LEAVINGS THINGS IN AN OVEN OR ON A FIRE (Yerushalmi Perek 1 Halachah 6 Daf 12a)

מתני' [דף טו עמוד א (עוז והדר)] ב''ש אומרים אין נותנין אונין של פשתן לתוך התנור אלא כדי שיהבילו מבעוד יום ולא את הצמר ליורה אלא כדי שיקלוט את העין.

(a)

(Mishnah): Beis Shamai forbid putting bundles of combed flax in an oven unless they will get warm before Shabbos, or wool in a pot [of dye] unless it will absorb the color [before Shabbos];

וב''ה מתירין:

Beis Hillel permit.

(Gemara) Question: What does it help (if it absorbs the color before Shabbos, if it is not fully dyed)?

א''ר אבהו כגון אילין קורייאי דלא מקפדין.

Answer (R. Avahu): We discuss villagers (PNEI MOSHE), who are not adamant [if it is not fully dyed].

רב יהודה בשם שמואל והיא שתהא היורה עקורה. אבל אם היתה היורה קבוע אסורה מפני שהוא מתיירא שמא מתאכל ציבעו והיא מוסיף מוי.

(Rav Yehudah citing Shmuel): [It is permitted] only if the pot is removed [from the fire], but if it is fixed [in its place on the fire], it is forbidden, for he fears lest [the water boil off and] the dye burn, and he will add water (and it will get cooked).

רבי שמואל בשם רבי אבהו ב''ה ילפון מלאכת היתר ממלאכת איסור. אילו עשה כן בשבת שמא אינו אסור. ודכוותה עשה כן מבעוד יום מותר:

(R. Shmuel citing R. Avahu): Beis Hillel learn permitted Melachah from forbidden Melachah. If he did so (began Melachah) on Shabbos, is it not forbidden (i.e. he is liable, even if it finishes after Shabbos)? Correspondingly, if he did so (began Melachah before Shabbos) during the day, it is permitted [even if it will finish on Shabbos. We explained this like AVNEI NEZER OC 1:48:6.]

CONCERN FOR TRAPPING ON SHABBOS OR YOM TOV (Yerushalmi Perek 1 Halachah 7 Daf 12a)

מתני' בית שמאי אומרים אין פורשין מצודות חיה ועופות ודגים אלא כדי שיצודו מבעוד יום

(a)

(Mishnah): Beis Shamai forbid setting traps for animals, birds or fish unless they will catch something during the day;

ובית הלל מתירין:

Beis Hillel permit.

גמ' מי מודיע.

(Gemara) Question: (A Mishnah (Beitzah 3:2) says that if an animal was found in a trap on Yom Tov, it is permitted on Yom Tov only if it was trapped before Yom Tov.) Who will tell us [when it was caught]?

אם נתקלקלה המצודה דבר בריא שניצודו מבעוד יום. ואם לא נתקלקלה המצודה דבר בריא שלא ניצודו מבעוד יום.

(d)

Answer: If the trap was dislocated [during the day], surely it was trapped during the day. If the trap was not dislocated, surely it was not trapped during the day.

ואפי' נתקלק[ל]ה המצודה חש לומר שמא לא ניצודו מבעוד יום.

(e)

Question: Even if the trap was dislocated [during the day], we should be concerned lest it [happened by itself, or by another animal that was not trapped, and what is there now] was not trapped during the day! (We explained this like PNEI MOSHE.)

Answer (R. Yosi bei R. Bun): The case is, he set [the trap] in a forest (full of animals. We may assume that something was caught before dark. GILYONEI HA'SHAS - this is brought here to explain why Beis Shamai require that it can trap during the day. Even if it does not, perhaps it will not trap on Shabbos! Rather, also here he sets in a forest. Surely something will be caught either before Shabbos or on Shabbos.)

תדע לך שהוא כן דתנן דגים. ודגים לא במקום שהן מצויין. וכא במקום שחיה ועוף מצויין.

Support: It taught also fish. Was not the fish trap put in a place where fish are found? Here, [the trap for animals and birds] is in a place where animals and birds are found!

(In the Mishnah in Beitzah, R. Gamliel permits fish that a Nochri brought to a Yisrael on Yom Tov.) We thought to say that [one may move them today, and eating them] tomorrow is permitted. R. Chizkiyah and R. Uzi'el brei d'R. Chuniyah of Beis Chavran said, they are truly permitted [to eat even today]. They hold that [Chachamim] permitted a Safek (perhaps they were caught on Yom Tov).

(R. Chananyah and R. Yonason): A Safek of Muchan (whether or not something was prepared before Shabbos or Yom Tov) is forbidden.

רבי יוחנן אמר ספק הכן מותר.

(R. Yochanan): A Safek of Muchan is permitted.

