' נותנין תבשיל לתוך הבור בשביל שיהא שמור

(a)

(Mishnah): One may put a Tavshil in a pit [on Shabbos] so it will not spoil [in the sun].

, ואת המים היפים ברעים בשביל שיצנו,

(b)

One may put good (drinkable) water [in a Kli] in bad water to cool the good water;

ואת הצונן בחמה בשביל שיחמו.

(c)

One may put cold water in the sun to warm up.

מי שנשרו כליו בדרך במים, מהלך בהן ואינו חושש.

(d)

If one's clothes became soaked in water on the road, he may continue, this is no problem;

הגיע לחצר החיצונה, שוטחן בחמה, אבל לא כנגד העם.

When he reaches the outer gate [of the entrance to the city, a guarded place], he spreads them out to dry in the sun, but not in front of people.

LAWS RELATED TO BATHING ON SHABBOS (Yerushalmi Perek 22 Halachah 5 Daf 92a)

מתני' הרוחץ במי מערה ובמי טבריא ונסתפג, אפלו בעשר אלנטיאות לא יביאם בידו;

(a)

(Mishnah): If one bathed in a cave or in the springs of Tiverya and wiped himself, even if he used 10 towels, he may not take them [with him, even if there is an Eiruv, lest he squeeze them];

אבל עשרה בני אדם מסתפגין באלנטית אחת, פניהם ידיהם ורגליהם, ומביאין אותה בידן.

(b)

However, even 10 people may use the same towel to wipe their hands, feet and face (or even their whole bodies, just this is uncommon, for it would be too wet), and take the towel.

LAWS RELATED TO BATHING ON SHABBOS (contd.) (Yerushalmi Perek 22 Halachah 6 Daf 92a)

מתני' סכין וממשמשין בבני מעים, אבל לא מתעמלין ולא מתגרדין,

(a)

We may anoint and massage [for pleasure], but one may not rub hard or scratch himself with Magredes (a comb used for horses, for this is a weekday act).

אין יורדין לקורדימה, ואין עושין אפיקטויזין,

(b)

One may not descend to Kordima (a certain river) or make Afiktizin [to make himself vomit];

ואין מעצבין את הקטן, ואין מחזירין את השבר.

(c)

One may not straighten limbs or vertebrae of a baby, or reset a broken bone;

מי שנפרקה ידו ורגלו לא יטרפם בצונן; אבל רוחץ הוא כדרכו, ואם נתרפא נתרפא.

(d)

If the hand or leg bone was dislocated, he may not shake (alternatively - rub, or shower) it in water, but he may wash normally; if it heals, this is no problem.

SHINUYIM TO PREVENT PERFORMING A MELACHAH ON SHABBOS (Yerushalmi Perek 23 Halachah 1 Daf 92a)

מתני' שואל אדם מחברו כדי יין וכדי שמן, ובלבד שלא יאמר לו הלוני,

(a)

(Mishnah): Reuven may Sho'el (borrow) barrels of wine or oil from his friend, as long as he does not say 'Halveni';

[דף קיג עמוד א (עוז והדר)] וכן האשה מחברתה ככרות.

(b)

Similarly, a woman may Sho'el loaves from her friend [but may not say 'Halveni'].

ואם אינו מאמינו מניח טליתו אצלו ועושה [דף צב עמוד ב] עמו חשבון לאחר שבת.

(c)

If the lender does not trust Reuven, Reuven leaves his Talis with him, and they calculate [the value of what was lent] after Shabbos.

וכן ערב פסח בירושלים שחל להיות בשבת מניח טליתו אצלו ונוטל את פסחו, ועושה עמו חשבון לאחר יום טוב.

(d)

Similarly, when Erev Pesach is on Shabbos one [who needs to buy Korban Pesach] leaves his Talis with the seller, and they make a calculation after Yom Tov.

12)

MAKING LOTTERIES ON SHABBOS (Yerushalmi Perek 23 Halachah 2 Daf 92b)

מתני' מונה אדם את אורחיו ואת פרפרותיו מפיו, אבל לא מן הכתב.

(a)

(Mishnah): One may count his guests and courses by heart, but he may not read [from a list].

