TOSFOS DH Ad Kavla

(SUMMARY: Tosfos explains that this is until the thigh.)

(a)

Explanation (Ri): This is until the thigh, like it says below (63b) "Biris (like a bracelet on the leg to hold up socks) is on one [leg], Kevalim are on two." They put Kevalim on the thigh.

2)

TOSFOS DH Rav Amar Leyavesh Mutar

(SUMMARY: Tosfos explains why he did not cite the Tana he rules like.)

(a)

Question: He should say "the Halachah follows Mar"!

(b)

Answer: [He did not,] because some switch [the opinions of] the Tana'im.

3)

TOSFOS DH Halachah k'R. Yehudah ben Beseira

(SUMMARY: Tosfos explains how this is unlike R. Yosi.)

(a)

Implied question: Why did he mention R. Yehudah ben Beseira, and not R. Yosi?

(b)

Answer: In a place where they are wrapped only to be dry, R. Yehudah ben Beseira permits. There, we cannot say "who knows [that it is to be dry]?!"

1.

R. Yosi forbids, lest it fall.

4)

TOSFOS DH R. Tam Garis Amar

(SUMMARY: Tosfos brings R. Tam's text.)

(a)

Explanation: In R. Tam's text, Rav rules like the first Tana, and Shmuel says... and similarly, when Ravin came, he cited R. Yochanan to say that the Halachah follows the first Tana.

(b)

Support: [According to this text, the third version] is fine. [It says that] some teach that Rav and Shmuel's opinions above referred to this [Beraisa. In our text, the third version does not cite Rav's opinion.]

5)

TOSFOS DH veha'Tanan Adam Mutar Im Kulam Lachrosh v'Limshoch

(SUMMARY: Tosfos explains how Kil'ayim of man applies.)

(a)

Question: Even if man was forbidden, this is difficult. How does Kil'ayim apply, since he does not pull the wagon or carriage, for we discuss on Shabbos!

1.

Suggestion: It is forbidden to conduct Kil'ayim (cause different species to walk together), even if they do not pull anything.

2.

Rejection: If so, it would be forbidden to make an ox of Pesulei ha'Mukdashim (a blemished Korban) walk or move from its place, for it is considered like two species (Kodshim and Chulin), like it says in Makos (22a) that one who conducts an ox of Pesulei ha'Mukdashim is lashed - it is one body, and the Torah made it [like] two bodies!

(b)

Answer #1: The Gemara means as follows. If you will say that (it is forbidden due to) Kil'ayim of man, and this that it teaches "as long as he does not wind [the ropes on his hand] refers to during the week, like we established above (23b) "and not with oil that must be burned (Tamei Terumah), which discusses [not Shabbos, rather,] on Yom Tov, and the case is, they pull something.

(c)

Answer #2: It is considered pulling something, for both of them carry the ropes.

TOSFOS DH Mai Taima Dilma Nafal v'Asi Le'asuyei

(SUMMARY: Tosfos points out that this is unlike we said above.)

(a)

Implied question: Above (53b), we established this when it is tied [now, just it was not tied from before Shabbos]!

(b)

Answer: Here [the Gemara] explains according to the simple reading of our Mishnah [that it is not tied now]. Because it elaborated above, it was not concerned to elaborate here.

(c)

Observation: Rashi's Perush connotes that his text does not say "lest he come to carry it."

7)

TOSFOS DH Mishum d'Michzi k'Man d'Azil l'Chigna

(SUMMARY: Tosfos explains why this is the only concern.)

(a)

Explanation: However, it is not a load, for [the bell] is Batel to the harness;

1.

We are not concerned lest he come to carry it, like we are concerned about a bell below (58b), for here we discuss when it is woven [into the harness], and it says there that they did not decree about anything woven.

8)

TOSFOS DH d'Lo Limtzeyuah Ye'eli

(SUMMARY: Tosfos concludes that this is a porcupine.)

(a)

Explanation #1 (Rashi): This is a leech.

(b)

Rebuttal #1: Leeches suck only blood!

(c)

Rebuttal #2: It should have said "Alukos". We do not find that [leeches] are called Ye'eli anywhere!

(d)

Explanation #2: Ye'eli is Kupar of our Mishnah, like it says in Bava Basra (4a) that Hurdus put a crown of Ye'eli [on his face] and made holes for his eyes. The Targum of "ha'Anakah" (one of the eight Sheratzim) is Ye'eli, what we call (in old French) the Yartzon (porcupine).

9)

TOSFOS DH Havah Ma'aser R. Elazar ben Azaryah Kol Shasa v'Shasa

(SUMMARY: Tosfos resolves this with the decree not to take Ma'aser Behemah nowadays.)

(a)

Question (R. Tam): It says in Bechoros (53b) that Ma'aser Behemah does not apply after the Churban, due to pitfall (we cannot offer it, and perhaps one will transgress shearing it, working with it, or slaughter it without a Mum);

1.

If so, he used to tithe while the Mikdash stood. Presumably, he was [at least] 13 years old when he tithed. If so, why does it say "every year"? You are forced to say that at the time of the Churban, he was at most 14 or 15!

2.

Source: R. Yochanan ben Zakai was Nasi after the Churban one or two years, for he made several enactments after the Churban, like the Mishnah says "after the Churban, R. Yochanan ben Zakai enacted...";

3.

After him, R. Gamliel was Nasi two or three two years before they appointed R. Elazar ben Azaryah, like it says in Brachos (27b) "last year, [R. Gamliel] pained R. Tzadok. Before that, he pained R. Yehoshua regarding fixing [which day is Rosh Hashanah, which affects] the date of the Mo'adim;

4.

When they appointed [R. Elazar] to be Nasi, he was 18 years old, like it says there. It turns out that at the time of the Churban, he was at most 14 or 15!

(b)

Answer #1: He used to tithe [after the Churban,] before the decree [not to].

(c)

Answer #2: An overseer used to tithe for [R. Elazar] when he was a minor.

(d)

Answer #3 (R. Elchanan): After the Churban he used to tithe animals for the king's tax.

10)

TOSFOS DH Rav v'R. Chanina v'R. Yochanan v'R. Chaviva Masnei

(SUMMARY: Tosfos explains that the Gemara interrupts to teach about switching R. Yochanan.)

(a)

Explanation: They taught the coming teaching;

1.

Now, the Gemara interrupts and says that everywhere in Seder Mo'Ed, whenever these [four] are taught [together], we switch R. Yochanan... The word "Masnei" (they taught) does not apply to switching. The Rashbam received so from Rashi, who heard so from his Rebbi R. Eliezer.
