12th Cycle Dedication

ERCHIN 18 - Dedicated in honor of Mordechai ben Moshe ha'Kohen, by Josh Rebbi Danziger of Cliffside Park, New Jersey.

SUMMARY

1. A person who makes a group of people swear that they know no testimony regarding events that occurred to him may or may not cause them to be liable to bring a Korban if they lie.
 
2. A person who pledges to pay the fixed value of a person must pay the person's fixed value at the time of the pledge, even if he does not pay until the person's fixed value changes.
 
3. There is a dispute about when a person enters a new age of fixed value (i.e., when is he considered to have the fixed value of a person over twenty, and not of a person between five and twenty).
 
4. There is a dispute about the meaning of the word "Ad" ("until") in the Torah.
 
5. The Beraisa lists many laws in which the number of years involved are based on the count of a regular year, and not on the count of a certain month. (For example, when Tishrei arrives, this counts as the start of the second year even if the count only started in Elul.)

A BIT MORE

1. If he says to the group, "I make you swear that if you know testimony, you must testify for me," and one indeed knows testimony and falsely swears that he does not, he does not have to offer a Korban of Shevu'as ha'Edus. However, if he says, "I am making anyone who knows testimony about me swear that he will testify," and one of them swears falsely, he is obligated to bring a Korban. The difference is that in the second case, the litigant specified the people he was referring to ("anyone who knows testimony"), fulfilling the verse that one offers a Korban if he specifically swore falsely that he knows no testimony.
 
2. However, when one pledges to pay the actual value of a person, the amount is based on the value of the person at the time that Beis Din evaluates him, not on his value at the time of the pledge.
 
3. Tana Kama: He is considered over a set age the day after he has lived the full number of years of that age. Rebbi Eliezer: He must be one day and one month older than the full number of years of that age.
 
4. The Tana Kama in the Beraisa understands that when the Torah says "from A until B," it means that A and B are not included in this amount (unless there is a special derivation to this effect). Rebbi maintains that A and B are included in this amount.
 
5. The list includes: the age of Kodshim animals, Batei Arei Chomah, Sedei Achuzah, and an Eved Ivri.