ומפיס עם בניו ועם בני ביתו על השלחן, ובלבד שלא יתכון לעשות מנה גדולה כנגד קטנה, משום קביא.

(b)

One may make a lottery [to determine who gets which portion] with his sons and household at the table, as long as he does not intend to make some portions bigger than others.

ומטילין חלשים על הקדשים ביום טוב, אבל לא על המנות.

(c)

We may make a lottery [among Kohanim] regarding Kodshim on Yom Tov, but not regarding the portions (this will be explained).

DISCUSSING BUSINESS ON SHABBOS (Yerushalmi Perek 23 Halachah 3 Daf 92b)

מתני' לא ישכר אדם פועלים בשבת,

(a)

(Mishnah): One may not hire workers on Shabbos;

ולא יאמר אדם לחברו לשכור לו פועלים.

(b)

[On Shabbos,] one may not ask his friend to hire workers for him;

אין מחשיכין על התחום לשכור פועלים ולהביא פרות,

(c)

One may not Machshich on the Techum (towards the end of Shabbos go to the end of the Techum, i.e. as far from the city as is permitted) to hire workers or to bring produce [from outside the Techum];

אבל מחשיך הוא לשמור, ומביא פרות בידו.

(d)

One may Machshich [on the Techum] to guard produce - he may return with produce.

כלל אמר אבא שאול: כל שאני זכאי באמירתו, רשאי אני להחשיך עליו.

(e)

Aba Sha'ul says, the general rule is - if [on Shabbos] one may ask someone to do something [after Shabbos], he may Machshich for it.

14)

MELACHOS THAT MIGHT HAVE BEEN DONE FOR A JEW (Yerushalmi Perek 23 Halachah 4 Daf 92b)

מתני' מחשיכין על התחום לפקח על עסקי כלה, ועל עסקי המת להביא לו ארון ותכריכין.

(a)

(Mishnah): One may Machshich to attend to the needs of a bride or a Mes, to bring a coffin or shrouds;

גוי שהביא חלילין בשבת לא יספד בהן ישראל, אלא אם כן באו ממקום קרוב.

(b)

If a Nochri brought flutes on Shabbos, one may not eulogize with them unless they came from a nearby place (inside the Techum).

עשו לו ארון וחפרו לו קבר יקבר בו ישראל;

(c)

If [Nochrim] made a coffin or dug a grave [for a Nochri or to sell], a Yisrael may be buried in it;

ואם בשביל ישראל לא יקבר בו עולמית.

(d)

If they made it for a Yisrael, no Yisrael may ever be buried in it.

15)

TENDING TO A DEAD BODY ON SHABBOS (Yerushalmi Perek 23 Halachah 5 Daf 92b)

מתני' עושין כל צרכי המת, סכין ומדיחין אותו, ובלבד שלא יזיזו בו אבר.

(a)

(Mishnah): [On Shabbos] we may do all needs of a Mes, e.g. anointing and rinsing, as long as we do not move a limb;

שומטין את הכר מתחתיו, ומטילין אותו על החול בשביל שימתין.

(b)

One may remove the pillow from underneath it, so it will be on the [cold] sand [and not decay so quickly].

קושרים את הלחי לא שיעלה, אלא שלא יוסיף.

(c)

We may tie the jaw to prevent the mouth from opening more, but not to close it.

וכן קורה שנשברה, סומכין אותה בספסל או בארוכות המטה לא שתעלה, אלא שלא תוסיף.

(d)

Similarly, if a beam [supporting the ceiling] broke, we may put a bench or bed board (Kelim that one may move) there to prevent the ceiling from falling more, but not to raise it [for this would be building].

אין מעמצין את המת בשבת,

(e)

We may not close the eyes of a Mes;

ולא בחל עם יציאת נפש. והמעמץ עם יציאת נפש הרי זה שופך דמים.

(f)

Even on a weekday one may not close the eyes of one about to die - one who does so murders (it hastens death).

