COOKING NOT ON A FIRE (Yerushalmi Perek 3 Halachah 3 Daf 22b)

מתני' אין נותנין ביצה בצד המיחם בשביל שתתגלגל ולא יפקיענה בסודרין

(a)

(Mishnah): One may not put an egg near a [hot] kettle in order to roast. (Chachmas Mano'ach - this is called Megalgel, for a roasted egg spins nicely), nor wrap (Aruch; Rashi - crack) it in [hot] garments [in order to roast];

R. Yosi permits.

לא יטמיננה בחול ובאבק דרכים בשביל שתיצלה

One may not be Matmin (wrap) it in sand or dust of the road in order to roast;

מעשה שעשו אנשי טבריא והביאו סילון של צונן בתוך אמה של חמין

A case occurred in which people in Tiverya brought a pipe of cold water through a hot spring. (Cold water constantly flowed through and became heated. Alternatively, it emptied into the spring, heating the cold water and tempering the heat of the spring. Alternatively, they put a Kli of cold water in the spring. To bathe on Shabbos in the Kli, they would open plugs, letting hot water into the Kli);

אמרו להן חכמים אם בשבת כחמין שהוחמו בשבת ואסורין ברחיצה ובשתייה ואם ביום טוב כחמין שהוחמו ביום טוב ואסורין ברחיצה ומותרין בשתייה

Chachamim: If this was on Shabbos, it is considered water heated on Shabbos. One may not bathe in it or drink it. If it was on Yom Tov, it is considered water heated on Yom Tov. One may not bathe in it, but one may drink it.

(Mulyar and Antichi are kinds of kettles with compartments to hold coals.) One may drink on Shabbos from a Mulyar that was Garuf (swept). One may not drink from an Antichi, even if it was Garuf.

גמ' תמן תנינן תפוח שריסקו ונתנו לתוך העיסה [דף כח עמוד ב (עוז והדר)] וחימצה הרי זו אסורה.

(f)

(Gemara - Mishnah): If one minced an apple [of Terumah] and put it in a [Chulin] dough and fermented it, it is forbidden [like Terumah].

תני רבי יוסי מתיר.

(Beraisa - R. Yosi): It is permitted.

רבי אחא רבי אבהו בשם רבי יוסי בר חנינה [דף כג עמוד א] מה פליגון במחמץ במימיו אבל המחמץ בגופו דברי הכל מותר.

(R. Acha citing R. Avahu citing R. Yosi bar Chaninah): They argue about one who fermented with its juice, but if one fermented with it itself, all permit.

רבי יוסי כדעתיה כמה דו אמר תמן אין חימוצו ברור. כן הוא אמר הכא אין תבשילו תבשיל ברור.

R. Yosi holds like he taught there. Just like he said there that [it is permitted to Zarim because] it is not proper fermentation, so he holds here that [what is not cooked on a fire] is not a properly cooked Tavshil.

תנא אמר רבי יוחנן בר מרייא בשלא העביר ידו ממנו אבל העביר אסור.

(i)

(Beraisa - R. Yochanan bar Maryei): [R. Yosi permits] when he did not remove his hand from [the egg], but if he removed it, it is forbidden (it looks like cooking - PNEI MEIR).

פגה שטמנה בתבן וחררה שטמנה בגחלים אם היו מקצתן מגולין ניטלין בשבת ואם לאו אין ניטלין.

(j)

If one wrapped an unripe fig in straw, or a cake that was wrapped in coals - if part of them was exposed, one may take them on Shabbos. If not, one may not take them.

רבי לעזר בר תדאי אומר בין כך ובין כך תוחב בשפוד ובסכין ונוטל.

(R. Lazar bar Tadai): In either case one may insert a spit or knife [through what it is wrapped in] and take it.

R. Lazar bar Tadai's law is like R. Shimon [who permits Davar she'Eino Miskaven. OHR SOMAYACH Hilchos Shabbos 25:15, citing the Rambam's son - taking the cake causes coals to extinguish or flare up.]

דתני לא יגרר אדם את המטה ואת הכסא ואת הספסל ואת הקתדרה מפני שהוא עושה חריץ. ור''ש מתיר.

(Tosefta): One may not drag [on the ground] a bed, chair, bench or special chair [for women to ride on], because he makes a furrow. R. Shimon permits.

ר' בא בשם רבי הונא ר' חגיי בשם ר' זעירא ר' יוסה בשם רבי אילא מודין חכמים לר''ש בכסא שרגליו משוקעות בטיט שמותר לטלטלו.

