THE ENACTMENT FOR GITIN OF CHUTZ LA'ARETZ (Yerushalmi Perek 1 Halachah 1 Daf 1a)

[דף א עמוד א] מתני' המביא גט ממדינת הים צריך שיאמר בפני נכתב ובפני נתחתם

(a)

(Mishnah): One who brings a Get (document of divorce) from abroad (Chutz la'Aretz) must say 'b'Fanai Nechtav uv'Fanai Nechtam' (it was written in front of me and signed in front of me).

רבן גמליאל אומר אף המביא מן הרקם ומן החגר

(b)

R. Gamliel obligates even one who brings from Rekem or Cheger;

ר' אליעזר אומר אפי' מכפר לודים ללוד

R. Eliezer obligates even one who brings from a village near Lud to Lud;

וחכ"א אינו צריך שיאמר בפני נכתב ובפני נתחתם אלא המביא ממדינת הים והמוליך והמביא ממדינה למדינה וממדינת הים צריך שיאמר בפני נכתב ובפני נתחתם

(d)

Chachamim say, the only one who must say 'b'Fanai Nechtav uv'Fanai Nechtam' is one who brings a Get from abroad, one who takes a Get abroad (from Eretz Yisrael), or one who brings a Get from one province to another in Chutz La'aretz, must say 'b'Fanai Nechtav uv'Fanai Nechtam.'

R. Shimon ben Gamliel obligates even one who brings from one county (of a governor) to another county.

גמ' וקשיא אילו המביא שטר מתנה ממדינת הים שמא חש לומר בפני נכתב ובפני נחתם.

(Gemara) Question: One who brings a gift document from abroad, must he say 'b'Fanai Nechtav uv'Fanai Nechtam'?!

ר' יהושע בן לוי אמר שנייא היא שאינן בקיאין בדיקדוקי גיטין.

Answer #1 (R. Yehoshua ben Levi): [Gitin] are different, for [Bnei Chutz la'Aretz] are not expert in the fine points of Gitin.

א"ר יוחנן קל היקלו עליה שלא תהא יושבת עגונה

Answer #2 (R. Yochanan): (The enactment is only for Gitin.) It is a leniency that [Chachamim] were lenient for her, lest she be an Agunah (unable to remarry).

והיינו קל אינו אלא חומר שאילו לא אמר לה בפני נכתב ובפני נחתם אף את אין מתירה להינשא.

Question: Is this a leniency?! It is rather a stringency! If he did not say 'b'Fanai Nechtav uv'Fanai Nechtam', you do not permit her to remarry!

א"ר יוסי חומר שהחמרתה עליה מתחילה שיהא צ"ל בפני נכתב ובפני נחתם היקלתה עליה בסוף שאם בא ועירער עררו בטל.

Answer (R. Yosi): [Due to] the stringency that you are stringent for her at the beginning, that he must say 'b'Fanai Nechtav uv'Fanai Nechtam', you are lenient for her at the end, that if [her husband] comes and protests (that the Get is invalid), his protest is Batel.

רבי מנא סבר מימר בערר שחוץ לגופו (אבל) [צ"ל אב"ל - ספר משביח] בערר שבגופו בערר שאין בו ממש. (אפילו) [צ"ל אב"ל - ספר משביח] בערר שיש בו ממש.

Assumption (R. Mana): This refers to protest Chutz mi'Gufo, but not protest b'Gufo. This refers to protest that has no substance, but not to protest that has substance. (MASHBI'ACH. CHASAM SOFER, citing MAHARIK 74 - b'Gufo is a claim that it is a forgery. Chutz mi'Gufo is another claim, e.g. Lo Lishmah, Migo (since) he could have claimed that it is a forgery.)

אמר ר' יוסי בי ר' בון מכיון דתימר דטעמא חומר שהחמרתה עליה מתחילה שיהא צריך לומר בפני נחתם היקלתה עליה בסוף שאם בא וערר עררו בטל. הווי לא שנייא הוא ערר שחוץ לגופו. הוא ערר שבגופו. הוא ערר שאין בו ממש הוא ערר שיש בו ממש.

Rebuttal (R. Yosi bei R. Bun): Since you say that the reason is, [due to] the stringency that made for her at the beginning, that he must say 'b'Fanai Nechtav uv'Fanai Nechtam', you are lenient for her at the end, that if he comes and protests, his protest is Batel - we do not distinguish. Protest Chutz mi'Gufo is the same as protest b'Gufo. Protest that has no substance is the same as protest that has substance.

וחש לומר שמא חתמו בעדים פסולין.

(m)

Question: You should be concerned lest Pasul witnesses signed!

א"ר אבון אינו חשוד לקלקלה בידי שמים. בבית דין הוא חשוד לקללה

Answer (R. Avun): [Her husband] is not suspected [to tell Pesulim to sign the Get, and ruin his wife] bi'Ydei Shamayim. He is suspected [only] to ruin her in Beis Din;

שמתוך שהוא יודע שאם בא וערר עררו בטל אף הוא מחתמו בעדים כשרין.

Since he knows that if he comes and protests [that the witnesses are Pasul], his protest is Batel, he has Kosher witnesses sign it.

Note: Perhaps he signs Pesulim, and he has Ploni and Almoni who can testify about their Pesul! Even if R. Avun requires a declaration only from Medinah to Medinah, he can ask Beis Din (or Ploni and Almoni) to sign a 'document' saying that the witnesses are Pesulim; anyone going there can ask them! We are concerned for such a Kol (rumors), certainly before she remarries! If Ploni and Almoni ever go to her Medinah and testify, Beis Din will make her leave her new husband! Perhaps her [first] husband is too ashamed to do so, lest people realize his evil intent, close to what OHR SOMAYACH (Hilchos Gerushin 7:24) says, that he is not suspected to forge in front of witnesses.
