תוס' ד"ה בלולה במקרא ובמשנה וכו'

פירש רבינו תם - דבתלמוד שלנו אנו פוטרין עצמנו ממה שאמרו חכמים (מסכת ע"ג דף יט.) 'לעולם ישלש אדם שנותיו - שליש במקרא, שליש במשנה, שליש בש"ס.

Ruling #1: Rabeinu Tam explains that by studying our Talmud (Bavli), we exempt ourselves from what the Chachamim say in Avodah-Zarah that one should divide one's years into three - a third T'nach, a third Mishnah and a third, Gemara.

אע"פ כן - אנו קוראים בכל יום פרשת התמיד, ושונים במשנת 'איזהו מקומן' וגורסין 'רבי ישמעאל אומר בשלש עשרה מדות ... '.

Ruling #2: In spite of which we read every day Parshas ha'Tamid, then we learn the Perek Mishnayos 'Eizehu Mekoman' and conclude with the Beraisa of 'R. Yishmael Omer; bi'Shelosh-Esrei Midos ... '.

תוס' ד"ה אמר רב דימי כגון דקבליה עליה בחד

(SUMMARY: Tos refutes Rashi, who interprets this as a clause in R. Meir's ruling. They interpret it as a qualification of that of the Chachamim).

פירש הקונט', דאפילו הכי, קאמר ר' מאיר דיכול לחזור בו.

Explanation #1: Rashi explains that nevertheless, R. Meir permits him to retract.

ולא נהירא, דכיון דלרבותא נקטיה, הוה ליה למימר 'לא צריכא ... ' דמדקאמר 'כגון', משמע דדוקא קא אמר 'כגון דקבליה עליה בחד'.

Refutation: But that is not correct; if it was coming to teach a Chidush, then what the Gemara ought to have said is 'Lo Tzericha ... ' ('No, we need to say ... '). Now that is says 'K'gon ... ', this implies that it is coming to establish the Mishnah specifically in this case (as we shall now explain).

על כן נראה דאמילתייהו דרבנן קאי - דדוקא כגון דקבלוה עלויה בחד, דחדא לריעותא הוא, דאיכא קאמרי רבנן דאינו יכול לחזור בו; אבל אי קבליה עליה כבי תרי יכול לחזור בו אף לרבנן, כיון דאיכא תרתי לריעותא.

Explanation #2: It therefore seems that it refers to the opinion of the Rabanan - that it is specifically where he accepted his father as one Dayan, which is only one fault (as we explained at the beginning of the previous Amud) that the Rabanan forbid him to retract; but if he were to accept him as two Dayanim, he would be permitted to retract even according to them.

(SUMMARY: Tosfos explains why we cannot answer that a. he holds like Resh Lakish, refuting the disproof to that, and b. he is making his own statement).

וליכא למימר דסבירא ליה כר"ש בן לקיש אליבא דר' מאיר?

Implied Question: Why can we not answer that he holds like Resh Lakish?

חדא, כפירוש רש"י, דאין לומר דשביק רבנן ועביד כר' מאיר.

Answer #1: Firstly, because he would leave the Rabbanan and rule like R. Meir, as Rashi explains.

ועוד, דהכא פליגי ר' יוחנן ור"ש בן לקיש; ורבא פסיק פרק החולץ (יבמות דף לו.) כר"ש בן לקיש בתלת, משמע דבכל שאר מקומות ס"ל כר' יוחנן לגבי רשב"ל.

Answer #2: And secondly, because here R. Yochanan argues with Resh Lakish in this matter; and Rava in Perek ha'Choletz rules like Resh Lakish in only three cases, implying that in all other cases (including here), we rule like R. Yochanan.

וליכא למימר הכא טעמיה דנפשיה קאמר כדתירץ לעיל?

Implied Question: Why can we not then say that Rava is simply making his own statement here, like we answered above?

משום דהכא לא קאי אפלוגתא דמתני' כדלעיל, דמשום הכי מפרש לה לעיל טעמיה דנפשיה, אבל הכא ליכא למימר טעמיה דנפשיה קאמר.

Answer: Because he is not referring here to the Machlokes in the Mishnah earlier (which is the reason that we answered that there), but here, where he does not, we cannot say it.

