(a)

Gemara: "Zos" of "ha'Mitzvah".

בסדר ואתחנן כך מצאתי כתוב ולא נמצא בספרים שלנו.

Remark: It is in Parshas va'Eschanan. So I found written; it is not found in our Seforim. (Note: Below (DH Im), the Ran brings that Mesorah lists "v'Es" of "ha'Nefesh" in place of "Zos" of "ha'Mitzvah".)

ר"ן ד"ה ידרוך דהדורך

(b)

Gemara: "Yidroch" of "ha'Dorech".

בסוף ירמיה ידרוך הדורך (הגהת יעב"ץ) קשתו ידרוך שני כתיב ולא קרי.

Explanation: This is near the end of Yirmeyah (51:3) - "Yidroch ha'Dorech Kashto". The second Yidroch is written, but not pronounced.

(c)

Gemara: "Chamesh" of "Pe'as Negev."

בסוף יחזקאל (והנה) [ואלה] מדותיה וגו' חמש חמש מאות וארבעת אלפים חמש שני כתיב ולא קרי.

Explanation: This is near the end of Yechezkel (48:16) - "v'Eleh Midoseha... Chamesh Chamesh Me'os..." The second Chamesh is written, but not pronounced.

(d)

Gemara: "Im" of "Ki Go'el."

ברות ועתה כי אמנם כי אם גואל אנכי האי אם כתיב ולא קרי

Explanation: It is in Rus (3:12). "Ki Amnam Ki Im Go'el Anochi" - Im is written, but not pronounced.

ובמסרה חשיב כל הני וטפי עלייהו אחריני מיהו לא חשיב זאת (גליון) דהמצוה אלא את דהנפש דכתיב בירמיהו גבי צדקיה חי ה' אשר עשה לנו את הנפש הזאת.

Remark: The Mesorah lists all of these, and adds others to them. However, it does not list "Zos" of "ha'Mitzvah", rather, "v'Es" of "ha'Nefesh" written in Yirmeyah (38:16) regarding Tzidkiyah - "Chai Hash-m [Es] Asher Asah Lanu Es ha'Nefesh ha'Zos." (The first "Es" is written, but not pronounced. - PF)

Gemara: Rav Chisda asked "Hash-m commanded me at that time to teach you"!

אלמא דהשם צוהו ללמד את ישראל

Inference: Hash-m commanded him to teach Yisrael!

ומפרקינן ואני לכם וקרא ה"ק ואותי צוה ה' בעת ההיא ואני נתתי את לבי ללמד חוקים ומשפטים.

Explanation: The Gemara answers, and I to you. The verse means that Hash-m commanded me at that time, and I put to my heart to teach Chukim and Mishpatim.

Gemara: In order that this song will be a witness for Me.

ואי שירה לבדה קאמר מאי סהדותא איכא.

Explanation: If it refers only to the Shirah, what testimony is there?!

Gemara: Mere Pilpul (a sharp understanding of Torah).

נתן לו למשה והוא נהג בו טובת עין לישראל.

Explanation: Hash-m gave this to Moshe, and he was generous [and gave it] to Yisrael.

Gemara: It is written "the height of the board is 10 Amos."

אלמא משה גבוה עשר אמות היה וכיון שהיה גדול כל כך מסתמא גבור היה.

Inference: Moshe was 10 Amos tall. Since he was so tall, presumably, he was strong.

Gemara: Tall and small.

ארוך בקומה וקטין בכח.

Explanation: Tall in height, and small in strength.

Gemara: Except for one.

ידיעת הש"י על אמיתתו כדכתיב ותחסרהו מעט מאלהים.

Explanation: [The one gate that Moshe did not receive was] true knowledge of Hash-m", like it says "You made him lack a small amount from [knowledge of] Elokim."

Gemara: Does this exclude that he did not take without paying for it?!

וכי משתבח היה שלא נטל בלא שכר.

Explanation: Would he boast that he did not take without paying rental!?

Gemara: Rather, [he did not take] even for pay.

שלא היה נהנה משל אחרים.

Explanation: He did not benefit from others.

Gemara: Even with consent.

דזימנין מתרצו משום כסופא ולא ניחא להו.