HAVING A NOCHRI TO CARRY ONE'S ITEMS ON SHABBOS (Yerushalmi Perek 24 Halachah 1 Daf 92b)

מתני' מי שהחשיך בדרך נותן כיסו לנכרי;

(a)

(Mishnah): If one was on the road when Shabbos was about to come, he may give his wallet to a Nochri [before Shabbos, to take it home for him];

ואם אין עמו נכרי מניחו על החמור. [דף קיג עמוד ב (עוז והדר)] הגיע לחצר החיצונה, נוטל את הכלים הנטלין בשבת; ושאינן נטלין בשבת מתיר את החבלים, והשקין נופלין מאליהם.

(b)

If no Nochri is around, he puts it on his donkey; when he reaches the outer gate [of the city], he removes from the donkey Kelim which may be moved on Shabbos, and unties the ropes [holding up sacks with Muktzeh], the sacks fall by themselves.

17)

MAKING AND IMPROVING FOOD ON SHABBOS (Yerushalmi Perek 24 Halachah 2 Daf 92b)

מתני' מתירין פקיעי עמיר לפני בהמה, ומפספסים את הכיפין, אבל לא את הזירין.

(a)

(Mishnah): One may untie Peki'ei (bundles of) straw in front of an animal and spread out Kipin, but not Zirin (these will be explained);

אין מרסקין לא את השחת ולא את החרובין לפני בהמה, בין דקה בין גסה;

(b)

One may not [finely] cut fodder or carobs for a Gasah or Dakah (big (work) animal or small animal);

רבי יהודה מתיר בחרובין לדקה.

(c)

R. Yehudah permits cutting carobs for a small animal.

18)

FORCE FEEDING ON SHABBOS (Yerushalmi Perek 24 Halachah 3 Daf 92b)

מתני' אין אובסין את הגמל, ולא דורסין, אבל מלעיטין.

(a)

(Mishnah): We may not Oves a camel [force food down its throat] or press food into its throat, but Mal'itim (this and the coming terms will be defined);

ואין ממרים את העגלים, אבל מלעיטין. ומהלקטין לתרנגולין, ונותנין מים למרסן, אבל לא גובלים.

(b)

We may not Ma'amir calves, but Mal'itim and Mehalketim chickens, and we may put water in their bran, but we may not knead it;

ואין נותנין מים לפני דבורים ולפני יונים שבשובך, אבל נותנין לפני אוזין ותרנגולים ולפני יוני הרדסיות.

(c)

We may not put water in front of bees or doves in a dovecote, but we may put in front of geese, chickens and domestic doves.

19)

THE HALACHAH REGARDING MUKTZEH (Yerushalmi Perek 24 Halachah 4 Daf 92b)

מתני' מחתכין את הדלועין לפני הבהמה, ואת הנבלה לפני הכלבים.

(a)

(Mishnah): We may cut gourds in front of animals, and a carcass in front of dogs [on Shabbos];

רבי יהודה אומר: אם לא היתה נבלה מערב שבת אסורה, לפי שאינה מן המוכן.

(b)

R. Yehudah says, if it was not dead when Shabbos began, we may not cut it, since it was not prepared.

20)

PERMITTING VOWS ON SHABBOS (Yerushalmi Perek 24 Halachah 5 Daf 92b)

מתני' מפירין נדרים בשבת, ונשאלין לדברים שהן לצרך השבת.

(a)

(Mishnah): Mefirim (a husband or father may annul) vows on Shabbos, and Nish'alim on vows (we request a Chacham or Beis Din to permit them), if they are for the need of Shabbos.

פוקקין את המאור,

(b)

One may plug up a Ma'or (a hole in a wall for light);

ומודדין את המטלית ואת המקוה.

(c)

One may measure a rag or Mikveh;

ומעשה בימי אביו של רבי צדוק, ובימי אבא שאול בן בטנית, שפקקו את המאור בטפיח וקשרו את המקדה בגמי, לידע אם יש בגיגית פותח טפח אם לאו. ומדבריהן למדנו, שפוקקין ומודדין וקושרין בשבת.

(d)

A case occurred in the days of R. Tzadok's father and Aba Sha'ul ben Bitnis, they plugged a Ma'or with a flask, and tied a jug with a reed to determine whether or not there was a Tefach in [a crack in] a basket - we learn from this that it is permitted to plug, measure and tie on Shabbos.
