PESACHIM 48 (1 Elul) - Dedicated l'Iluy Nishmas Esther Chaya Rayzel (Friedman) bas Gershon Eliezer (Yahrzeit: 30 Av, Yom Kevurah: 1 Elul) by her daughter and son-in-law, Jeri and Eli Turkel of Raanana, Israel. Esther Friedman was a woman of valor who was devoted to her family and gave of herself unstintingly, inspiring all those around her.

Halachah: ha'Rav Yosef Paskens like Rebbi, since the Halachah is like him whenever he argues with a single opinion.

Refutation: The Ri however, refutes this. Maybe, he claims,we will not apply this principle here...

דהא איפליגו רבה ורב חסדא בהכי, והא דהלכה כרבי מחבירו היינו היכא דליכא פלוגתא דאמוראי.

Reason: Since Rabah and Rav Chisda dispute the issue here, and the principle that the Halachah is like Rebbi ... only applies where the Amora'im are not argue over it.

רש"י לא גרס 'ועוד', משום דחמשה לוגין ציפורים בצמצום הוי כעיסת מדבר.

(a)

Refutation of Text: Rashi does not have the word 've'Od' in his text, because five Lugin Tziporim exactly, is the equivalent of the dough in the Desert (of the Manna).

ור"ת מפרש דהיינו כר' יוסי דאמר בפ"ק דשבת (דף טו.) 'חמשה פטורים, חמשה ועוד חייבין'.

(b)

Reinstitution of Text: Rabeinu Tam however, explains that it goes according to Rebbi Yossi, who says in the first Perek of Shabbos (Daf 15.) that 'Five Kabin are Patur (from Chalah), five Kabin plus are Chayav'.

והיינו טעמא דר' יוסי דלאחר הפרשת חלה בעינן שיעור עריסותיכם.

(c)

Reason: And Rebbi Yossi's reason is because he requires the Shi'ur of the dough in the Desert after having separated Chalah.

תימה, דלא משמע הכי במסכת חלה (פ"ב משנה ד) דתנן 'העושה עיסתו קבין, פטור מן החלה עד שישוכו. רבי אליעזר אומר, אף הרודה ... '.

Question: This does not seem to be the case in Maseches Chalah (2:4), where the Mishnah states 'Someone who kneads a dough via individual Kabin, is Patur from Chalah until they touch. Rebbi Eliezer says, even if one takes them from the oven and places them in the basket'.

אלמא לא בעי ר' אליעזר שישוכו.

(b)

Question (cont.): This implies that Rebbi Eliezer does not require that they touch.

ואי לא גרס 'אף', אתי שפיר, דמצי למימר דבעי תרתי שישוכו ויתנם לסל.

(c)

Answer: But if we omit the word 'Af' (also) from the text, the question is answered, since we can they say that he requires both that they touch and that they are placed in a receptacle.
