WHAT HAKRAVAH IS PERMITTED ON YOM TOV (Yerushalmi Perek 2 Halachah 3 Daf 11b)

מתני' ב''ש אומרים מביאין שלמים ואין סומכין עליהן אבל לא עולות

(a)

(Mishnah - Beis Shamai): We may bring Shelamim [on Yom Tov] but do not do Semichah on them, but not Olos;

וב''ה אומרים מביאין שלמים ועולות וסומכין עליהן:

(b)

Beis Hillel say, we may bring Shelamim and Olos and do Semichah on them.

גמ' ב''ש אומרים הותרה סמיכה שלא כדרכה וב''ה אומרים לא הותרה סמיכה שלא כדרכה

(Gemara): Beis Shamai say, Semichah was permitted Lo k'Darkah (abnormally). Beis Hillel say, Semichah was not permitted Lo k'Darkah.

אי זו היא סמיכה שלא כדרכה מאתמול

What is Semichah Lo k'Darkah? It is from the day before.

א''ר זעירה כל עמא מודיי באשם מצורע שסמך עליו מאתמול לא יצא שלמי נדבה שסמך עליהן מאתמול יצא מה פליגין בשלמי חגיגה

(R. Ze'irah): All agree that if one did Semichah on Asham Metzora from the day before, he was not Yotzei [for it says "v'Hevi... v'Samach.'' All agree that if one did Semichah from the day before] on Shalmei Nedavah, he was Yotzei. What do they argue about? They argue about Shalmei Chagigah;

בית שמאי עבדין לון כשלמי נדבה ב''ה עבדין לון כאשם מצורע

Beis Shamai consider them like Shalmei Nedavah. Beis Hillel consider them like Asham Metzora.

א''ר יסה הן דאת אמר אשם מצורע שסמך עליו מאתמול לא יצא בזמנו עיבר זמנו נעשה כשלמי (חגיגה) [צ''ל נדבה - קרבן העדה]

(R. Yosah): You say that if one did Semichah on Asham Metzora from the day before, he was not Yotzei - this is if he brought it in its time (the eighth day). If the time passed, it becomes like Shalmei Nedavah [and one is Yotzei through Semichah the day before].

אמרו ב''ה לב''ש מה אם בשעה שאני אוסר להדיוט הרי אני מתיר לגבוה בשעה שאני מתיר להדיוט אינו דין שנתיר לגבוה

Beis Hillel (to Beis Shamai): If when I (Hash-m) forbid [all Melachah] to a Hedyot (i.e. on Shabbos), I permit to Hash-m (to offer Temidim and Musafim) - when I permit to a Hedyot (Melachah of Ochel Nefesh on Yom Tov), all the more so we should permit to Hash-m (all Korbanos, even Olos)!

אמרו להן ב''ש והרי נדרים ונדבות יוכיחו שהן מותרין להדיוט ואסורין לגבוה

Beis Shamai: Nedarim and Nedavos disprove this! [On Yom Tov, Melachah of Ochel Nefesh] is permitted to a Hedyot, and [Nedarim and Nedavos] are forbidden to Hash-m!

אמרו להן ב''ה לא אם אמרתם בנדרים ונדבות שאין זמנן קבוע תאמרו בחגיגה שזמנה קבוע

Beis Hillel: If you say that Nedarim and Nedavos [are forbidden on Yom Tov], for they have no fixed time, will you say that [the same applies to] Chagigah, whose time is fixed?!

אמרו להן ב''ש חגיגה אין זמנה קבוע שאם לא חג בראשון חוגג בשני שאם לא חג בשני חוגג בשלישי

Beis Shamai: Chagigah's time is not fixed, for if he did not offer it on the second [day of the Regel], he may offer it on the third!

אמרו להן ב''ה חגיגה זמנה קבוע שאם לא חג ברגל אינו יכול לחוג לאחר הרגל

Beis Hillel: Chagigah's time is fixed, for if he did not offer it during the Regel, he cannot offer it after the Regel!

אמרו להם ב''ש והלא כבר נאמר [שמות יב טז] אך אשר יאכל לכל נפש הוא לבדו יעשה לכם

Beis Shamai: It already says "Ach Asher Yochal l'Chol Nefesh Hu Levado Ya'aseh Lachem''! (How can you permit Olah, which people may not eat?!)

אמרו להם ב''ה משם ראייה לכם אינו נעשה אבל נעשה הוא לגבוה

Beis Hillel: Do you bring a proof from there?! It is not done "Lachem'', rather, it is done for Hash-m! (The limitation "Ach Asher Yochal... Hu Levado'' applies only to what is Lachem, but not to what is for Hash-m.)

