WHEN THE HETER OF PASEI BIRA'OS APPLIES (Yerushalmi Perek 2 Halachah 1 Daf 13a)

מתני' [דף יד עמוד א (עוז והדר)] עושין פסין לביראות ד' דיומדין נראין כשמונה דברי רבי יהודה

(a)

(Mishnah - R. Yehudah): We may make Pasim (planks) around Bira'os (wells, to permit carrying inside), i.e. four Deyumadim (L-shaped posts in the four corners of a square) that look like eight;

ר' מאיר אומר שמונה נראין [דף יג עמוד ב] כשנים עשר ארבעה דיומדין וארבעה פשוטין

(b)

R. Meir says, we make eight Pasim that look like 12, i.e. four Deyumadim and four Peshutim (straight planks, one in the middle of each side).

גובהן עשרה טפחים ורוחבן ששה ועוביין כל שהוא

(c)

The Pasim must be [at least] 10 Tefachim tall and six Tefachim wide. They can be any thickness;

וביניהן כמלוא שתי רבקות של שלש שלש בקר דברי רבי מאיר

(d)

R. Meir says, the distance between them is [at most] the width of two teams of three cattle [each];

רבי יהודה אומר של ארבע ארבע

R. Yehudah says, it is the width of two teams of four.

קשורות ולא מותרות אחת נכנסת ואחת יוצאת:

[The bulls in each team are] tied together, and not loose. [We consider the width necessary to allow] one [team] to enter and one leaves [at the same time. I.e. there is some room in between. Therefore, we allow for each bull one and two thirds Amos Sochekos, i.e. composed of Tefachim in which there are small spaces between the fingers.]

גמ' לפי שהפרוץ רבה על העומד הוא עושה דיומדין אבל לא פשוטין אוף הוא מוכיח על עצמו משום הולכת הבאר

(g)

(Gemara): Because Parutz Merubah Al ha'Omed, he makes Deyumdin, but not simple planks. It (the well) proves about itself that [the Heter was given for the sake of] going to the well.

ר' זעירא בשם ר' אלעזר הגיעוך סוף תחומי שבת עד איכן הן שאם עשה כן במקום אחר וחזר וזרק ד' אמות בר''ה חייב

(h)

(R. Ze'ira citing R. Elazar): [From here] you understand how much [one must be meticulous about] the laws of Techumim of Shabbos [and Mechitzos]! If he did so (made Pasei Bira'os) elsewhere (not around a well) and went and through four Amos in Reshus ha'Rabim [within the Pasim], he is liable. (Only when they surround a well, they make Reshus ha'Yachid.)

(R. Yosah): Everywhere, [a Mechitzah must be] Omed Merubah Al ha'Parutz, and here you were lenient for him [to permit] Parutz Merubah Al ha'Omed, so you were stringent on him in another way;

שבכל מקום עושה פס של ד' טפחים וכאן עושה פס של ו' טפחים

Everywhere, one may make a plank of four Tefachim, and here he must make a plank of six Tefachim.

רב ירמיה בשם רב לא התירו פסי ביראות אלא לעולי רגלים בלבד

(R. Yirmeyah citing Rav): They permitted Pasei Bira'os only for Olei Regalim.

רב אבין אמר בשעת עולי רגלים

(k)

(R. Avin): [He means that they permitted them only] at the time [while the Mikdash stands, and there are] Olei Regalim.

[דף יד עמוד ב (עוז והדר)] ר' ירמיה בשם ר' שמואל בר רב יצחק מפני עולי רגלים.

(R. Yirmeyah citing R. Shmuel bar Rav Yitzchak): [They permitted them] due to Olei Regalim [but they are permitted even nowadays].

Support #1 (R. Ezra, to R. Mana - Beraisa): We may make Pasei Bira'os nowadays.

והא תנינן ממלין מבור הגולה בגלגל בשבת מבור הגדול כו'

Support #2 (Mishnah): We may use a Galgal (wheel) on Shabbos to draw water from Bor ha'Golah and from the great pit [in the Azarah, and outside the Mikdash, from Bor ha'Kar on Yom Tov];

מפני מה ממלין מבאר הקר בגלגל בי''ט אלא בשעה שעלה ישראל מן הגולה וחנו על אותה הבאר והתנו עמהן הנביאים שביניהן שיהו ממלין מבאר הקר בגלגל בי''ט

Why may we draw from Be'er ha'Kar on Yom Tov using a wheel on Yom Tov? When the exiles returned [from Bavel at the start of Bayis Sheni], they camped by that well [and needed water], and prophets among them permitted it to them stipulated that they may draw from Be'er ha'Kar on Yom Tov using a wheel on Yom Tov.

לא כל בארות הקר התירו אלא אותה הבאר שחנו עליה בלבד

They did not permit all Be'eros ha'Kar (wells), only the well at which they camped.

[דף יד עמוד א] כמה דאת אמר תמן מה שהותר הותר וכה שהותר הותר

Just like you say there, that what was permitted, was permitted [permanently, even when the reason for the initial Heter does not apply], also here [Pasei Bira'os], what was permitted, was permitted [permanently].

ר' אבדימא דחיפא הורי בחיפא ר' ירמיה הורי בחלף בפסי ביראות בזמן הזה.

R. Avdimi of Chaifa ruled in Chaifa, and R. Yirmeyah ruled in Chalaf [to permit] Pasei Bira'os nowadays.

2)

THE ARGUMENT OF R. MEIR AND R. YEHUDAH

הוון בעיי מימר ר''מ יודה לר' יודה. רבי יודה לא יודה לר''מ

(a)

Assertion: They wanted to say that R. Meir agrees to R. Yehudah, but R. Yehudah does not agree to R. Meir (this will be explained);

ר''מ יודה לר' יודה ר''מ אית ליה דיומדין פשוטין ואת אמר הכין

(b)

Question: [How can you say that] R. Meir agrees to R. Yehudah? R. Meir requires Diyumdin and Peshutim, and you say so?!

מתוך שאת עושה דיומדין אבל לא פשוטין אף הוא סבור לומר שמא מחיצת שבת כך הוא והוא הולך ועושה כן במקום אחר ומתחייב

(c)

Answer: (R. Meir agrees that mid'Oraisa, Diyumdin alone permit.) If you would [say to] make Diyumdin and not Peshutim, one will think that they are proper Mechitzos of Shabbos [everywhere], and he will do so elsewhere and be liable [for elsewhere, inside the Pasim is Reshus ha'Rabim].

(R. Acha citing R. Chinena): He (R. Meir) does not agree to him (R. Yehudah), and he (R. Yehudah) does not agree to him (R. Meir).
