WHICH VOWS NEED A CHACHAM TO PERMIT THEM (Yerushalmi Perek 3 Halachah 1 Daf 7b)

מתני' ארבעה נדרים התירו חכמים נידרי זירוזין ונדרי הבאי נידרי שגגות ונדרי אונסין

(a)

(Mishnah): Chachamim permitted four vows: vows of persuasion, of exaggeration, of Shogeg, and of Ones.

נידרי זירוזין היה מוכר חפץ אמר קונם שאיני פוחת לך מן הסלע והלה אומר קונם שאיני מוסיף לך על השקל שניהם רוצין בשלשה דינרין

Vows of persuasion - one was selling an item, and said Konam, I will not [benefit from the money I receive, or from a certain food, if I will] sell it for less than a Sela (four Zuz). The [buyer] said Konam, I will not add (give to you) more than a Shekel (two Zuz). Both of them want [to make the sale for] three.

רבי אליעזר בן יעקב אומר אף הרוצה להדיר את חבירו שיאכל אצלו יאמר לו כל נדר שאני עתיד לידור הרי הוא בטל ובלבד שיהא זכור בשעת הנדר:

R. Eliezer ben Yakov says, even one who wants to vow (to pressure) his friend to eat by him, should say 'any vow that I will take later, it is Batel', as long as he remembers [this stipulation] at the time of the vow.

גמ' וכל הנדרים לאו חכמים הן שהן מתירין

(d)

(Gemara) Question: (Why does it say that Chachamim permitted four vows?) Is it not Chachamim who permit all vows?!

כתיב [במדבר ל ב] וידבר משה אל ראשי המטות [דף ח עמוד א] תלה הפרשה בראשי המטות שיהא מתירין נדרי העם.

"Va'Ydaber Moshe El Roshei ha'Matos" - the Parshah was made dependent on Roshei ha'Matos, for they permit the vows of the nation.

רב יהודה בשם שמואל [במדבר ל ג] לא יחל דברו הוא אינו מיחל דברו הא אחר עושה דברו חולין. ואי זה זה זה חכם שמתיר נדרו.

(R. Yehudah citing Shmuel): "Lo Yachel Devaro" - one may not profane his word [by himself], but another (a Chacham) can make his word Chulin.

חנינה בן אחי רבי יהושע אומר [תהילים קיט קו] נשבעתי ואקיימה פעמים שאינו מקיים

(Chananyah ben Achi R. Yehoshua): "Nishbati va'Akayemah" - sometimes one does not fulfill (rather, he permits his Shevu'ah).

רבי יהושע אומר [שם צה יא] אשר נשבעתי באפי באפי נשבעתי חוזר אני בי.

(R. Yehoshua): "Asher Nishbati v'Api" - in My anger I swore, and I retract.

וכל הנדרים חכמים הם שהם מתירין ותנינן ארבעה נדרים התירו חכמים.

Reiteration of Question: It is Chachamim who permit all vows. Why does our Mishnah say that Chachamim permitted four vows?

רבי לעזר בשם רבי חייה רובה אילו אינן צריכין היתר חכם.

Answer (R. Lazar citing R. Chiyah Ruba): These vows do not need a Heter through a Chacham. (Chachamim of the Mishnah permitted them.)

רב ושמואל תריהון אמרין אלו הן צריכין היתר חכם.

(g)

(Rav and Shmuel): They need a Heter through a Chacham.

התיב איסי והרי לא מצינו פתח לנדרים אלא מיכן.

Question (against R. Lazar - Isi): We do not find a Pesach for [any] Nedarim, only from here! (Due to the Pesach, it is considered like one of these four Nedarim.)

א"ל שמואל חגר עליה מותנא.

Shmuel: Gird your loins (invigorate yourself to defend your words)!

מתניתא פליגי על איסי אף זה יכול להפר נדרו שלא על פי חכם.

Question (against Isi - Mishnah): Even this one can permit his vow without a Chacham.

פתר לה כל נדרים צריכין פתח ממקום אחר. ואלו פתחן בצידן.

Answer: All [other] Nedarim need a Pesach from elsewhere. These, the Pesach is right by them (persuasion, exaggeration, Shogeg, or Ones).