TOSFOS DH SHALACH LEIH LE'ACHAR G'MAR DIN MACHLOKES VE'HALACHAH KE'DIVREI CHACHAMIM

תוס' ד"ה שלח ליה לאחר גמר דין מחלוקת והלכה כדברי חכמים

(SUMMARY: Tosfos queries the inference in our Gemara that brfore the G'mar Din, the Chachamim concede that he can retract, from the Gemara in 'Yesh Nochlin, which implies that he cannot. And they resolve the problem by amending the latter).

תימה, דהכא משמע דלאחר גמר דין מחלוקת, אבל קודם גמר דין יכול לחזור בו; ובפ' יש נוחלין (ב"ב דף קכח. ושם) אמרי' 'אמר לו "עבדי גנבת", "שורי טבחת", והלה אומר "אתה מכרתו לי", "אתה נתתו לי במתנה; רצונך השבע וטול"! נשבע ואינו יכול לחזור בו - משמע מיד שאמר "השבע וטול" שחבירו ישבע ואינו יכול לחזור בו, אלמא אפי' קודם גמר דין אינו יכול לחזור בו?

Question: Here it seems that the Machlokes Tana'im pertains to after the G'mar-Din, but before, one is permitted to retract, unanimously. Whereas in 'Yesh Nochlin', we rule that if Reuvern says to Shimon 'You stole my Eved or my ox and Shimon retorts 'You sold him/it to me or gave it to me as a gift; If you want, swear and take it', he swears and is not permitted to retract! Implying that as soon as he says 'Swear and take', his friend may do so, and he cannot retract, a proof that even before the G'mar-Din, he cannot retract?

להכי גרס ר"ת ' ... ונשבע, אינו יכול לחזור בו', כלומר אם קפץ זה חבירו ונשבע אינו יכול לחזור בו, דכיון דכבר נשבע, הוי לאחר גמר דין; ואמרי' לאחר גמר דין דהלכה כחכמים.

Answer: Therefore, Rabeinu Tam amends the Gemara in 'Yesh Nochlin' to read (not ' ... he swears and is not permitted ... , but) 'if he swore, he is not permitted to retract', meaning that it is only after he swore that he is not able to retract, because since he already swore, it is after the G'mar-Din, and we say that after the G'mar-Din the Halachah is like the Chachamim.

TOSFOS DH VE'EILU HEIN HA'PESULIN

תוס' ד"ה ואלו הן הפסולין

(SUMMARY: Tosfos proves that the Tana only includes Pesulim de'Rabbanan. Consequently, they reject 'Avadim' from the text).

יש גורסין 'עבדים', משום דסבירא ליה דקא חשיב הכא פסולי דרבנן ודאורייתא.

Explanation #1: Some commentaries include 'Avadim in the Mishnah.

ולא נהירא, משום דלא חשיב במתני' רק פסולי דרבנן, דהא 'גזלנים' לא קתני; וכל פסולי דמתני' פסולי דרבנן נינהו.

(b)

Refutation: But this is not correct, seeing as the Tana only includes Pesulim that are de'Rabbanan (as we shall now proceed to prove).

'משחק בקוביא' - אפי' למ"ד אסמכתא היא, ואסמכתא לא קניא, מ"מ אינו דאורייתא, כיון שאינו סבור לעשות איסור, לבא לידי פסול דאורייתא.

Proof #1: 'Playing with dice' - even according to those who consider it Asmachta (and 'Asmachta is not Koneh), is only mi'de'Rabbanan, since people do not consider this an Isur (which is a major criterion that determines being Pasul d'Oraysa).

ולמ"ד משום 'ישובו של עולם', פשיטא דאינו אלא מדרבנן.

Proof #2: And according to those invalidate it because it is not 'Yishuvo shel Olam', it is certainly only mi'de'Rabbanan.

ו'מלוה בריבית' - מיירי בריבית שאינה קצוצה, ואפי' מיירי בריבית קצוצה, לא משמע ליה איסור, כיון דמדעתיה יהיב, ואינו פסול לעדות אלא מדרבנן.

Proof #3: 'Those who lend on interest - speaks about Ribis that is not Ketzutzah (fixed, which is only mi'de'Rabbanan); and even if it speaks about Ribis Ketzutzah, this too, people do not consider an Isur, seeing as the debtor gives the money of his own freewill, in which case he (the creditor) is only Pasul from testifying mi'de'Rabbanan.

