TOSFOS DH v'Al Haza'ah sheb'Sha'as Melachah Mishum Haza'ah she'Lo b'Sha'as Melachah

(SUMMARY: Tosfos explains why we do not decree so for an ax handle.)

(a)

Question: Regarding a stick that he made a handle for an ax, it says that it is connected for Tum'ah, but not for Haza'ah;

1.

What is the reason? It is not applicable to decree there due to not at the time of Melachah, like it says above, for a person is wont to throw it among wood [destined to be burned]!

(b)

Answer: There, it is not connected for Haza'ah, because even at the time of Melachah, it is not connected mid'Oraisa. It is never considered a handle, since he is always prone to throw it [among wood].

2)

TOSFOS DH Aval Lo bi'Chesus Lachah v'Chulei

(SUMMARY: Tosfos points out that this is unlike our Mishnah.)

(a)

Assertion: It seems that [the Beraisa of] R. Oshaya argues with our Mishnah. (It distinguishes between dry and wet clothing. The Mishnah above (47b) distinguished between wet and dry for some matters, and the coming Mishnah permits garments Stam, i.e. even wet.)

3)

TOSFOS DH k'Elisha Ba'al Kenafayim

(SUMMARY: Tosfos discusses why our observance of Tefilin is weak.)

(a)

Explanation: It mentions Elisha because presumably, since a miracle was done for him with Tefilin, he was careful about them, and had a clean body.

(b)

Remark: We cannot exempt ourselves [from wearing Tefilin the entire day] for this reason (Tefilin requires a clean body), for we can be careful about this.

(c)

Observation: It is not surprising that this Mitzvah is weak in our hands, for also in the days of Chachamim it was weak, like a Beraisa below (130a) teaches;

1.

Citation (130b - Beraisa - R. Shimon ben Elazar): Every Mitzvah that Yisraelim were not willing to die for when kingdoms decreed against it, like Tefilin, it is still weak in their hands.

(d)

Citation (Rosh Hashanah 17a): [An example of] Posh'ei (sinners of) Yisrael with their bodies, is a head that did not wear Tefilin.

(e)

Explanation (R. Tam): This refers to people who do not wear due to rebellion, and they disgrace the Mitzvah, and they play with the strap on their arm and head, like it says in Yoma (36b) "Posh'im are sins of rebellion."

(f)

Citation (Midrash): Why weren't they Machazik (strengthen people to carefully observe) Tefilin? It is due to swindlers.

(g)

Explanation (Ri): They did not refrain from doing a Mitzvah due to swindlers. Rather, it asks "why didn't they establish a person wearing Tefilin to be trustworthy?" It answers that it is due to swindlers, who wore Tefilin to deceive people;

1.

This is like it explains there an episode in which a Talmid deposited coins with a man wearing Tefilin. When he claimed them, the Shomer said "you never deposited with me!" The Talmid said "I did not deposit with [trust in] you, rather, with the Tefilin on your head." This requires investigation there.

4)

TOSFOS DH Amar Abaye she'Lo Yafi'ach Bahen

(SUMMARY: Tosfos explains the argument of Abaye and Rava.)

(a)

Explanation: He can guard himself from emitting gas until he removes Tefilin, like Rashi explained. However, he is not concerned lest he sleep, even though sometimes he cannot be careful to avoid sleep;

1.

Rava requires also that he can control himself when sleep [almost] seizes him, that he not sleep suddenly.

2.

However, Abaye agrees that it is forbidden to sleep in them, like a Beraisa (Sukah 26a) says that one may not sleep in Tefilin, not a fixed sleep and not a nap.

5)

TOSFOS DH she'Lo Yishan Bahen

(SUMMARY: Tosfos explains that the only concern is gas.)

(a)

Explanation: [He is concerned that he not sleep in them] lest he emit gas, but there is no concern for Hesech ha'Da'as (taking his mind off them) or a seminal emission, like it says in Sukah (26a);

1.

R. Yosi said, youths always remove Tefilin, for Tum'ah is common among them;

2.