רבי חייא רובה ורבי שמעון ב''ר חד אמר העכו''ם צריך הכן. וחרנה אמר אין העכו''ם צריך הכן. ולא ידעינן מאן אמר דא ומאן אמר דא.

R. Chiyah Rabah and R. Shimon bar Rebbi argued. One said that [something brought via] a Nochri needs Hachanah (preparation before Shabbos or Yom Tov), and the other said that a Nochri does not need Hachanah. We do not know who said this and who said this.

מן מה דרב מעני מיתי קומיה רבי חייה רובא והוא א''ל הן הויתא והוא אמר ליה (שירתה הוות עברא) [צ''ל שיירתא הוה עברה - קרבן העדה] והוינא אכול מינה תאינון.

Inference: [A case occurred in which] Rav was late to come in front of R. Chiyah Rabah [on Shabbos or Yom Tov], and [R. Chiyah] said to him "where were you?'', and he said that a caravan passed and he was eating figs from it...

הוי הוא דו אמר אין העכו''ם צריך הכן.

Inference: This shows that [R. Chiyah] said that a Nochri does not need Hachanah. (He did not rebuke Rav for eating them.)

חד תלמיד מן [צ''ל דרבי, כמו בביצה ג:ב] סימאי אזל לאנטיוריס ואייתון ליה דרמסקינא ואכל.

One Talmid of R. Simai went to Antiyoris, and [on Yom Tov, Nochrim] brought to him fruits and he ate.

Note: How could Rav and R. Simai's Talmid eat them? The Rambam says that even if a Nochri can acquire land in Eretz Yisrael to exempt from Ma'aser, mid'Rabanan it is obligated! We can say that for Terumah mid'Rabanan, one may rely on Bereirah to eat now and separate later (after Shabbos). The Rambam holds that nowadays all Terumah is mid'Rabanan. And most Meforshim hold that Terumah of figs is always mid'Rabanan.

One Talmid of R. Yehoshua ben Levi went to there, and they brought to him fruits and he did not eat. He came and said in front of his Rebbi.

א''ל דו נהיג כשיטתיה דרבי סימאי. דרבי סימאי אמר אין העכו''ם צריך הכן.

R. Yehoshua ben Levi: [The other] Talmid did like [his Rebbi,] R. Simai, for R. Simai said that a Nochri does not need Hachanah.

רבי אבהו בשם ריב''ל דמדמניות שבכרם הרי אלו אסורות.

(o)

(R. Avahu citing R. Yehoshua ben Levi): Dimdaniyos (grapes that dry up and fall off the vine - SHA'AREI TORAS ERETZ YISRAEL, from ha'Ma'arich) in the vineyard are forbidden on Yom Tov (perhaps they fell off today. This was brought to suggest that the above Talmid of R. Yehoshua ben Levi was R. Avahu.)

רב הונא בשם רב שצים שבכפים הרי אלו מותרין:

(Rav Huna citing Rav): [Dates that fell onto] thorns and leaves [of a date tree], they are permitted (they normally stay there a long time. Presumably, they fell off before today. We explained this like HA'GAON RAV C. KANIEVSKY, SHLITA.)

NOCHRIM MAY NOT APPEAR TO WORK FOR YISRAELIM ON SHABBOS (Yerushalmi Perek 1 Halachah 8 Daf 12b)

מתני' ב''ש אומרין אין מוכרין לעכו''ם ולא טוענין עמו ולא מגביהין עליו אלא כדי שיגיע למקום קרוב

(a)

(Mishnah): Beis Shamai forbid selling to a Nochri, or helping him load a donkey or himself unless he can reach a close place [before Shabbos];

וב''ה מתירין:

Beis Hillel permit.

גמ' אי זהו מקום קרוב

(Gemara) Question: What is a close place?

ייבא כיי דמר שמואל כגון מן חוטרא לנהרדעא. אוף הכא כן.

Answer #1: It is like Shmuel said, e.g. from Chutra to Neharde'a. The same applies here.

Answer #2: It is so he can reach his house.

ואית דבעי מימר עד שהוא מגיע לעירו.

Answer #3: It is so he can reach his city.

רבי עקיבה אומר כדי שיצא ממקום הפתח ויקדש עליו היום.

R. Akiva says, he must be able to leave the opening [of the Yisrael's house] before Shabbos comes.

(h)

(R. Yochanan): (Our Mishnah says that Beis Hillel always permits.) These are R. Yosi's words. R. Akiva comes to give [his opinion about] Beis Hillel's opinion.

אין נותנין לעכו''ם על מנת לצאת נטל ויצא אין את זקוק לו.

(i)

We do not give to a Nochri in order to take out [on Shabbos]. If he took out, [the Yisrael] is not responsible for him.

אין נותנין לכלב על מנת לצאת נטל ויצא אין את זקוק לו.

(j)

We do not give [food] to a dog on condition to take out [on Shabbos]. If it took out, he is not responsible for it.