Explanation: [This is an attribute,] for sometimes people consent due to shame [to refuse], and they are not pleased [to do so].

THE RAN EXPLAINS THE MISHNAH

ר"ן ד"ה מתני'. וזן את אשתו ואת בניו

(a)

Mishnah: He may feed his wife and children.

אפי' כרבנן אתיא דבתורת מצוה עסקינן ולא בתורת פרעון של בעל שחייב במזונותיהם

Explanation: This is even like Rabanan, for we discuss feeding them for a Mitzvah, and not to fulfill the obligation of the husband, who must feed them;

ואף על גב דהמודר מתהני שאינו צריך לתת להם מזונות ההיא הנאה דממילא היא.

2.

Even though the Mudar benefits, for [since the Madir feeds them,] he need not feed them, that benefit comes automatically.

ר"ן ד"ה ולא יזון את בהמתו בין טמאה בין טהורה

(b)

Mishnah: He may not feed his animal, whether or not it is a Tamei or Tahor species.

דמהנהו הוא ממש מפני שמעלה בדמים.

Explanation: He truly benefits him, for he increases its value.

ר"ן ד"ה ר' אליעזר אומר זן את הטמאה

(c)

Mishnah: R. Eliezer says, he may feed a Tamei species.

כדמפרש ואזיל שכיון שאין בה למודר הנאת אכילה אינו נהנה במזונותיו של מדיר.

Explanation: This is like he will explain - since the Mudar will not benefit regarding eating, he does not benefit from the Madir's food.

Gemara: Its body is his.

לאכילה הלכך (מכאן מעמוד ב) אי מפטם לה מהני ליה

Explanation: He may eat it. Therefore, if he fattens it, he benefits him.

Mishnah: A Tamei animal, its Nefesh and body are Shamayim's.

שאין לו בה היתר אכילה ונמצא שאינו נהנה בפטומה.

Explanation: There is no Heter to eat it. It turns out that [the Mudar] does not benefit from its fattening.

RAN DH she'Im Yirtzeh Harei Zeh Mochrah l'Ovdei Kochavim

ר"ן ד"ה שאם ירצה הרי זה מוכרה לעובדי כוכבים

(SUMMARY: The Ran discusses why R. Eliezer and Rabanan argue.)

שאוכלין אותה וכשהיא מפוטמת לוקחין אותה ביותר או מאכילה לכלבים ונמצא נהנה בפטומה ורבוי בשרה

Explanation: They (Nochrim) eat it, and when it is fattened, they pay more for it. Or, he can feed it to dogs, and he benefits from its fattening and increased meat.

ונ"ל דר"א לא שרי בטמאה אלא לזונה מזונות יתרים כדי לפטמה משום דס"ל דכיון דאינה עומדת לאכילה אלא למלאכה אינן נהנין בעלים בפטומה דאדרבה מפנקא טפי ולא עבדא שפיר

Opinion #1: It seems to me that R. Eliezer permits regarding a Tamei animal only to give to it extra food in order to fatten it, because he holds that since it is not destined to be eaten, rather, for Melachah, the owner does not benefit from its fattening. Just the contrary, it is more delicate, and does not work properly;

אבל במזונות הצריכין לכדי חייה לא שרי ר' אליעזר דבכי האי גוונא ודאי מהנהו

However, R. Eliezer does not permit the food needed for it to live. In such a case, surely he benefits him!

ומשום דת"ק פסיק ותני ולא יזון את בהמתו בין טמאה בין טהורה דמשמע דבכולהו גווני דמתסר בטהורה מתסר נמי בטמאה מהדר ליה רבי אליעזר לא כי

Because the first Tana taught uniformly "he may not feed his animal, whether it is Tamei or Tahor", which implies that every way forbidden for a Tahor [animal] is forbidden also for a Tamei, R. Eliezer responded that this is not so;

אלא איכא גוונא דזן את הטמאה אף על פי שאינו זן את הטהורה

Rather, there are ways in which he may feed a Tamei, even though he may not feed a Tahor.

ונהי דתנא מסתם לישניה

(c)

Implied question: The Tana taught Stam [that R. Eliezer permits feeding a Tamei animal]!