'מפריחי יונים' - מדרבנן פסולים, אפי' למ"ד 'אי תקדמי יונך', היינו משחק בקוביא. ולאידך דאמר 'ארא' מפני דרכי שלום הוא.

Proof #4: 'Dove racers' - too are Pasul mi'de'Rabbanan, since this is merely a branch of Asmachta; and according to those who interpret 'Mafrichei Yonim' as 'Ara' (doves that are trained to bring back other doves to one's nest), this is forbidden only on account of Darkei Shalom.

ו'סוחרי שביעית' - מיירי בשביעית בזמן הזה, דאינו אסור אלא מדרבנן; ואפי' בשביעית דאורייתא, לא חשיב ליה איסור, הא דממציאין מעות לעניים.

Proof #5: 'People who deal with Sh'mitah-produce' - which speaks about Shevi'is nowadays, which is only Asur mi'de'Rabbanan; and even if it is speaking about Shevi'is d'Oraysa, people do not consider it an Isur, since they are availing money to the poor.

אבל עבדים פסולין מדאורייתא נינהו, ק"ו מאשה - ומה אשה שכשירה לבא בקהל, פסולה להעיד דכתיב (דברים יט) "האנשים", עבד שפסול ... .

Proof #5: But 'Avadim' are Pasul min ha'Torah, 'Kal ve'Chomer' from a woman - who is eligible to marry into the congregation of Yisrael, yet she is Pasul to testify, how much more so an Eved, who is not eligible to marry into the congregation of Yisrael.

על כן נראה דלא גרסי' 'עבדים' - דלא מיירי אלא בפסולי דרבנן.

Explanation #2: It is therefore clear that we do not read 'Avadim' in the text, since the Mishnah is speaking exclusively about Pesulim mi'de'Rabbanan.

TOSFOS DH KOL KI HAI GAVNA LA'AV ASMACHTA HI (1)

תוס' ד"ה כל כי האי גוונא לאו אסמכתא היא

(SUMMARY: Tosfos discuss Rashi, in whose opinion Asmachta is confined to where he thinks that matter is within his control, but subsequently, it is not, like the case of 'Im Ovir ve'Lo A'avid' in Perek ha'Mekabel and that of 'ha'Mashlish Sh'taro' in Get Pashut, but not 'ha'Mesachek be'Kuvya' which is outside one's jurisdiction. After amending Rashi's reference to 'Im Ovir ve'Lo A'avid', Rabeinu Tam queries Rashi from the Gemara in Bava Metzi'a, which seems to say exactly the opposite. They therefore offer a different interpretation between what is Asmachta and what is not. Accordingly, they conclude that Shiduchim is not fall under the category of Asmachta).

פ"ה, דהיכי דמי אסמכתא? כגון 'אם אוביר ולא אעביד, אשלם במיטבא' וכן 'משליש את שטרו' דגט פשוט (ב"ב דף קסח. ושם).

Explanation #1 (Part 1): Rashi explains that Asmachta is a case such as 'If I leave the land fallow and do not work it, I will pay you from the best of my lands'; and likewise the case in 'Get Pashut' of 'Mashlish es Sh'taro' (where, after paying half the debt, the debtor hands the Sh'tar over to a third party and declares that if he does not pay the balance within a given space of time, the Sh'tar should be returned to the creditor and he will pay the full amount of the debt.

דכל הני סמיך אדעתיה, וסבור הוא שזה בידו לעשות. ומרישא כי מתני ליה אדעתיה דלא יהיב ליה מתנה ליה, שהרי סבור הוא שלא יבא לידי כך.

(b)

Reason (Part 1): Because in all these cases, he relies on his own mind, inasmuch as he thinks that he will be able to fulfill his condition. And when he initially makes it, he does so with the intention of not having to give the other party, because he thinks that it will never come to that.

אבל הכא, לאו בידו ולא סמיך אמידי, דהא לא ידע אי נצח אי לא נצח, ואפ"ה אתני - ש"מ דמספיקא גמר ומקני, ולאו גזילה היא.

Reason (Part 2): Whereas in the current case, the outcome is not in his hands and there is nothing for him to rely on, seeing as he doesn't know whether he will win or not.

