Dear Rabbi Kornfeld,

A big Yasher Koach for all your great work on the Daf. You have many Talmidim even in Down Under Australia. Here are a few of questions that came up in our Daf Yomi Shiur in Melbourne.

(3) On Daf 32B the Gemora explains the Mishna that he put his Eiruv above 10 tefachim (Reshus Hayachid) and he wanted to be Koneh Shvisa in the street (Reshus Harabim). So he cannot bring the Eiruv to himself without transgressing an Issur D'Oraysa.

Rashi explains if the Eiruv were between 3 and 9 tefachim it would be in a Karmelis and it would only involve an Isur Derabanan, which would be permitted Bein Hashmoshos.

If so, even when it is above 10 in a Reshus Hayachid, he could still bring it into the Reshus Harabim as follows: Take it from above 10, make a hanacha putting it down between 3 and 9 i.e. a Karmelis - Isur Derabanan. Then he could pick it up again from the Karmelis and put it down in the Reshus Harabim - another Issur Derabanan.

Issurim Deraban are permitted Bein Hashmoshos. So it is still possible to bring down and should therefore be a good Eiruv?

(3) Good question. TOSFOS (DH d'Hadar) indeed explains that your question is the question of the Gemara there, and that the Gemara is answering that the case is discussing a situation when there is no Karmelis upon which to place the food. Tosfos asks that the person should simply place the food on his hand or shoulder above ten Tefachim which is considered a Karmelis (the TOSFOS HA'ROSH, however, doubts whether this is considered resting on a Karmelis; it is considered resting in Reshus ha'Rabim since the person himself is standing in Reshus ha'Rabim). Tosfos answers that since it would be very easy to transgress an Isur d'Oraisa in such a case, Rebbi did not permit doing this type of Isur d'Rabanan during Bein ha'Shemashos.

Even according to Rashi, this type of carrying is worse than carrying less than four Amos in Reshus ha'Rabim and will not be permitted Bein ha'Shemashos for the above reason.
