RETURNING INSULATION (Yerushalmi Halachah 3 Daf 30b)

מתני' אם לא כסהו מבעוד יום לא יכסנו משתחשך

(a)

(Mishnah): If it (a pot) was not covered before Shabbos, one may not cover it after dark;

כסהו ונתגלה מותר לכסותו

(b)

If it was covered and became exposed, one may cover it.

ממלא את הקיתון ונותן לתחת הכר או תחת הכסת:

One may fill a flask [of cold water] and put it under a pillow or blanket [to keep it cold].

גמ' נטלו מבעוד יום מחזירו מבעוד יום. נטלו משחשיכה מחזירו משחשיכה.

(d)

(Gemara): If one took [a Tavshil from its insulation] during the day, he may return it during the day. If one took it after dark, he may return it after dark;

נטלו מבע''י וקדש עליו היום רבי בא בשם רב יהודה אם נתקלקלה הגומה אסורה.

(e)

If one took it during the day and Shabbos came, R. Ba says in the name of Rav Yehudah that if the cavity was ruined (the insulation caved in), it is forbidden [to return it].

ומכירה לכירה מותר.

(f)

One may move [a pot] from one Kirah to another Kirah.

[דף לז עמוד ב (עוז והדר)] מן ההוא דמר רבי לעזר בשם ר' יהושע משרת הייתי את רבי חייא הגדול והייתי מעלה לו חמין מדיוטי התחתונה לדיוטי העליונה ומחזירין לכירה.

Source: We learn from what R. Lazar said in the name of R. Hoshayah - I used to serve R. Chiyah ha'Gadol, and I would bring up for him hot water from the bottom floor to the top floor and return it to the Kirah.

ומר רבי ירמיה כר''ש אפילו מכירה שהבלה ממועט לכירה שהבלה מרובה מותר.

(R. Yirmeyah bei R. Shimon): Even from a Kirah of small heat to a Kirah of great heat is permitted.

מכירה לטמינה אסור. מטמינה לכירה אסור. מטמינה לטמינה צריכה.

Question: From a Kirah to Hatmanah is forbidden. From Hatmanah to a Kirah is forbidden. From Hatmanah to Hatmanah [in something else, is it permitted]?

נתגל' מבע''י מכסהו מבע''י. נתגלה משחשיכה מכסהו משחשיכה.

(i)

If it [was covered and] became exposed during the day, he may cover it during the day. If it became exposed after dark, he may cover it after dark.

Implied question: If it became exposed during the day and Shabbos came [may he cover it]?

תני אין טומנין חמין משחשיכה אבל מוסיפין עליהן כסות וכלים.

(Beraisa): One may not wrap Chamin (hot food or water) after dark, but one may add to it garments and Kelim.

כמה יהא עליהן ויהא מותר לכסותם.

Question: How much must be on it and it is permitted to cover [more]?

Answer #1 (R. Zerikan citing R. Chanina): Even a cloth suffices.

אמר רבי זעירא ובלבד דבר שהוא מועיל.

Answer #2 (R. Ze'ira): This is only if it helps [keep it hot].

Support (R. Matanyah): This is proper! One who takes a worn out garment and puts it on hhis head when it is cold, does it not keep his head from getting cold?!

כשם שאין טומנין חמין משחשיכה כך אין טומנין לא שלג ולא צונין. ורבי מתיר.

(q)

Just like one may not wrap Chamin after dark, so one may not wrap snow and cold [food or drink to keep it cold]. Rebbi permits.

התיב שמואל בר אבא על הדא קדמייתא והא תני ממלא הוא אדם את הקיתון של מים ונותן תחת הכר או תחת הכסת. אלא כרבי דרבי מתיר

Question (against the first Tana - Shmuel bar Aba - our Mishnah): One may fill a flask of [cold] water and put it under a pillow or blanket [to keep it cold]. Is this [only] like Rebbi, for Rebbi permits?!

WITH WHAT ANIMALS MAY GO OUT (Yerushalmi Halachah 1 Daf 31a)

מתני' במה בהמה יוצאה ובמה אינה יוצאה

(a)

(Mishnah) Question: What may an animal go out with on Shabbos, and what may it not go out with? (A person is commanded that his animal rest on Shabbos. It may wear something normally used for Shemirah (to protect the animal, or to prevent it from running away.)