ומיהו הא שפירש ד'אם אוביר ולא אעביד אשלם במיטבא' אסמכתא היא טעות סופרים הוא זה, ובזה לא דבר רש"י - דהא 'אם אוביר אשלם במיטבא' לאו אסמכתא, כדאמרי' פ' איזהו נשך (ב"מ דף עד.); אלא היינו 'אם אוביר ולא אעביד, אשלם אלפא זוזי', דבפ' המקבל (שם דף קד.) קאמר 'אסמכתא היא'.

Printer's Error: That what Rashi explains however, that 'Im Ovir ve'Lo A'avid Ashalem mi'Meitva' is an Asmachta, is a printer's error; In fact, Rashi never said that, because, as the Gemara says in 'Eizehu Neshech', that is not a case of Asmachta. What Rashi must have been referring to is the case of 'Im Ovir ve'Lo A'avid Ashalem Alfa Zuzi', which is 'Asmachta', as the Gemara states in Perek ha'Mekabel.

ובפי' רש"י היה כתוב 'אם אוביר ... '. על כן טעו סופרים.

Cause of Error: Rashi, it seems, had written 'Im Ovir ' on its own, as a result of which the Sofrim cited the wrong case.

אבל ר"ת הקשה לפי' הקונט' משום דלפי פי' משמע דטפי חשיב אסמכתא (מה) שהיה בידו מלאו בידו, ובפ' איזהו נשך (שם דף עד. ושם) משמע איפכא.

Question (Part 1): Rabeinu Tam however, queries Rashi in that, according to his explanation, it seems that whenever something lies in one's control to achieve it is more of an Asmachta than when it doesn't, whereas in Perek Eizehu Neshech it implies the opposite?

דאמר התם 'האי מאן דמקבל זוזי מחבריה למיזבין ליה חמרא ופשע ולא זבין, משלם כדאזיל אפרוותא דזולשפוט'; וקאמר התם ד'אסמכתא היא ... '; עד דמקשה הש"ס 'מאי שנא מאם אוביר ולא אעביד אשלם במיטבא?' ומשני 'התם גבי "אם אוביר ולא אעביד אשלם במיטבא" משום דהוי בידו לא הויא אסמכתא'. אלמא היכא דלא הויא בידו הוי טפי אסמכתא ממה שהוא בידו.

Question (Part 2): For the Gemara there, in a case where someone receives money from his friend to purchase wine on his behalf, but who carelessly fails to do so, rules that he is obligated to recompensate on his loss according to the price of wine in 'Aparvasa de'Zulshfot' (where wine is sold cheaply). The Gemara concludes however, that it is Asmachta. It then queries this from 'Im Ovir ve'Lo A'avid, Ashalem be'Meitva', and answers that the latter case is not Asmachta because it is be'Yado, whereas the case there is. So we see, that the more it is not be'Yado, the more it Asmachta?

על כן נראה לר"ת לפרש הכי - 'כל כי האי גוונא לאו אסמכתא היא', דלא הויא אסמכתא אלא היכא שאין יכול להרויח כגון 'משליש שטרו ... ' דגט פשוט (ב"ב דף קסח.), אבל הכא לא הויא אסמכתא, משום דכיון דשנים הם, כל אחד ואחד מקני לחבריה, מגו דאי מרווח בעי איהו למקני, בההיא הנאה גמר ומקני לחבריה.

Explanation #2: Rabeinu Tam therefore explains that 'Kol ki Hai Gavna La'av Asmachta' is because Asmachta only applies there where there is nothing to gain, such as the case (in 'Get Pashut') of ha'Mashlish es Sh'taro'; Whereas here, since there are two people, each one is Makneh to his friend. This is because since if he wins, he certainly wants to be Koneh, with that Hana'ah, he is Makneh to his friend should he win.

לפי זה כל שידוכין לא הויא אסמכתא, משום דכל חד וחד בעי למקני, גמר נמי ומקני.

Inference: By the same token, All promises made by Shiduchin are not Asmachta either, seeing as each one wants to acquire for himself, he is also Makneh to the second party.

