NAZIR 38 (9 Adar 5783) - Dedicated l'Iluy Nishmas Sarah bas Zishe Ehrmann, by her grandson Zev Rosenbaum (of Yerushalayim), in honor of her Yahrzeit.

1)

LIABILITY FOR WHAT COMES FROM VINES (Yerushalmi Perek 6 Halachah 2 Daf 27b)

îúðé' åçééá òì äééï áôðé òöîå åòì äòðáéí áôðé òöîï åòì äçøöðéí áôðé òöîï åòì äæâéï áôðé òöîï

(a)

(Mishnah): One is liable for wine by itself, grapes by themselves, Chartzanim by themselves and Zagim by themselves;

ø' ìòæø áï òæøéä àåîø àéðå çééá òã ùéàëì ùðé çøöðéï åæåâï

(b)

R. Elazar ben Azaryah says, one is liable only for eating two pits and their peel.

àéìå äï äçøöðéí åàéìå äï äæâéï äçøöðéí àéìå äçéöåðéí åäæâéï àéìå äôðéîééï ãáøé ø' éäåãä

(c)

Which are Chartzanim and which are Zagim? Chartzanim are the outside (grape peels), and Zagim are the inner (pits). R. Yehudah says so;

ø' éåñé àåîø ùìà úèòä ëæåâ ùì áäîä äçéöåï æåâ åäôðéîé òéðáåì:

(d)

R. Yosi says, (they are the opposite;) so you will not err, it is like a animal bell. The outer part is Zug, and the inner (clapper) is Inbul.

âî' ëúéá [áîãáø å â] åòðáéí ìçéí åéáùéí ìà éàëì îîùîò ùðàîø òðáéí àéï àðå éåãòéï ùäï ìçéï îä úìîåã ìåîø òðáéí ìçéí åéáùéí

(e)

(Gemara) Question: It says "va'Anavim Lachim vi'Yveshim Lo Yochal" - since it says Anavim, do I not know that they are moist?! Why does it say "va'Anavim Lachim vi'Yveshim"?

ìçééá òì æä áôðé òöîå åòì æä áôðé òöîå

(f)

Answer: This obligate for this (moist grapes) by itself, and this (dry grapes) by itself.

åàúééà ëäãà ãúðé çæ÷éä îä àí áî÷åí ùìà òùä ôñåìú ôøé ëôøé òùä ìçéí ëéáéùéí ëàï ùòùä ôñåìú ôøé ëôøé àéðå ãéï ùðòùä ìçéï ëéáùéï

(g)

This is like what Chizkiyah taught. In a place (Orlah) where [the Torah] did not make the waste of a fruit like the fruit, it made dry like moist. Here (Nazir), it made the waste of a fruit like the fruit - all the more so it should make dry like moist!

îä úìîåã ìåîø ìçéí åéáùéí ìçééá òì æä áôðé òöîå åòì æä áôðé òöîå

1.

[If so,] why does it say "Lachim vi'Yveshim"? This obligates for this by itself, and this by itself.

åàúééà ëääéà ãàîø ø' äéìà [ãáøéí ëã å] ìà éçáåì øéçéí åøëá îîùîò ùðàîø øëá àéï àðå éåãòéï ùäøéçéí áëìì îä úìîåã ìåîø øéçéí åøëá ìçééá òì æä áôðé òöîå åòì æä áôðé òöîå

(h)

This is like R. Heila taught - "Lo Yachavol Reichayim va'Rachev." Since it says Rechev (the upper millstone), do I not know that Reichayim (the lower millstone) is included?! Why does it say Reichayim va'Rachev? This obligates for this by itself, and this by itself.

ìçéí ìøáåú àú äáåñø ìçéí ìøáåú àú äñîãø

(i)

(Beraisa): Lachim includes Boser (unripe grapes). Lachim includes Semader (the flower from which comes Boser).

îúðéúà ãøáé éåñé ãøáé éåñé àîø ñîãø àñåø áðæéø îôðé ùäåà ôøé

(j)

The Beraisa is like R. Yosi, for R. Yosi says, Semader is forbidden to a Nazir, for it is Pri. (Boser and Semader are not absolute Pri, therefore we need a verse to include them - SHIREI KORBAN.)

