ERUVIN 105 (18 Teves) - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the sixth Yahrzeit of her father, Reb Mordechai ben Eliezer Zvi (Rebbi Morton Weiner) Z'L, who passed away 18 Teves 5760. May the merit of supporting and advancing Dafyomi study, which was so important to him, during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

REMOVING TUM'AH FROM THE MIKDASH (Yerushalmi Perek 10 Halachah 14 Daf 64b)

מתני' שרץ שנמצא במקדש כהן מוציאו בהמיינו שלא לשהות את הטומאה דברי ר' יוחנן בן ברוקה

(a)

(Mishnah - R. Yochanan ben Brokah): If a [dead] Sheretz was found in the Mikdash on Shabbos, a Kohen takes it outside in his Avnet (belt), to avoid delaying the Tum'ah in the Mikdash [even on Shabbos. Even though a Sheretz is Muktzeh, the concern to get rid of the Tum'as Mes overrides Shevus];

R. Yehudah says, he takes it out with wooden tongs, to avoid increasing the Tum'ah [to the garment. Wooden Kelim without a receptacle are not Mekabel Tum'ah.]

מאיכן מוציאין אותו

Question: From where must we remove it [or similar Tum'ah]?

מן ההיכל ומן האולם ומבין האולם ולמזבח דברי רבי שמעון בן ננס

Answer #1 (R. Shimon ben Nanas): We must remove it from the Heichal, Ulam and between the Ulam and the Mizbe'ach;

ר' עקיבה אומר מקום שחייבין על זדונו כרת ועל שגגתו חטאת משם מוציאין אותו

(e)

Answer #2 (R. Akiva): Any place for which a Tamei person is Chayav Kares b'Mezid and Chayav Chatas b'Shogeg [if he delays there, i.e. the entire Azarah], we remove it from there.

ושאר כל המקומות כופין עליו פסכתר

If it is found elsewhere, we cover it with a Pesachter (a big bowl).

ר' שמעון אומר מקום שהתירו לך חכמים משלך נתנו לך שלא התירו לך אלא משום שבות:

R. Shimon says, Chachamim permitted to you [only] what [really] is permitted to you. They permitted to you only Shevus (an Isur mid'Rabanan. This will be explained.)

(Gemara - R. Yochanan ben Brokah, to R. Yehudah): (You obligate taking it out with wooden tongs.) Do you not delay the Tum'ah (until we find such tongs)?!

אמר לו לא נמצאת מרבה בטומאה.

R. Yehudah: (You say that he takes it outside in his Avnet.) Do you not increase the Tum'ah (the Avnet becomes Tamei!)

[דף עא עמוד א (עוז והדר)] אמר לו מוטב לעבור על מצות לא תעשה שלא באת לידי ממצות לא תעשה שבאת לפניו.

R. Yehudah: It is better to transgress a Lo Sa'aseh that he does not do overtly (delaying the Tum'ah is passive) than [to transgress] a Lo Sa'aseh overtly (being Metamei the Avnet)!

אמר רבי יוסי בי ר' בון אתייא אילין פלוגתא כאילין פלוגתא

(i)

(R. Yosi bei R. Bun): This argument is like the following arguments;

דתנינן תמן כיצד מפרישין חלה בטומאה ביום טוב רבי (אלעזר) [צ''ל אליעזר] אומר לא תקרא לה שם עד שתיאפה

(Mishnah): How do we separate Chalah in Tum'ah on Yom Tov [of Pesach]? R. Eliezer says, he does not call it Chalah until after it is baked;

בן בתירה אומר תטיל לצונין.

Ben Beseira says, [he separates Chalah from the dough, and] puts it in cold water (to impede fermenting, i.e. becoming Chametz).

[צ''ל ר' יהושע אומר לא זהו חמץ שמוזהרין עליו על בל יראה ובל ימצא אלא מפרשתה ומניחתה עד הערב ואם החמיצה החמיצה - קרבן העדה]

R. Yehoshua says, this is not Chametz about which we are commanded Bal Yera'eh and Bal Yimatzei! Rather, he separates [Chalah ] and leaves it (does not burn it) until night (Motza'ei Yom Tov). If it ferments, it ferments.

אמר לו ר' יהושע לא נמצאתה כשורף קדשים ביום טוב

R. Yehoshua (to R. Eliezer): (You hold that he calls it Chalah and leaves it in the oven.) Do you not find that he burns Kodshim (Tamei Chalah) on Yom Tov?!

אמר לו רבי אליעזר מאיליהן הן נשרפין

R. Eliezer: They burn by themselves.

אמר לו (ר' יהושע) [צ''ל ר''א - קרבן העדה] לא נמצאת עובר על לא יראה ולא ימצא

R. Eliezer: [According to you], do you not find that he transgresses Bal Yera'eh and Bal Yimatzei?!

אמר לו מוטב לעבור על מצות לא תעשה שלא באת לידך ממצות לא תעשה שבאת לפניך.

R. Yehoshua: It is better to transgress a Lo Sa'aseh that he does not do overtly (it ferments by itself) than [to transgress] a Lo Sa'aseh overtly (burning Chalah on Yom Tov).
