DOES A BOGERES RECEIVE THE FINE? (Yerushalmi Perek 4 Halachah 2 Daf 24a)

מתני' עמדה בבית דין עד שלא בגרה הרי הן של אב מת האב הרי הן של אחין

(a)

(Mishnah): If she stood in Beis Din before she became a Bogeres, the payments belong to the father. If he died afterwards, [her] brothers inherit them;

לא הספיקה לעמוד בבית דין עד שבגרה הרי הן של עצמה

(b)

If she did not have time to stand in Beis Din before she became a Bogeres, she receives the payments;

[דף כד עמוד ב] רבי שמעון אומר אם לא הספיקה לגבות עד שמת האב הרי הן של עצמה

(c)

R. Shimon says, if she did not have time to stand in Beis Din before the father died, [the payments] are hers.

מעשה ידיה ומציאתה אף על פי שלא גבתה מת האב הרי הן של אחין:

(d)

[Her father receives] her earnings and Metzi'os (Hefker objects that she finds), even if she did not collect them yet. If her father dies, they belong to the brothers.

גמ' תני רבי שמעון בן יוחי [דברים כב כט] ונתן האיש השוכב עמה לאבי הנערה חמשים כסף מלמד שאין האב זוכה אלא בנתינה

(Gemara - Beraisa - R. Shimon ben Yochai): "V'Nasan ha'Ish ha'Shochev Imah l'Avi ha'Na'arah Chamishim Kasef" teaches that the father merits only the giving (it is given to him)";

רבי שמעון אומר במגבה הדבר תלוי

(f)

R. Shimon says, it depends on collection;

ורבי אומר בעמידת בית דין הדבר תלוי

(g)

Rebbi says, it depends on standing in Beis Din.

ר' שמעון עבד לה כמעשה בית דין ורבנין עבדין לה כמלוה

R. Shimon makes it like Ma'ase Beis Din, and Rabanan make it like a loan.

על דעתיה דרבי שמעון גובה בעידית על דעתיה דרבנין גובה בבינונית

According to R. Shimon, he collects Idis (like damages). According to Rabanan, he collects Beinonis (like a loan).

על דעתיה דרבי שמעון אין השביעית משמטתה על דעתון דרבנין השביעית משמטתה

According to R. Shimon, Shemitah does not cancel it. According to Rabanan, Shemitah cancels it.

על דעתיה דרבי שמעון הבכור נוטל פי שנים על דעתיה דרבנין אין הבכור נוטל פי שנים

(j)

According to R. Shimon, a Bechor receives a double portion [in it]. According to Rabanan, a Bechor receives a double portion.

WHO RECEIVES A DAUGHTER'S EARNINGS? (Yerushalmi Perek 4 Halachah 2 Daf 24b)

ר' זעירא שלח לרב נחמן בר יעקב ולרבי אימי בר פפי מעשה ידי הבת של מי

(a)

Question (R. Ze'ira, to Rav Nachman bar Yakov and R. Imi bar Papa): A daughter's earnings - who gets them?

(אמר) [נראה שצ"ל אמרו] ליה שוקד אמר לעצמה

(b)

Answer (Rav Nachman bar Yakov and R. Imi bar Papa): 'Shoked' said that they are hers.

מני שוקד

(c)

Question: Who is 'Shoked'?

Answer #1: It is Shmuel.

אמר רבי מתנה בשם רבי אמרוה ומדרש אמרוה

Answer #2 (Rav Masneh): They said it in the name of Rebbi, and it was from a Drashah;

[ויקרא כה מו] והתנחלתם אותם לבניכם אחריכם לרשת אחוזה אותם לבניכם לא בנותיכם לבניכם במעשה ידי הבת הכתוב מדבר

"V'Hisnachalten Osam li'Vneichem Achareichem Lareshes Achuzah" - they (Kena'ani slaves) are [an inheritance] to your sons, but your daughters are not to your sons. The verse discusses the daughter's earnings.

א"ר יודן [דף כה עמוד א] מתניתא אמרה כן מעשה ידיה ומציאתה אף על פי שלא גבת ומת האב הרי הן של אחין

Support (R. Yudan - Mishnah): Her earnings and Metzi'os - even if she did not collect them yet, if her father dies, they belong to the brothers.

