ZEVACHIM 44 (13 Sivan) - Dedicated by Elliot and Lori Linzer to commemorate the Yahrzeit of Chaim Yoseph ben Ephraim Henoch ha'Levi z'l.

SUMMARY

1. One who eats Ma'aser Sheni when he is Tamei transgresses a Chiyuv Lav. One who eats Terumah when he is Tamei is Chayav Misah.
 
2. The prohibition of Pigul applies to anything which has a Matir, whether it is Matir a person to eat from it, or whether it is Matir the Eimurim to be burned on the Mizbe'ach.
 
3. There is a disagreement about whether the prohibition of Pigul applies to Parim ha'Nisrafim.
 
4. Rebbi Meir says that the prohibition of Pigul applies to the Log Shemen of a Metzora.
 
5. There is a disagreement about whether the prohibition of Pigul applies to Nesachim that are brought on the same day as the Korban.
 
6. One who benefits from the Log Shemen of a Metzora, until the sprinkling of the blood of the Asham, is Chayav Me'ilah, according to the Tana Kama. Rebbi disagrees.
 
7. Everyone agrees that the Log Shemen of the Metzora may not be eaten by the Kohanim until after the sprinkling of the Shemen and after the Shemen has been placed on the Behonos of the Metzora.
 
8. The remainder of a Minchas Omer and Minchas Sotah is eaten by the Kohanim, like other Menachos.
 
9. A Chatas ha'Of and an Asham Nazir Tamei are eaten by the Kohanim.
 
10. When one steals from a Ger and swears falsely, and the Ger subsequently dies without children, the thief must give the principle and a fifth to the Kohen. The Kohen owns the money and may be Mekadesh a woman with it.
 
11. Rebbi Elazar says that if a Korban of Parim ha'Nisrafim is slaughtered with intent to sprinkle the blood after the allotted time, it is not Pigul.
 
12. If the blood of a Korban of Parim ha'Nisrafim is sprinkled with intent to spill the Shirayim or Maktir the Eimurim after the allotted time, it is not Pigul.
 
13. If a Korban of Parim ha'Nisrafim is slaughtered with intent to spill the Shirayim or to be Maktir the Eimurim after the allotted time, it is Pigul.

A BIT MORE

1. Even if a person is Tamei with Tum'as Mes, the most severe form of Tum'ah, he transgresses only a Chiyuv Lav for eating Ma'aser Sheni and he is not Chayav Misah.
 
2. The blood of an Olah is Matir the flesh to the Mizbe'ach and it is Matir the hide to the Kohanim. The blood of an Olas ha'Of is Matir the flesh of the bird to the Kohanim.
 
3. According to the Chachamim, the prohibition of Pigul applies to Parim ha'Nisrafim, because the blood is Matir the Eimurim to the Mizbe'ach. Rebbi Shimon maintains that since Parim ha'Nisrafim are not brought on the Mizbe'ach in the Azarah, the prohibition of Pigul does not apply.
 
4. The blood of the Asham is Matir the Shemen to be placed on the Behonos of the Metzora, and it is Matir the remaining Shemen to be eaten. Although the Log Shemen may be brought on a different day than the Asham, according to Rebbi Meir if it is brought on the same day the blood of the Asham is the Matir.
 
5. According to Rebbi Meir, if the Nesachim are brought on the same day as the Korban, the blood of the Korban is Matir the Nesachim. The Chachamim maintain that since the Nesachim may be brought on a different day than the Korban, the blood of the Korban is not the Matir the Nesachim even when brought on the same day.
 
6. According to Rebbi, there is a Chiyuv Me'ilah on the Log Shemen until the seven sprinklings of the Shemen. However, even according to the Tana Kama, there is an Isur d'Rabanan against benefiting from the Log Shemen until the seven sprinklings of the Shemen.
 
7. Although, Min ha'Torah, it may be eaten by the Kohanim after the sprinkling of the blood of the Asham (according to the Tana Kama) or after the sprinkling of the Shemen (according to Rebbi), mid'Rabanan it may not be eaten until the Matan Behonos.
 
8. A Minchas Omer and Minchas Sotah are not brought for atonement. The Minchas Omer is brought to be Matir the Chadash in the Medinah (outside the Beis ha'Mikdash). A Minchas Sotah is brought to ascertain whether the Sotah was Mezanah. Even so, it is no different from any other Minchah and it is eaten by the Kohanim.
 
9. Although Melikah, and not Shechitah, is done to a Chatas ha'Of, it is not considered a Neveilah and it may be eaten. Although an Asham Nazir Tamei is brought in order to be Machshir the Nazir to begin counting his Nezirus Taharah and not as atonement, it is eaten by the Kohanim.
 
10. The money is Chulin and becomes the property of the Kohen to do with it as he pleases.
 
11. The Chiyuv of Pigul for Parim ha'Nisrafim applies only when the Machshavah occurs during an Avodah in the Azarah, and the Machshavah involves an Avodah in the Azarah. In this case, even though the Machshavah occurred during the Shechitah which is in the Azarah, since the Machshavah involved the sprinkling of the blood which is done in the Heichal, the Korban is not Pigul.
 
12. Although the spilling of the Shirayim and the Haktaras ha'Eimurim are done in the Azarah, since the Kohen had the Machshavah during the sprinkling of the blood which is done in the Heichal, the Korban is not Pigul.
 
13. In this case, the Machshavah occurred during an Avodah in the Azarah and it involved an Avodah in the Azarah. Therefore, the Korban is Pigul.