The Gemara asks, does R. Yosi hold that a Bal Keri may not wear Tefilin? It answers, here we discuss youths with their wives. Perhaps they will come to relations, but we did not want to say that it is forbidden because [he saw] Keri.

6)

TOSFOS DH Natlam mi'Rosho

(SUMMARY: Tosfos explains why one need not forfeit his life for Tefilin.)

(a)

Implied question: It says in Sanhedrin (74b) that at the time of royal decrees, even for a light Mitzvah, one must submit to be killed and not transgress. Even to change shoelaces is forbidden!

(b)

Answer: That is because through changing shoelaces, he conducts like a Nochri, and removes himself from Klal Yisrael;

1.

However, here he does not do anything, just he does not have Tefilin on his head for a short time. Many Yisraelim do not have Tefilin [on their heads], like him.

7)

TOSFOS DH Kenafeha Meginos Aleha

(SUMMARY: Tosfos explains this based on the Midrash.)

(a)

Explanation (Ri): We say in the Midrash that all birds, when they are tired, rest on a rock. The dove, when she is tired, flies with one and rests with one.

8)

TOSFOS DH Tomnin bi'Shelachin u'Metaltelin Osan

(SUMMARY: Tosfos discusses when one may move hides.)

(a)

Implied question: It says in Beitzah (11a) that we put a hide where it will be trampled. They permitted the end due to the beginning, i.e. in order that people slaughter for the needs of Yom Tov [and not refrain due to concern lest the hide spoil];

1.

However, a hide [from an animal slaughtered] before Yom Tov, it connotes there that it one may not move it.

2.

Below (116b) it says "if we may carry the case of a Sefer with the Sefer, can we not (i.e. all the more so we may) move the hide due to the meat?!" This implies that one may not move hide without meat.

(b)

Answer #1 (Rashi 116b): Here we discuss the hide of a big (work) animal. There we discuss the hide of a small animal, which is not so proper to lie on.

(c)

Consequence: According to this, also the case in Beitzah discusses the hide of a small animal.

1.

Implied question: A Mishnah (120a) says that we may spread the hide of a goat on a chest [that caught fire]!

2.

Answer: According to Rashi, we must say that this is when he designated it to sit on.

(d)

Answer #2 (R. Tam): Here we discuss dry hides, which are proper to lie on, and there we discuss wet [hides].

49b----------------------------------------49b

9)

TOSFOS DH Aba Shalcha

(SUMMARY: Tosfos explains that he moved hides on Shabbos.)

(a)

Explanation #1 (R. Chananel): He said "bring to me hides" on Shabbos. The Halachah follows R. Yosi, for this was followed in practice.

(b)

Explanation #2 (Rashi): [He asked to bring hides] during the week. He brings a proof only that also a craftsman is not more adamant [than others not to use them].

(c)

Rejection: If so, he should have brought R. Yosi' teaching below that explicitly permits a craftsman's [hides. Since the episode does not show that this was followed in practice, an explicit ruling is better than an episode from which we may infer the law.]

10)

TOSFOS DH Lo Amru Avudin Ela l'Inyan Tum'ah Bilvad

(SUMMARY: Tosfos discusses the difference between Tum'ah and Shabbos.)

(a)

Explanation #1 (Rashi): A hide is Mekabel Tum'ah only after tanning.

(b)

Question: It says in Zevachim (93b) what is the source to include hide after it was flayed? It says "Asher Yazeh Alav Techabes";

1.

Citation (93b) Suggestion and Rejection: Perhaps this is even for hide before it was flayed? It says "Beged" - just like a garment receives Tum'ah, also everything that receives Tum'ah.

2.

A hide after it was flayed is Mekabel Tum'ah!

(c)

Answer: There, he designated it to sit on. Here, he did not designate it to sit on, and even so one may move it on Shabbos.

(d)

Implied question: It says below (123a) "since regarding Tum'ah it is not a Kli, also regarding Shabbos it is not a Kli", regarding a needle from which its hole or point was removed!

(e)

Answer: This means that since regarding Tum'ah it is not a Kli even through designation - since its hole or point was removed it is Tahor, and designation does not help [also regarding Shabbos].