מעשה שעשת בחיי האב אבל עשת לאחר מיתת האב כל עמא מודו שהן של עצמה:

This is what she did (earned) in her father's lifetime, but what she did after the father died, all agree that it is hers.

WHEN DOES A FATHER RECEIVE THE KESUVAH? (Yerushalmi Perek 4 Halachah 3 Daf 25a)

מתני' המארס את בתו וגירשה אירסה ונתאלמנה כתובתה שלו

(a)

(Mishnah): If a man was Mekadesh his daughter [to a man, and the man] divorced her, and [her father] was Mekadesh her [again] and she was widowed (before Bagrus) her Kesuvah belongs to [her father];

השיאה וגירשה השיאה ונתאלמנה שלה

(b)

If he married her off (Nisu'in, and her husband) divorced her, he married her off [again], and she was widowed, [her Kesuvah] belongs to her;

ר' יהודה אומר הראשונה של אב

(c)

R. Yehudah says, he receives the first Kesuvah.

אמרו משהשיאה אין לאביה רשות בה:

(d)

Chachamim: Once she does Nisu'in, her father has no jurisdiction over her.

גמ' א"ר בון בר חייה טעמא דרבי יודה כדי שיהא אדם מצוי ליתן לבתו בעין יפה

(Gemara - R. Bun bar Chiyah): R. Yehudah's reason is in order that a man will be likely to give [a dowry] to his daughter generously [when she marries the second time. Really, after one Nisu'in she is not in his Reshus. She remarries by herself! Our Mishnah says that he married her off to teach that even if her father gave a dowry, R. Yehudah agrees that the second time, the Kesuvah is hers. - CHASAM SOFER]

(R. Yakov bar Acha citing R. Yitzchak): R. Yehudah learns from Motzi Shem Ra. (She left his Reshus. Why does the father collect? It is because her husband tried to make her father lose the Kesuvah. - IMREI BARUCH.)

והתני רבי חייה זינתה ועודה בבית אביה משבגרה הוציא עליה שם רע הוא אינו לוקה ואינו נותן מאה סלע אלא או היא או זוממיה מקדימין לבית הסקילה

Question (R. Chiyah - Beraisa): If [he claims that] she was Mezanah while in her father's house, and after Bagrus he was Motzi Shem Ra on her (made his accusation of Zenus, if he lied), he is not lashed, and he does not pay 100 Sela'im. However, (if witnesses testify about Zenus during Eirusin,) she or the witnesses who plotted against her (if they were Huzam) go promptly to the place of stoning. (If it depends on the beginning, since Zenus was during Na'arus, the fine should apply to even if his claim was during Bagrus! The Gemara does not answer this; it is a Gezeiras ha'Kasuv.)

רבי מנא בעא קומי רבי יוסי הגע עצמך הוציא עליה שם רע עודה נערה ובגרה

(h)

Question (R. Mana, to R. Yosi): Exert yourself [and you will find the answer]! If he was Motzi Shem Ra on her while she was a Na'arah, and she became a Bogeres, [what is the law]?

Note: The Mishnah said that if she stood in Beis Din after Bagrus, the fine is hers. It seems that we ask about one who accused her during Na'arus. Is this as if she stood in Beis Din before Bagrus? (PF)

א"ל שמענו שנותן לאביה

(i)

Answer (R. Yosi): We heard that he gives [the fine] to her father.

אמר רבי ירמיה קומי רבי זעירא ותמיה אני היך רבנין מדמו כתובה לקנס ולא דמי דו כתובה משעה הראשונה וקנס בסוף ואת אמר אכן

Question (R. Yirmeyah, to R. Ze'ira): How do Rabanan compare Kesuvah to the fine? They are not similar! Kesuvah, [her father merited it] from the beginning [of her marriage], and a fine comes at the end, and you say so (that they are similar)?!

אמר ליה ומי יאמר לך ואפי' קנס משעה הראשונה הוא

Answer (R. Ze'ira): Who will tell you [that it is so? I say that] even a fine is from the beginning!

R. Mana (who thought that after she became a Bogeres, the fine is hers, for it depends on the end) holds like R. Yirmeyah, and R. Yosi (who answered that it is her father's, for it depends on the beginning) holds like R. Ze'ira.