éù àåëì àùëåì åçééá îùåí òðáéí ìçéí åéáéùéí åçøöðéí åæâéï ùøééå ìùí îùøä ñçèå ìùí ééï åäúøå áå îùåí [áîãáø å ã] îëì àùø éöà îâôï äééï åâåîø

(k)

One can eat one cluster, and he is liable for Lachim, Yeveshim, Chartzanim and Zagim. If he soaked [the grapes in water, and drank it], he is liable for Mishreh. If he squeezed them, he is liable for wine. If they warned him for "mi'Chol Asher Ya'aseh mi'Gefen ha'Yayin..." (he is lashed also for it).

àîø ø' áà áø àçà èòîà ãøáé ìòæø áï òæøéä îùåí áéøéä

(l)

(R. Bun bar Acha): The reason for R. Elazar ben Azaryah is due to a Beriyah. (He obligates for a whole grape only if he also ate the peel and two pits.)

åúðé çøöðéí (åæâéï) [ö"ì åòã æâ - ÷øáï äòãä] ìäáéà àú äùìù ùáðúééí

(m)

(Beraisa): [Me']Chartzanim v'Ad Zag" includes the matter in between them.

åäà úðé áùí ø' ìòæø îëì àùø éòùä îâôï äééï àó äòìéï åäìåìáéï áîùîò

(n)

Question: It was taught in the name of R. Eliezer "mi'Chol Asher Ya'aseh mi'Gefen ha'Yayin [me'Chartzanim v'Ad Zag]" - even leaves and sprigs are implied! (We expound me'Chartzanim v'Ad Zag for the previous Drashah!)

øáé ìéòæø ëøáé éùîòàì ãøáé éùîòàì àîø (ëìì åôøè äëì áëìì åëã øáä îï ãøáé éùîòàì àîø àôéìå ëìì åôøè) [ö"ì ôøè åëìì äëì áëìì åãøåáä îï ãø' éùîòàì ãå àîø àôé' ôøè åëìì åôøè - ÷øáï äòãä] äëì áëìì

(o)

Answer: R. Eliezer holds like R. Yishmael, for R. Yishmael says, a Prat u'Chlal, everything is included in the Klal. He holds an even bigger Chidush than R. Yishmael, for [R. Eliezer] says so even for Prat u'Chlal u'Ferat, everything is included. (We explained this like PNEI MOSHE);

ìàéæä ãáø ðàîø çøöðéï åæâéï ìäáéà äùìù ùáéðúééí

1.

Why does it say me'Chartzanim v'Ad Zag? This includes the matter in between them.

Question: What is [a result of] R. Yosi's opinion?

(q)

Answer: If he ate half a k'Zayis of Chartzanim (pits) and Zagim from one grape, according to R. Elazar ben Azaryah he is liable [for it is a Beriyah. A grape has pits, but only one peel.] According to Rabanan, he is exempt.

Question: What is [a result of] R. Yehudah's opinion?

àëì ëæéú çøöðéí åæâéï îùúé òðáåú òì ãòúéä ãø' ìòæø áï òæøéä àéðå çééá àìà àçú òì ãòúéä ãøáðï çééá ùúéí

(s)

Answer: If he ate a k'Zayis of Chartzanim (peels) and Zagim from two grapes, according to R. Elazar ben Azaryah [one is not liable for less than a k'Zayis, like all Isurim, just a Gezeiras ha'Kasuv exempts until he eats Chartzanim (two peels) and Zag. There are only two peels in two grapes, so] he is liable only once. According to Rabanan [who do not expound this Gezeiras ha'Kasuv], he is liable twice. (We explained this like the GRIZ, 35a.)

àîø øáé àáåï àúééà ãøáé ìòæø áï òæøéä ëøáé éåñé àéï úéîø ëøáé éåãä àëì ëæéú ùðé (æåâéï åçøöðéï) [ðøàä ùö"ì çøöðéí åæâï]

(t)

(R. Avun): R. Elazar ben Azaryah holds like R. Yehudah. If you will say [that he holds like] R. Yehudah, [he should have said that one is not liable until he eats] a k'Zayis, [including] two Chartzanim (peels) and their Zag. (SEFER NIR)
