1)

WHO RECEIVES A WIFE'S EARNINGS AND METZI'OS? (Yerushalmi Perek 6 Halachah 1 Daf 38b)

מתני' מציאה האשה ומעשה ידיה של בעלה וירושתה הוא אוכל פירות בחייה

(a)

(Mishnah): A man receives Metzi'os that his wife finds and her earnings. He receives the Peiros of her property in her lifetime;

בושתה ופגמה שלה

(b)

[If one embarrassed or wounded her,] the payments of Boshes and Pegam are hers;

רבי יהודה בן בתירה אומר בזמן שהן בסתר לה שני חלקים ולו אחד ובזמן שהן בגלוי לו שני חלקים ולה אחד

R. Yehudah ben Beseira says, for damage to a covered part of the body, she receives two thirds of the payment and he gets a third. For damage to an exposed part, he gets two thirds and she gets a third.

שלו נותנין לו מיד ושלה ילקח בהן קרקע והוא אוכל פירות:

He receives his share immediately. Her share is used to buy land, and he receives the Peiros.

(Gemara - R. Chizkiyah citing R. Imi): R. Yochanan and Reish Lakish argued about this. One said that all agree [that a man receives his wife's Metzi'os], and one said that it is an argument (it is like R. Meir. R. Yochanan ha'Sandlar holds that she gets her extra earnings, and all the more so her Metzi'os.)

מסתברא דרבי שמעון בן לקיש הוא דו אמר במחלוקת דו פתר לה במעלה לה מזונות ואינו נותן לה מעה כסף לצרכיה

Presumably, Reish Lakish said that it is an argument. For he explained that [R. Meir and R. Yochanan ha'Sandlar discuss] when he feeds her, and does not give to her Ma'ah Kesef for her needs;

ותנינן ואם אינו נותן לה מעה כסף לצרכיה מעשה ידיה שלה מעשה ידיים שהן כמציאה

(Mishnah): If he does not give to her Ma'ah Kesef for her needs, her earnings are hers. Earnings are like a Metzi'ah.

אתא רבי יעקב בר אימי בשם רבי שמעון בן לקיש דברי הכל היא

Question: R. Yakov bar Imi came and said in the name of Reish Lakish that it is like everyone!

הוויי דעוון דעוון אית לרבי שמעון בן לקיש

Answer: There are different opinions (Amora'im argue) about what Reish Lakish said.

Question: According to whom did [our Mishnah] need to teach [that he gets only the Peiros of what she inherits]?

לרבי מאיר אף על גב דלרבי מאיר עביד יד העבד כיד רבו זכתה האשה זכה בעלה מודה שאין עליה אלא אכילת פירות בלבד

Answer: It is according to R. Meir. Even though R. Meir makes a slave's Yad (power of acquisition) like his master's Yad, and what a woman acquired, her husband acquired, he agrees that he gets only rights to eat the Peiros.

תמן תנינן מציאת בנו ובתו הקטנים ועבדו ושפחתו הכנענים ומציאת אשתו הרי אילו שלו שהוא יכול לשנותן למלאכה אחרת

(Mishnah): The Metzi'ah of his minor son and daughter, and his Kena'ani male and female slave, and the Metzi'ah of his wife, they are his, for he can change them to another Melachah (he can tell them to find Metzi'os);

מה טעמא אמרין מציאת בנו ובתו הגדולים ועבדו ושפחתו העברים הרי אילו שלהן שאינו יכול לשנותן למלאכה אחרת

Why did they say that the Metzi'ah of his adult son and daughter, and of his Ivri male and female slave, they are theirs? It is because he cannot change them to another Melachah.

התיבון הרי אשתו אינו יכול לשנותה למלאכה אחרת ואת אמר מציאתה שלו

Question: His wife, he cannot change her to another Melachah, and you say that her Metzi'ah is his!

אמר רבי יוחנן טעם אחר יש באשה

Answer (R. Yochanan): There is a different reason for a wife.

Question: What is the different reason for a wife?