TOSFOS DH KOL KI HAI GAVNA LA'AV ASMACHTA HI (2)

תוס' ד"ה כל כי האי גוונא לאו אסמכתא היא

(SUMMARY: Based on Kashyos on Rabeinu Tam from both from the Gemara in Perek ha'Zahav and the Gemara later, the Ri agrees with Rashi, whose explanation he reconciles with the Gemara in ha'Zahav. Tosfos then go on to reconcile our Sugya, which implies that something that his outside his control is not an Asmachta, with the Gemara in Bava Metzi'a, which considers the case of 'Chamra de'Zulshefot' (that we cited earlier) an Asmachta, and ends up dividing the levels of Asmachta into three. Finally, Tosfos explain why we declare 'Mesachek be'Kunya Kasher le'Eidus, and qualify the ruling that it is Koneh).

ומיהו קשה על פי' ר"ת, שהרי בפרק הזהב (ב"מ דף מח: ושם) אמרינן 'הנותן עירבון לחבירו, ואמר לו "אם אני חוזר בי עירבוני מחול לך", והלה אומר "אם אני חוזר בי אכפול לך ערבונך" נתקיימו התנאים, דברי רבי יוסי', ומסיק התם לבסוף אליבא דר' יהודה דהויא אסמכתא ולא קניא. אלמא אפי' בשנים חשיב אסמכתא, ולא אמרינן מגו דבעי קנין העירבון אם חבירו חוזר בו, מקנה נמי כנגד העירבון לחבירו כשהוא חוזר בו?

Question 1#: There is a Kashya on Rabeinu Tam however, from the Gemara in Perek ha'Zahav, in a case where Reuven gives Shimon a security and stipulates that should he retract, he will forego it, whilst Shimon stipulates that in the event that he retracts, he will pay Reuven twice the amount of the security, R. Yossi validates the conditions, whereas R. Yehudah considers it an Asmachta. So we see that even when there are two people, it is considered an Asmachta, and we do not say that since he wants to acquire the security should his friend retract, he is Makneh the security to his friend should he retract?

ועוד משמע לקמן גבי צריכותות דמפריחי יונים, דהיכא שהוא סבור דבידו להרויח, הויא אסמכתא בעלמא טפי כדפירש רש"י.

(b)

Question #2: And this is also implied further on (where the Gemara discusses 'Mafrichei Yonim'), that the more he thinks that the matter lies in his control the more it is Asmachta?

על כן נראה לר"י עיקר כפירוש רש"י.

Reverting to Explanation #1: Therefore the Ri agrees with Rashi's explanation.

ואי קשיא לו מההיא דאיזהו נשך כדפירשנו לעיל, תריץ הכי שאני התם, דודאי דבר שהוא בידו ממש לגמרי כגון 'אם אוביר ולא איעביד אשלם במיטבא', דהתם בידו לעשות ולא גזים נמי, שסובר הוא שכך הפסיד חבירו אם לא ישלים תנאו, כמו אם ישלם במיטבא, בההיא ודאי גמר ומקני ולא חשיב אסמכתא, ואומר בלבו 'עלי לשלם ודאי מן הדין מה שבידי לעשות ולא עשיתי'.

Answer to Question (Tosfos Part 1 [Part 1]): And the answer to the Kashya from 'Eizehu Neshech' that we asked earlier is that that case is different. It is different because there (in the case of 'Im Ovir ve'Lo I'avid ... ') 1. It lies completely in hiss control to work the field and 2. He does not exaggerate, he thinks that this is what his friend lost and that he is obligated to make up that loss (for example where he says 'I will pay from the best!'), and he really means what he says with a full heart and it is not Asmachta.

אבל היכא דגזים, אע"ג דהוי בידו ממש לגמרי כגון 'אם אוביר ולא איעבד אשלם אלפא זוזי', מכל מקום כיון דגזים ודאי הוי גוזמא, דמתנה לשלם אלף זוז בשביל קרקע אחת ודאי חשיב אסמכתא.

Answer to Question (Tosfos Part 1, [Part 2]): But there where he exaggerates, even though it lies totally in his control (e.g. where he says 'Im Ovir ve'Lo I'avid, Ashalem Alfa Zuzi'), the mere fact that he is exaggerating turns it into an Asmachta, because the fact that he volunteers to pay a thousand Zuz for a regular field demonstrates that he is exaggerating, and does not really mean what he says.