(m)

(R. Ba citing R. Huna, R. Chagai citing R. Ze'ira, and R. Yosah citing R. Ila): (R. Lazar's law is even like Chachamim.) Chachamim agree to R. Shimon about a chair whose legs are sunk in mud, that one may move it [since it does not make a furrow].

כמה דאת אמר מותר לטלטלו. ודכוותה מותר להחזירו.

Just like one may move [the chair], one may return it (this is not making a new hole).

Support #1 (for R. Ila - R. Yosi - Mishnah): [A radish or turnip buried under a vine, if some of the leaves are exposed,] one may take it on Shabbos. (Likewise, one may move a chair whose legs are sunk in mud.)

Rebuttal (R. Yosi bei R. Bun): [The Mishnah] is like R. Shimon [but Chachamim, who forbid Davar she'Eino Miskaven, forbid.]

Support #2 (R. Yosi - Mishnah): All Kelim may not be dragged [on the ground], except for a wagon, for it compresses [the earth underneath, but does not make a furrow. This is like R. Yehudah, who forbids Davar she'Eino Miskaven, and he permits even though he moves earth!]

והא תנינן שביעית. אית לך מימר שביעית [דף כט עמוד א (עוז והדר)] כרבי שמעון (דפתר לה שביעית כרבי שמעון דרבי) [צ''ל רבי - שערי תורת ארץ ישראל] שמעון מתיר בספיחי שביעית ואת אמר הכין.

Question (against Rebuttal): The Mishnah [permits removing a radish or turnip only if some of the leaves are exposed, also in] Shevi'is! (If not, the additional growth is forbidden.) Can you say that [this law of] Shevi'is is like R. Shimon?! R. Shimon permits Sefichei Shevi'is (what grew by itself) and you say so?! (Just like regarding Shevi'is it is unlike R. Shimon, also regarding Shabbos!)

אף על גב דרבי שמעון מתיר בספיחי שביעית אית ליה משום שביעית ומשום קדושת שביעית.

Answer: Even though R. Shimon permits Sefichei Shevi'is, he holds that there is concern for [planting in] Shevi'is and Kedushas Shevi'is [if none of the leaves were exposed];

ותנינן על דרבי שמעון טהרו מלטמא אינו חושש לא משום שביעית ולא משום קדושת שביעית [דף כג עמוד ב]

It was taught about R. Shimon's opinion that [if some of the leaves are exposed,] it became Tahor, and he is not concerned for Shevi'is and Kedushas Shevi'is.

תמן אמרין חמה מותרת תולדת חמה אסורה.

(s)

There (in Bavel) we say that [cooking in] the sun is permitted, but [cooking in] Toldos Chamah (Kelim heated in the sun) is forbidden;

רבנן דהכא אמרין בין חמה בין תולדת חמה מותרת.

Rabanan here (in Eretz Yisrael) say that both the sun and Toldos Chamah are permitted.

מתני' פליגא על רבנין דהכא לא יטמיננה בחול ובאבק דרכים בשביל שתצלה.

Question: Our Mishnah opposes Rabanan here! One may not wrap [an egg] in sand or dust of the road in order to roast!

שנייא היא שהוא עושה חריץ. אילו אמר בקמח יאות.

Answer: There is different. [It is not forbidden due to cooking, rather,] for he makes a furrow [in the sand or dust]. Had the Mishnah [forbade] in flour, [the question against Rabanan would be] proper.

מתני' פליגא על רבנין דתמן

(v)

Question: A Beraisa opposes Rabanan there!

דתני ר' שמעון ב''ג אומר מגלגלין ביצים על גב גג של סיד רותח. ואין מגלגלין ביצים על גבי עפר רותח. מה עבדין לה רבנן דתמן.

(Beraisa - R. Shimon ben Gamliel): We may roast eggs on the roof, on hot plaster, but we may not roast eggs on hot earth. (He forbids only when one moves earth, but not due to Toldos Chamah!)

פתרין לה חלוקין על רשב''ג.

Answer: They answer that Rabanan argue with R. Shimon ben Gamliel [and the Halachah follows Rabanan].

על דעתין דרבנן דתמן מעשה שעשו אנשי טבריא. (ועל דעתין דרבנן דהכא) [צ''ל סלקא על דעתיהון דרבנין דהכא לא - רשב''א לט:ב] סלקת מתניתין כמעשה שעשו אנשי טבריא:

According to Rabanan there, the act that people of Tiverya did (i.e. Chachamim's protest against them) is the Halachah. According to Rabanan here, our Mishnah is unlike [Rabanan's protest against] the act that people of Tiverya did. (Rather, the Halachah follows the people of Tiverya.)