אמר רבי חגיי מפני קטטה

Answer #1 (R. Chagai): It is due to quarrels. (If she does not give her Metzi'ah to him, he is prone to quarrel with her.)

ר' יוסי לא אמר כן אלא שלא תהא מברחת משל בעלה ואומרת מציאה מצאתי

Answer #2: R. Yosi did not say so. Rather, it is lest she steal property from her husband, and say 'I found a Metzi'ah.'

הגע עצמך שנתן לה אחר מתנה

(p)

Question: Exert yourself [and you will find the answer! She can steal, and say that] someone else gave a gift to her!

קול יוצא למתנה ואין קול יוצא [דף לט עמוד ב] למציאה

(q)

Answer: There is publicity to a gift (if there is no Kol, she is not believed to say that she received a gift). There is no Kol to a Metzi'ah.

הגע עצמך שמצאה בעדים

(r)

Question: Exert yourself! If witnesses saw her find a Metzi'ah (there is no concern lest she stole it from her husband)!

זו מפני זו

Answer: This [what witnesses saw her find, it is his] due to this [a Metzi'ah without witnesses].

אמר רבי יוחנן בשאין טפולין לאביהן אבל אם היו טפולין לאביהן מציאתן שלו

(t)

(R. Yochanan): This is when [his adult children] are not dependent on their father (to feed them), but if they are dependent on their father, their Metzi'ah is his.

הורי ר' יצחק בהן דמשביק אינתתיה ולא ממרק לה פורנא שהוא מעלה לה מזונות עד שעה שהוא ממרקה

R. Yitzchak ruled about one who divorced his wife but did not totally pay the Kesuvah, that he feeds her until he finishes paying it.

ר' רדיפה ר' אחא בשם ר' בון בר כהנא דלא (מחסד לה) [צ"ל מחסר בה - ר"ן] בסתר למה נוטל

Question (R. Redifah citing R. Acha citing R. Bun bar Kahana): [Her husband] is not lacking anything in her [if someone damaged his wife] in a covered place! Why does he get [a third of the payment, according to R. Yehudah ben Beseira We explained this like the RAN on the Rif, 28b.]

מפני צערו שמצטער עמה:

Answer: It is due to his pain. He is pained with her.

2)

RETRACTING FROM A PLEDGE (Yerushalmi Perek 6 Halachah 2 Daf 40a)

מתני' הפוסק מעות לחתנו ומת חתנו אמרו חכמים יכול הוא שיאמר לאחיך הייתי רוצה ליתן ולך אי אפשי ליתן:

(a)

(Mishnah): If a father pledged to give a dowry and the husband died before Nisu'in, the father can tell the Yavam 'I wanted to give to your brother, but I do not want to give to you;'

גמ' ולא דברים שהן קונין באמירה הן

(b)

(Gemara) Question: Are not these matters acquired through speech?! (If so, the first husband already acquired. The Yavam inherits him. How can the father retract?)

תני בר קפרא פוסק (לשם כתובה - הרי"ף כט:א מוחקו) על מנת לכנוס

(c)

Answer (Bar Kapara - Beraisa): One who pledges, it is on condition that he enter her (make Nisu'in. We explained this like the RIF.)

וכיני הפוסק מעות לבתו קטנה כופין אותו ליתן

(d)

Support (Beraisa) Question: One who pledges to his minor daughter, we force him to give.

הא לגדולה לא

(e)

Question: [If one pledges] to an adult [daughter], no (we do not force him to give)?!

אמר רבי אבון כופין אותו ליתן גט:

(f)

Answer (R. Avun): [Regarding a minor,] we force [her husband] to give a Get (PNEI MOSHE. I.e. there is no reason why a minor should suffer Igun (inability to marry). An adult, even if she was silent, it is as if she accepted responsibility for her father's pledge - PF.)

CHANGING THE VALUE OF THE DOWRY (Yerushalmi Perek 6 Halachah 3 Daf 39b)

מתני' פסקה להכניס לו אלף דינר הוא פוסק כנגדו בחמשה עשר מנה

(a)

(Mishnah): If she pledged to bring 1000 Dinarim into the marriage, [her husband] correspondingly pledges (writes in the Kesuvah that he received) 1500 (the reason will be explained);

כנגד השום הוא פוסק פחות חומש

(b)

When property is evaluated, he pledges (writes that she entered) a fifth less than the appraised value.