ומיהו קשה, דהכא משמע דדבר דלא הוי בידו לאו אסמכתא הוא כגון 'משחק בקוביא' דהכא, ואע"ג דגזים. ומאי שנא מההיא דחמרא דזולשפוט דחשבינן אסמכתא מהאי טעמא?

Question: The Kashya remains however, how to reconcile the Gemara here, which implies that something that his outside his control (such as 'Mesachek be'Kuvya' is not an Asmachta, even though he is exaggerating (seeing as he owes him nothing) with the Gemara in Bava Metzi'a, which considers the case of 'Chamra (Aparvasa) de'Zulshefot' (that we cited earlier) an Asmachta for this very reason?

ומכ"מ לא קשיא מידי - דהתם ודאי הויא אסמכתא משום שזה סומך עליו משום דהוי דבר שבידו שמוצאין יין למכור, ונראה כאסמכתא קצת, אע"ג דלא גזים, דשמא לא ירצו אחרים למכור לו; והלכך אע"ג דלא גזים, כיון דלאו בידו הוא לגמרי לא גמר ומקני לחבריה.

Answer (Part 1): This is not a Kashya however, since the reason that it is an Asmachta there is because the owner relied on him to purchase, which, granted, was seemingly available, and moreover, was not based on an exaggerated request, yet there was no guarantee that the sellers would be willing to sell him what he asked for. Consequently, since it was not completely be'Yado, it was considered Asmachta, since the owner is not Makneh him the money with a full heart.

אבל הכא גבי משחק בקוביא דלאו בידו הוא כלל, אע"ג דגזים בתנאי שחוק שלו, מ"מ גמר ומקני, דכיון שהוא יודע שאין בידו להרויח, וידוע הוא שאחד מהם ירויח, ודאי לא נתכוון להסמיך חבירו על דבר שאינו, אלא גמר ומקנה לכך, כי האי גוונא ודאי לאו אסמכתא היא.

Answer (Part 2): Whereas here, by Mesachek be'Kuvya, which is completely outside his control, despite the fact that there is an element of exaggeration (since he does not owe him anything) in the game that he is playing, he is nevertheless Makneh to his friend with a full heart. This is due to the fact that he knows that, on the one hand, it does not lie in his control to win, whilst on the other, one of them is bound to win, in which case he certainly doesn't expect his friend to rely on some non-existant factor to win, but is Makneh the money to him with a full heart, should he win. And that is certainly not Asmachta.

אבל הא ד'אשלם אלפא זוזי', דגזים, וגם בידו להשלים תנאו, יש לנו לומר דנתכוון להסמיך ולהטעות חבירו, והויא אסמכתא, משום דגוזמא קאמר ולא גמר ומקנה. ומסתברא דלהכי גזים שהוא סבור ודאי שיעבדנה, ועוד שבידו הוא.

Answer (Part 3): In contrast, in the case of 'Ashalem Lach Alfa Zuzi'; where a. he exaggerates and b. it lies within his control to fulfil his condition, we have to say that he intended to coerce his friend to rely on his assurance to pay, and the thousand Zuz is an Asmachta, in that it was no more than an exaggeration, and he was not Makneh it to him with a full heart. We can assume that he only exaggerated because he was certain that he would work the field. And in addition, it was totally be'Yado.

ומשום הכי פסק ד'משחק בקוביא' כשר לעדות, דפסקינן כר' יהודה לקמן, דכיון שיש לו אומנות שלא הוא, כשר.

Conclusion: And the reason that we declare a 'Mesachek be'Kuvya' eligible to testify is because we rule R. Yehudah later, who declares him Kasher provided he has another occupation.

והא דפסקינן ד'משחק בקוביא' קני', דווקא כשמעות שניהם על פי הדף לפי שהדף והמקום קנוי לאותו שירויח כדי לקנות המעות אשר עליו. אבל המשחקים באמנה, אפילו הקנו לא מהני, אם לא הקנו בב"ד חשוב כדאי' בנדרים (דף כז:).

Ruling: When we rule that 'Mesachek be'Kuvya' is basically Koneh, this pertains specifically to where both the participants; money is lying on the board, since the board together with the place on which lying both belong to the winner, so that the winner acquires the money that is lying on it. But if one plays with the dice 'on faith' the winner is not Koneh, even if they made a Kinyan, unless the Kinyan was made in a Beis-Din Chashuv.
