INFERENCES ABOUT WHOM THE HALACHAH FOLLOWS (Yerushalmi Perek 4 Halachah 5 Daf 28b)

ר' חונה אמר רב נחמן בר יעקב בעא גר שטבל לאחר שהאיר המזרח מאחר שאילו היה ער [דף כט עמוד א] היה קונה לו שביתה.

(a)

Question (R. Chunah citing Rav Nachman bar Yakov): If a convert immersed after dawn, [do we say that just like a sleeping person acquires Shevisah, for] if he were awake he would acquire Shevisah [also here, he acquires Shevisah, for had he immersed before Shabbos he would have acquired Shevisah]?

מה אמר כאומר רבי יוחנן בן נורי

Question: (His question assumes that the Halachah follows R. Yochanan ben Nuri.) What was said [that shows that the Halachah is] like what R. Yochanan ben Nuri says?

נישמעינה מן הדא דמר רבי יצחק בר נחמן בשם רבי יהושע בן לוי הלכה כרבי יוחנן בן נורי.

Answer: We learn from this that R. Yitzchak bar Nachman said in the name of R. Yehoshua ben Levi, that the Halachah follows R. Yochanan ben Nuri. (We explained this like PNEI MEIR.)

בירר לו מבעוד יום חוזר בו מבעוד יום משחשיכה חוזר בו משחשיכה בירר לו מבעוד יום וקדש עליו היום

Question: If he chose [his four Amos] during the day (before Shabbos), he can retract during the day. [If he chose] after dark, he can retract after dark. If he chose during the day, and Shabbos came [can he retract after dark]?

נישמעינה מן הדא לא יכנס דברי רבי מאיר רבי יודה אומר יכנס.

Answer: We learn from the above [Mishnah that Tana'im argue about this. If one stopped on the road and found that he is within the Techum of a city,] he may not enter it. R. Meir says so. R. Yehudah says, he may enter;

Objection (R. Bun): [In our Mishnah,] R. Yehudah agrees that if he chose, he cannot retract!

Answer: [In our Mishnah, R. Yehudah] does not say so about [one who receives four Amos in addition to a Techum of 2000 Amos.] Rather, he said so about [one who receives only four Amos, e.g. in] the first Mishnah of our Perek, if Nochrim or a Ru'ach Ra'ah removed one from his Techum. (R. Yehudah does not refer to Chachamim in our Mishnah, for he holds like R. Yochanan ben Nuri. We explained this like PNEI MEIR.)