שום מנה ושוה מנה אין לו אלא מנה

(c)

If the appraisal was 100 and it is truly worth 100, (he writes 100, and) he gets only 100 (he cannot demand that she enter an additional fifth, even though normally the appraisal is a fifth more than he wrote);

שום במנה היא נותנת שלשים וא' סלע ודינר בארבע מאות היא נותנת חמש מאות

(d)

If he writes (that he received) 100, she must bring in property appraised for 125. If he writes 400, she must bring in property appraised for 500.

ומה שהחתן פוסק הוא פוסק פחות חומש:

What the Chasan pledges, he pledges a fifth less.

גמ' מה ראו לומר בכספים אחד ומחצה ובשום פחות חומש

(Gemara) Question: Why did [Chachamim] say that for money [he pledges] one and a half [times what she entered], and for appraisal [of property], it is a fifth less?

אמר רבי יוסי בן חנינה [דף מ עמוד א] שמין דעתה של אשה שהיא רוצה לכלות את כליה ולפחות אותן חומש שמין דעתו של איש רוצה לישא וליתן בהן ולעשותן באחד ומחצה

(g)

Answer (R. Yosi ben Chaninah): We assess a woman's intent. She wants to consume her Kelim (use them until they wear out) and deduct a fifth [from what he pledges corresponding to them]. We assess a man's intent. He wants to do business with the money and consider it one and a half [times the true amount].

אמר רבי יוסה זאת אומרת שאין אדם רשאי למכור כלי אשתו

(h)

Inference (R. Yosah): A man may not sell his wife's Kelim.

דלמא רבי חייה ורבי יסא ר' אימי סלקון לשומא דברתה דרבי יוסי בן חנינה אמרין ליה פחות חומש וכופל

(i)

A case occurred in which R. Chiyah and R. Yosa went to the appraisal of [the dowry of] R. Yosi ben Chaninah's daughter. They said to [the Chasan] 'deduct a fifth and double' (the amount. Above (29b), R. Yosi taught that in a place where the custom is to double the amount given, she collects only half; this was such a place.)

אמר לון פוחת חומש ואינו כופל

He told them, he deducts a fifth and does not double. (The custom to double applies only to money, but not to Metaltelim that are appraised. We explained this like SEFER NIR.)

שמעון בר אבא בשם רבי יוחנן הכניסה לו זהב בשוייו

(j)

(Shimon bar Aba citing R. Yochanan): If she entered gold to him, [it is written in the Kesuvah] like its value.

ותני כן תקשיטין לעשותן דינר בא' ומחצה דינר לעשותן תקשיטין בשוייהן

(k)

Support (Beraisa): If she entered to him ornaments to [sell them, and] convert them to Dinarim (coins), they are [written] at one and a half [times their value]. If she entered to him Dinar (money) to [buy them, and] convert them to ornaments, they are [written] like their value.

רבי אחא בר פפא בעא קומי רבי אימי הכניסה לו בהמה

(l)

Question (R. Acha bar Papa, to R. Imi): If she entered to him an animal, [what is the law]?

אמר ליה בשוייה

(m)

Answer (R. Imi): [It is written] like its value.

הכניסה לו קרקע

(n)

Question (R. Acha bar Papa, to R. Imi): If she entered to him land, [what is the law]?

אמר ליה בשוייה

(o)

Answer (R. Imi): [It is written] like its value.

ואינו משתכר

(p)

Question (R. Acha bar Papa, to R. Imi): Does he not profit?! (He should add a half!)

(וגובה) [צ"ל גבי - ספר ניר] קרקע אין לו אלא אכילת פירות:

Answer (R. Imi): Regarding [an animal or] land, he has only [rights to] eat the Peros. (He cannot sell it, therefore he does not add. We explained this like SEFER NIR.)