סמיך ליה אמאי דאמרו לו ודקמהדר להו ר"א דמשקלא וטריא דידהו מוכח דר"א לא שרי בטמאה אלא במזונות יתרים כדי לפטמה ולא בכדי חייה

(d)

Answer: He relies on what they said to him, and R. Eliezer responded to them. From their dialogue it is proven that R. Eliezer permits regarding a Tamei only extra food in order to fatten it, but not food needed for it to live.

וראיתי להרשב"א שכתב בהפך ולא נתחוורו דבריו.

(e)

Opinion #2: I saw that the Rashba wrote oppositely. His words are not clear.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה גמ'. הרי מוסר לו שפחה לשמשו

(a)

Gemara: He hands over to him a female slave to serve him!

דקס"ד דבבתו נערה עסקינן.

Explanation: We are thinking that we discuss his daughter, a Na'arah.

ר"ן ד"ה אלא בשנכסי חתן אסורין על אבי כלה

(b)

Gemara: Rather, the Chasan's property is forbidden to the Kalah's father.

וקמ"ל שאע"פ שנכסיו אסורין עליו מותר להשיא לו בתו אף על פי שיתחייב לזונה אחר כן ונמצא מהנהו.

Explanation: This teaches that even though his property is forbidden to him, he may marry his daughter to him, even though he will be obligated to feed her afterwards, and it turns out that he benefits him.

ר"ן ד"ה גדולה מזו אמרו זן את אשתו ואת בניו וכו' ואת אמרת מותר להשיא לו בתו

(c)

Gemara: [Our Mishnah] said a bigger Chidush than this! He may feed his wife and children... and you teach [only] that he may marry his daughter?!

כלומר אם הוא יכול לזון את בתו בעודה ברשותו שהוא חייב במזונותיה כ"ש שיוכל לזון אותה אחר שנשאה שנתחייב במזונות אשתו ומאי קמ"ל רב הונא.

Explanation: I.e. if he may feed [the Mudar's] daughter when she is still in his Reshus, and he is obligated to feed her, all the more so he may feed her after he married her, for he became obligated to feed his wife! What is Rav Huna's Chidush?

(d)

Gemara: And his Bogeres daughter.

דלא איהו קמסר לה אלא היא עצמה

Explanation: [Her father] does not hand her over, rather, she hands herself over.

RAN DH umi'Daitah [TRANSLATION: And with her consent.]

ר"ן ד"ה ומדעתה

(SUMMARY: The Ran gives two explanations of this.)

טעמא קא יהיב למילתיה כלומר מש"ה שרי דהא מדעתה היא דכיון שבגרה שוב אין לאביה רשות בה

(a)

Explanation #1: This is the reason for the law. It is permitted because it depends on her will. Once she became Bogeres, her father has no jurisdiction over her.

אי נמי כי קאמר מדעתה למעוטי דעתו דחתן שאם עשאו שליח לדבר עמה על עסקי נשואין אסור דהא קא מהני ליה.

(b)

Explanation #2: It says mi'Daitah to exclude the Chasan's Da'as. If he made [her father] a Shali'ach to speak with her about marriage [to him], it is forbidden, for he benefits him.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה המדיר את בנו לת"ת

(a)

Gemara: One who is Madir his son for learning Torah.

האב הדירו שלא יהנה אביו ממנו כדי שלא יתבטל מת"ת.

Explanation: The father was Madir him, that the father will not benefit from him, in order that the son will not be hindered from learning Torah.

ר"ן ד"ה מותר הבן למלאות לאביו חבית של מים ולהדליק לו את הנר

(b)

Gemara: The son may fill a barrel of water for his father, and light a lamp for him.

דמסתמא ממילי זוטרי כי הני דליכא בהו בטול למוד תורה לא אדריה

Explanation: Presumably, he did forbid small matters like these, in which there is no Bitul of learning Torah.

והכי מוכח האי פירושא בתוספתא דבכורות (פ"ו) דתניא מעשה באחד שהרצה בנו לת"ת והדירו מלעשות מלאכה והתיר לו יוסי ברבי למלאות לו חבית של מים ולהדליק לו את הנר.