(f)

Implied question: A Mishnah (Kelim 13:5) teaches that if the hole or point of a needle was removed, it is Tahor, and if he prepared it for stretching [garments], it is Tamei!

(g)

Answer (Ri): There, we discuss when he made a change and fixed it for stretching, but through mere designation for stretching, it is not Tamei;

1.

However, when it is a Kli for Tum'ah through designation, for Shabbos it is a Kli without designation.

2.

Support: It connotes like this there. Abaye answered for Rava [that the Beraisa discusses] unfinished [needles]. Sometimes one decides to use them as is [without a hole] and makes them a Kli. Therefore one may move it even though he did not yet reconsider, and it is Tahor.

11)

TOSFOS DH Arba'im Avos Melachos Chaser Achas k'Neged Mi

(SUMMARY: Tosfos explains the basis of this question.)

(a)

Explanation: There are many Melachos that resemble each other, and we should have considered all of them like one, like it asks below (73b) "winnowing, Borer and sifting are the same!"

1.

Due to a small difference between them, we would not distinguish them, if not that [Chachamim] knew that there are 39 Melachos, corresponding to some matter. Therefore we ask what [39] corresponds to.

12)

TOSFOS DH k'Neged Kol Melachah sheb'Torah

(SUMMARY: Tosfos concludes that he learns from this alone.)

(a)

Explanation #1: It seems that [R. Yonason ben Elazar] learns also from the Mishkan, for this is why Parshas Shabbos was written next to Parshas Mishkan;

(b)

Support #1: If he does not learn from the Mishkan, according to him, how do we know which are Avos Melachos and which are Toldos? It is unreasonable that based on their own opinion [Chachamim] clarified which Melachos are important and made them Avos!

(c)

Support #2: Below (96a), a Mishnah explicitly teaches that one who passes is liable, for this was the service of the Leviyim.

(d)

Explanation #1 (cont.): However, since there are Melachos that resemble each other, and we make both of them Avos, e.g. sifting and Borer, therefore Chachamim divided them to complete the number of times "Melachah" is written in the Torah, since they are slightly different from each other.

(e)

Rebuttal #1 (and Explanation #2): You cannot say so, that he does not argue, since it says below "a Beraisa supports the one who says corresponding to labors in the Mishkan." This implies that they argue [about whether or not we learn from the Mishkan]!

1.

Note: Maharam asks that if so, R. Yonason ben Elazar argues with the Mishnah that learns from the Leviyim! He answers that this is an inferior Melachah, and we would not obligate for it had we not found it in the Mishkan. Rashash says that indeed, R. Yonason argues with the Mishnah. He is a Tana!

(f)

Rebuttal #2: According to the opinion that argues with the Drashah of "Melaches" and "Melachah", what is his source to consider sifting and Borer as two Melachos?

(g)

Rebuttal #3: Below, it connotes that solely due to the reason of corresponding to labors in the Mishkan, we should count them like two!

1.

Abaye and Rava say (73b) that everything that was in the Mishkan, even if there is [another Melachah] that resembles it, it is considered [an Av Melachah].

13)

TOSFOS DH Hem Ha'alu Kerashim

(SUMMARY: Tosfos explains that all agree that the wagons were Reshus ha'Yachid.)

(a)

Explanation: Even Rabanan who argue R. Yosi b'Ribi Yehudah about one who inserted a stick in Reshus ha'Rabim and there is a basket on top, and they do not say "Gud Achis" (to project the walls of the basket down, and consider it a Reshus ha'Yachid)...

1.

They agree that a wagon is Reshus ha'Yachid, since the wagon itself has 10 [Tefachim of wall] vertical and a width of four [Tefachim], even though underneath it is Reshus ha'Rabim. In Eruvin (89a) I elaborated more.

14)

TOSFOS DH v'Atem Al Tachnisu

(SUMMARY: Tosfos points out that it is not an Av Melachah.)

(a)

Explanation: Even so, [bringing from Reshus ha'Rabim to Reshus ha'Yachid] is not an Av (it is only a Toldah), like I explained above (2a DH Pashat).