אבא שאול אומר טעם אחר מה אם בשעה [דף יב עמוד א] שכירתך סתומה כירת רבך פתוחה בשעה שכירתך פתוחה אינו דין שתהא כירת רבך פתוחה

Aba Sha'ul said a different reason. When your oven is sealed (Shabbos, when you may not cook), your Rebbi's oven is open (we offer on the Mizbe'ach). When your oven is open (Yom Tov), all the more so your Rebbi's oven should be open (for all Korbanos)!

דבר אחר אינו בדין שיהא שולחנך מלא ושולחן קונך ריקם

9.

Another reason - it is improper that your table is full, and your Maker's table is empty.

אמר ר' יוסי בי רבי בון רבי שמעון בן לקיש הוה עבר קומי סדרא ושמע קלהון קריי הדין פסוקא [דברי הימים א כט כא] ויזבחו לה' זבחים ויעלו עולות לה' למחרת היום ההוא

(f)

(R. Yosi bei R. Bun): Reish Lakish was passing by the Beis Midrash, and heard [children] reading "va'Yizbechu la'Shem Zevachim va'Ya'alu Olos l'Macharas ha'Yom ha'Hu'';

אמר מאן דמפסיק ליה כבית שמאי מאן דקרא כוליה כבית הלל

He said, the one who breaks [the verse between Zevachim and va'Ya'alu, i.e. they offered Shelamim that day (Yom Tov) and Olos the next day] holds like Beis Shamai. The one who reads the entire verse (without a break, i.e. they offered both Shelamim and Olos the next day) holds [even] like Beis Hillel;

ניחא עולות למחרת היום ההוא שלמים למחרת היום ואין שלמים באין כב''ש

i.

Question: Granted, [according to Beis Shamai we could say that they offered] Olos the next day. Why did they wait for] Shelamim until the morrow? Do Shelamim not come [on Yom Tov even] according to Beis Shamai?!

א''ר יוסי בי רבי בון דוד מת בעצרת והיו כל ישראל אוננין והקריבו למחר

ii.

Answer (R. Yosi bei R. Bun): David died on Shavu'os, and all of Yisrael were Onenim (so they could not offer that day), and they offered the next day.

מעשה בהלל הזקן שהביא עולתו לעזרה וסמך עליה חברו עליו תלמידי ב''ש התחיל מכשכש בזנבה אמר להן ראו נקיבה היא ושלמים הפליגן בדברים והלכו להן

(g)

A case occurred in which Hillel ha'Zaken brought his Olah to the Azarah [on Yom Tov] and did Semichah on it. Talmidei Beis Shamai ganged up on him. He began to wag its tail. He said to them, see, it is a female (when the tail is lifted, the female genitals are visible), and a Shelamim. He diverted them with words, and they went away.

לאחר ימים גברה ידן של ב''ש וביקשו לקבוע הלכה כדבריהם והיה שם בבא בן בוטא מתלמידי ב''ש ויודע שהלכה כב''ה

Days later, Beis Shamai overpowered, and wanted to fix the Halachah like their words. Bava ben Buta was there from Beis Shamai, and he knew that the Halachah follows Beis Hillel;

ופעם אחת נכנס לעזרה ומצאה שוממת אמר ישמו בתיהן של אלו שהישמו את בית אלהינו

Once, he entered the Azarah [on Yom Tov] and found it [almost] desolate. He said, the houses of these (who are not offering Olos today) should be desolate, for they made desolate Hash-m's House!

מה עשה שלח והביא שלשת אלפים טלי מצאן קדר וביקרן ממומין והעמידן בהר הבית ואמר להן שמעוני אחיי בית ישראל כל מי שהוא רוצה יביא עולות יביא ויסמוך יביא שלמים ויסמוך

What did he do? He brought 3,000 lambs from the flock of Kedar (high quality animals) and checked them from [ensured that they have no] blemishes, stood them in Har ha'Bayis, and said "hear me, my brothers Bnei Yisrael! Whoever wants to bring Olos, bring and do Semichah! Whoever wants, bring Shelamim and do Semichah!''

באותה השעה נקבעה הלכה כבית הלל ולא אמר אדם דבר

4.

At that time the Halachah was fixed like Beis Hillel, and no one said anything [to protest].