2.

Proof (Tosefta, Bechoros 6:3): A case occurred in which one persuaded his son to learn Torah, and was Madir him not to do Melachah. Yosi b'Ribi permitted the son to fill a barrel of water for him, and light a lamp for him.

RAN DH Yerushalmi [TRANSLATION: The Talmid Yerushalmi.]

(SUMMARY: The Ran brings the Yerushalmi's opinion about one who was Madir his son for Talmud Torah.)

במס' ביכורים תני המדיר את בנו לת"ת מותר למלאות לו חבית של מים ולהדליק לו את הנר

(a)

Citation: The Yerushalmi in Bikurim says that if one was Madir his son for Talmud Torah, he may fill a barrel of water for [his father] and light a lamp for him;

רבי יעקב בר אידי בשם רבי יוחנן אף ליקח לו חפצים מן השוק

(b)

Citation (cont.): R. Yakov bar Idi in the name of R. Yochanan says that he may even buy things for him in the market;

מה פליגין כאן באיש כאן באשה אם היה אדם מסויים עשו אותו כאשה כלומר דאשה ואדם מסויים אין דרכן ליקח חפצים מן השוק ואנן סהדי דאדעתא דהכי לא אדריה

It says that one discusses a man, and the other discusses a woman. If he (the father) was a distinguished man, they made him like a woman. I.e. a woman and a distinguished man do not normally buy things in the market. [We are so sure that] we can testify that he was not Madir him with intent for this;

אבל איש שאינו מסויים כיון שדרכו לילך בשוק אפי' בהני אדריה.

2.

However, a man who is not distinguished, since he normally goes to the market, he was Madir him even about these.

THE RAN EXPLAINS THE GEMARA

ר"ן ד"ה מותר להשקות לו כוס של שלום

(a)

Gemara: He may give to him to drink a cup of Shalom.

כלומר מותר לשמשו בכוס של בית אבל אי נמי של בית המרחץ מפני דרכי שלום

Explanation: I.e. he may serve him with a cup of Beis ha'Evel, or of Beis ha'Merchatz, due to Darchei Shalom.

שהיה דרכן בכך ומיהו דוקא האי כוס של מודר דלשמשו בכגון זה בלבד התירו דומיא דאידך דהמדיר את בנו לת"ת שהתירו לבן למלאות לאביו מים משל אב.

This was their custom. However, this is only if it is the Mudar's cup. They permitted to serve him only in such a case, similar to the case of one who is Madir his son for Talmud Torah. They permitted the son to fill [a barrel] of water for the father, from the father's water.

RAN DH Es Avadav v'Es Shifchosav ha'Kena'anim [TRANSLATION: And his male and female Kena'ani slaves.]

(SUMMARY: The Ran explains why he argues with R. Eliezer.)

Assertion: It seems to me that he discusses extra food. He refers to R. Eliezer's words, and says as follows:

ההוא שריותא דשרי ר"א בבהמה טמאה דהיינו מזונות יתרים כמו שפירשתי במשנתנו ליתיה דאפי' בהמה טמאה לפטומא עבידא ולמוכרה לעובדי כוכבים

R. Eliezer's Heter for a Tamei animal, i.e. to give to it extra food, like I explained in our Mishnah, is wrong. Even a Tamei animal, it is normal to fatten it and sell it to Nochrim;

אבל בעבדיו ושפחותיו הכנענים מיהא איתיה דאינהו למנקרותא עבידן כלומר לנקר הבית ולתשמיש בלבד

However, the Heter applies to male and female Kena'ani slaves, for they are for Mankerusa, i.e. only to clean the house and serve;

ואיכא דגרסי למנחרותא כלומר שאין עומדין לאכילה אלא לנחירה בעלמא שכשהן מתין מניחין אותן ואין אדם אוכלן.

Some texts say that they are for Mancherusa, i.e. they are not destined to be eaten, rather, for Nechirah. When they die, one leaves them, and no person eats them.

ר"ן ד"ה מתני'. נכנס לבקרו עומד אבל לא יושב

Mishnah: If he enters to visit him, he stands, but he may not sit.