יוצא הגמל באיפסר והנקה בחטם והלובדקים בפרומביא והסוס בשיר

(b)

Answer: A camel may go out with a halter (a rope tied in its mouth). A Nakah (white, or female camel) may go out with with an iron ring (through a hole pierced in the middle of the nose), Luvdakim [donkeys] may go out with an iron bit, and a horse may go out with a Shir (a collar with a strap or rope attached);

וכל בעלי השיר יוצאין בשיר ונמשכין בשיר

(c)

All Ba'alei Shir (animals that normally go out with a Shir) may go out with a Shir and are pulled by a Shir [on Shabbos].

ומזין עליהן וטובלן במקומן:

(d)

[If it became Tamei], one may sprinkle [Mei Chatas] on it and immerse it while it is in place (on the animal. We are not concerned lest the animal be a Chatzitzah, i.e. if it is too tight).

גמ' תני רבי ישמעאל בי רבי יוסי משום אביו. ארבע בהמות נמשכות באיפסר ואילו הן הסוס והפרד הגמל והחמור.

(Gemara - Beraisa - R. Yishmael bei Rebbi Yosi citing R. Yosi): There are four animals that are pulled by a halter - a horse, mule camel and donkey.

א''ר חזקיה וסימנא [זכריה יד טו] וכן תהיה מגפת הסוס הפרד הגמל והחמור.

(R. Chizkiyah): The Siman (way to remember this) is "v'Chen Tihyeh Magefas ha'Sus ha'Pered ha'Gamal veha'Chamor.''

(Rav): The Halachah follows R. Yishmael b'Rebbi Yosi.

Our Mishnah says Luvdakim. Some teach "Lugdakas'';

מאן דמר לובדקם על שם [דניאל יא מג] ולובים וכושים במצעדיו. מאן דמר לגדקס אבמטוס.

The one who says Luvdakim, this is based on "v'Luvim v'Kushim b'Mitz'adav'' (i.e. donkeys of Luv). The one who says Lugdakas, this is Avamatus.

מהו אבמטוס. חמר סלק.

What is Avamatus? It is a donkey from Silak (Ashur - PNEI MOSHE).

ר' יונה אמר [דף לח עמוד א (עוז והדר)] רב הושעיה בעי גרים הבאים מלובים מהו להמתין להן ג' דורות.

Question (R. Yonah citing R. Hoshayah): Converts who come from Luvim - must they wait three generations [before marrying into Yisrael, like the law of a Mitzri convert]?

א''ר יונה בן צרויה מן מה דנן חמיי ההן פולא מיצרייא כדון רטיב אינון צווחין ליה לובי. כדו נגיב אינון צווחין ליה פול מצרייא. הדא אמרה גר מלובי צריך להמתין ג' דורות.

(j)

Answer (R. Yonah ben Tzeruyah): Since we say that Mitzri beans, when they are wet they are called Luvi, and when they are dry they are called Mitzri beans, this shows that converts from Luvi must wait three generations.

Note: A Mishnah (Yadayim 4:4) permits Amoni converts, because Sancheriv exiled and mixed up the nations. For this reason, R. Akiva permitted a Mitzri convert (Tosefta Kidushin 5:4), and R. Gamliel wanted to do so (Tosefta Yadayim 2:8), but there it concludes that Mitzriyim returned to their land, and are forbidden.

הדא אמרה הוא לובי הוא מצרי.

Inference: Luvi is Mitzri.

(R. Yitzchak bar Nachman citing R. Oshaya): The Halachah follows the Talmid (R. Yonah was a Talmid of R. Oshaya - R. SHLOMO SIRILIYO, Kil'ayim 8:3).

דברי חכמים כל מין פרדות אחד.

Chachamim say that all mules are one species. (R. Yehudah argues, and says that everything born to a female horse is one species. The above Sugya in Kil'ayim 8:3 was relevant to Luvdakim. When the Yerushalmi brings from other relevant Sugyos, it often copies more than just what is relevant.)

(R. Shmuel citing R. Ze'ira): Just like you say about Isur (in Mishnah 3, it says that a camel may not go out... the same applies to all animals), so you say about all other animals for Heter (our Mishnah permits a camel with a halter, and a Na'akah with an iron bit... - the same applies to all animals, unless taught explicitly otherwise).