א''ר יצחק בי ר' לעזר הדא (כסא בשירותה בעייא מילוי כסא דקיסא) [צ''ל כל כשרותה בעי מלאי ססא דקסא - עמודי ירושלים] מיניה וביה

(h)

(R. Yitzchak bei R. Lazar): A beam needs its own kind (an axe with a wooden handle, to cut it. Beis Shamai was rejected only from Bava ben Buta, who was one of them.) Wood becomes wormy from [a worm that began] inside itself. (We explained this like AMUDEI YERUSHALAYIM, citing the ME'IRI.)

כל גומרא דלא כוויא בשעתה לא כוייא

(i)

Any coal that is not ignited in its time, it will not be ignited later (without a great fire. Because initially, Hillel did not defend his opinion, it took great efforts to establish the Halachah like him afterwards.)

מעשה באחד מתלמידי ב''ה שהביא עולתו לעזרה וסמך עליה וראהו אחד מתלמידי ב''ש אמר להן מה זו סמיכה אמר לו מה זו שתיקה ושיתקו בנזיפה והלך לו:

A case occurred with one of Talmidei Beis Hillel who brought his Olah to the Azarah [on Yom Tov] and did Semichah on it. One of Talmidei Beis Shamai saw, and said to them "what is this Semichah?!'' He said to him, what is this silence?! He angrily silenced him and he went away.

2)

WHEN WE BRING KORBANOS OF SHAVU'OS (Yerushalmi Perek 2 Halachah 4 Daf 12a)

מתני' עצרת שחלה להיות ערב שבת ב''ש אומרים יום טבוח לאחר שבת

(a)

(Mishnah): If Shavu'os fell on Erev Shabbos, Beis Shamai say, Yom Tevo'ach (the day to bring Olos, which could not be brought on Yom Tov) is after Shabbos;

וב''ה אומרים אין להן יום טבוח

(b)

Beis Hillel say, there is no Yom Tevo'ach (everything may be brought on Yom Tov).

ומודין שאם חלה להיות בשבת שיום טבוח לאחר שבת ואין כ''ג מתלבש בכליו ומותרין בהספד ובתענית שלא לקיים את דברי האומרין עצרת לאחר השבת:

(c)

They agree that if it fell on Shabbos, Yom Tevo'ach is after Shabbos (Sunday), and the Kohen Gadol does not wear his Bigdei [Kehunah], and that day, people are permitted eulogies and fasting, lest we support those who say that Shavu'os is [always] after Shabbos.

גמ' עצרת שחלה להיות ערב שבת ב''ש אומרים יום טבוח שלה לאחר שבת ב''ה אומרים אין לה יום טבוח אלא יומה הוא טבוחה

(d)

(Gemara): If Shavu'os fell on Erev Shabbos, Beis Shamai say, its Yom Tevo'ach is after Shabbos. Beis Hillel say, it has no Yom Tevo'ach. Rather, the day (Shavu'os) is for Shechitah [of all Korbanos].

הא ב''ש אומר יום טבוח שלה אחר שבת ואין כ''ג מתלבש בכליו מק''ו

(e)

Beis Shamai say, its Yom Tevo'ach is after Shabbos, and the Kohen Gadol does not wear his garments, from a Kal v'Chomer;

מה אם בשעה שיש שם שלמים ועולות כדברי ב''ה אין כ''ג מתלבש בכליו בשעה שאין שלמים ועולות כדברי בית שמאי לא כ''ש

If when [Shavu'os fell on Shabbos, and on Yom Tevo'ach] there are Shelamim and Olos even according to Beis Hillel, the Kohen Gadol does not wear his garments - when [Shavu'os fell on Erev Shabbos, and on Yom Tevo'ach] there are not Shelamim and Olos (rather, only Olos) according to Beis Shamai, all the more so (he does not wear his garments)!

כתוב אחד אומר [שמות כג טז] וחג הקציר בכורי מעשיך וכתוב אחר אומר [ויקרא כג ז] כל מלאכת עבודה לא תעשו

(f)

Contradiction: One verse says "v'Chag ha'Katzir Bikurie Ma'asecha'', and another verse says "Kol Meleches Avodah Lo Sa'asu''!

א''ר חנניה כיצד יתקיימו שני מקראות הללו בשעה שהוא חל בחול את חוגג ושובת ובשעה שהוא חל בשבת למחר את חוגג וקוצר

(g)

Resolution (R. Chananyah): How do we fulfill both of these? When [Shavu'os] falls during the week, you bring Chagigah and cease [from Melachah]. When [Shavu'os] falls on Shabbos, the next day [on Yom Tevo'ach] you bring Chagigah and [may] reap.

(h)

(R. Yosi bei R. Bun): It is permitted only if his dough was finished (but if one has food, he may not do Melachah of Ochel Nefesh to make more of the same kind);

כהדא דתני להן אינש דיהוי עלוהי אעין ובכורין האומר הרי עלי עצים למזבח וגיזרין למערכה אסור בהספד ותענית ומלעשות מלאכה בו ביום.

This is like it was taught about one who has [a vow] on himself to bring wood [for the Mizbe'ach] or Bikurim, e.g. he said "it is Alai to bring wood for the Mizbe'ach or logs for the Ma'arachah (woodpile on the Mizbe'ach, the day he brings is like a Yom Tov.) He is forbidden eulogies, fasting and Melachah that day.

מודים שאם חלה להיות בשבת שיום טבוח שלה לאחר שבת

(i)

(Mishnah): They agree that if it fell on Shabbos, its Yom Tevo'ach is after Shabbos.

הא בית הלל אומרים יום טבוח שלה לאחר שבת עורות של מי

(j)

Question: Beis Hillel say that its Yom Tevo'ach is after Shabbos. Who receives the skins [of Olos offered on Yom Tevo'ach? On Yom Tov, all the Mishmaros share them.]

רבי טבי בשם ר' יאשיה איתפלגון רבי יוחנן ורשב''ל רבי יוחנן אמר של כל המשמרות ר''ש בן לקיש אמר של אותו המשמר

(k)

Answer (R. Tavi citing R. Yoshiyah): R. Yochanan and Reish Lakish argued about this. R. Yochanan said that they are of all the Mishmaros. Reish Lakish said that they are of that Mishmar [that serves that day, according to the rotation].

ואת אמר יום (טוב) [צ''ל טבוח] שחלה לאחר שבת עורות של מי פלוגתא דרבי יוחנן ורשב''ל

(l)

Objection: Can you say that when Yom Tevo'ach is after Shabbos, who receives the skins is an argument of R. Yochanan and Reish Lakish?! (Surely all agree that these are Korbanos of the Regel, and they are of all the Mishmaros! We explained this like PNEI MOSHE.)

(m)

(R. Yochanan): Shavu'os has Tashlumin all seven days.

התיב רב הושעיה והא תני מה החדש למנוייו יום אחד אף העצרת למנוייה יום אחד

(n)

Question (R. Hoshayah): It was taught "just like a month is according to its constituent parts (we count 30 days, and we are Mekadesh to be Rosh Chodesh) one day, also Shavu'os is according to its constituent parts (we count 50 days, and it is only) one day!

Answer (R. La): [Surely, l'Chatchilah it is one day. R. Yochanan teaches that] if he did not bring Chagigah the first day, he may bring it [any time during] all seven days.

(R. Yosi bei R. Bun citing R. Yehoshua ben Levi): Every day the Kohen Gadol wears his Bigdei [Kehunah] and comes and offers the morning Tamid;

אם יש נדרים ונדבות הוא מקריבן והולך ואוכל בתוך ביתו ובא ומקריב תמיד של בין הערבים ובא ולן בלשכת פלהדרין

If there are Nedarim and Nedavos, he offers them and goes and eats in his house. He comes and offers the afternoon Tamid and goes to the Palhedrin chamber;

ר' עוקבה בשם ר' יהושע בן לוי לא היה עושה כן אלא בשבתות ובימים טובים

(R. Ukvah citing R. Yehoshua ben Levi): He did so only on Shabbosos and Yamim Tovim.

אית תניי תני הציץ מרצה על מצחו אית תניי תני אפי' בזוית

(r)

Some teach that the Tzitz is Meratzeh (makes Korbanos acceptable, even if Tum'ah occurred) when it is on his forehead, and some teach [that it is Meratzeh] even if it is in the corner.

מ''ד הציץ מרצה על מצחו [שמות כח לח] והיה על מצחו תמיד מ''ד אפי' בזוית מהדא דיום הכיפורים

The one who says that it is Meratzeh [only] when it is on his forehead learns from "v'Hayah Al Mitzcho Tamid.'' The one who says even if it is in the corner learns from Yom Kipur (surely it is Meratzeh even when he wears only the Bigdei Lavan).

מ''ד הציץ מרצה על מצחו מסייע לר' יוסי בי ר' בון מאן דאמר אפי' בזוית מסייע לר' עוקבה:

The one who says that it is Meratzeh [only] when it is on his forehead supports R. Yosi bei R. Bun [who says that he wears his Begadim every day]. The one who says even if it is in the corner supports R. Ukvah [who says that he did so only on Shabbos and Yom Tov].
