LIABILITY IN A CHATZER (Yerushalmi Perek 3 Halachah 8 Daf 16a)

(Mishnah): If a man was chopping wood in a Reshus ha'Rabim and damaged in [another's] Reshus ha'Yachid, or vice- versa, or was chopping in a Reshus ha'Yachid and damaged in another's Reshus ha'Yachid, he is liable [four damages, but not Boshes, which is only if he intended to harm].

(Gemara - R. Yosi ben Chaninah): If one was standing and chopping wood in his Chatzer, and a worker entered to claim his wage, and a piece of the wood was strewn and damaged him, he is liable. If he died, he is not exiled;

Question: R. Chiyah taught that he is exempt!

Answer: They do not argue. R. Yosi discusses when he saw [the victim], and R. Chiyah discusses when he did not see him.

Question: If [R. Chiyah exempts only when] he did not see him, since he said "enter'', he should be liable. However, a Beraisa teaches that R. Chiyah exempts!

(R. Yochanan citing R. Yanai): Partners can acquire from each other in a jointly owned Chatzer, and each is liable for damage to the other.

Question: Didn't Rav say that he filled the entire [width of] Reshus ha'Rabim? (If not, he would collect from one who broke his Kli, and he would be exempt if someone was damaged through his Kli. Here,) did he fill Reshus ha'Rabim?! (The victim could have gone elsewhere!)

Answer: Since it is normal for one to go in the Chatzer, it is as if he filled the entire Chatzer.

PAYMENT OF HALF DAMAGE (Yerushalmi Perek 3 Halachah 9 Daf 16a)

(a)

(Mishnah): If two Tam oxen damaged each other, they (i.e. whichever damaged more) pay half the excess damage. If they are Mu'ad, they pay all the excess damage;

If one is Tam and one is Mu'ad, if [the greater damage was] the Mu'ad to the Tam, it pays all the excess damage;

If a man damaged a Tam and the Tam damaged the man, if the man damaged the Tam more, he pays all the excess damage;

He gets only half [the loss due to] the wounding. Therefore (since a Tam pays only mi'Gufo), if the ox [that gored] died or weakened, he gets only that ox.

If an ox worth 100 gored an ox worth 200, and weakened it (decreased its value) 50 Zuz. If the latter returned and wounded it three gold Dinarim (75 Zuz), the latter pays the former half a gold Dinar (half the excess damage).

Correction (R. La): The Beraisa should say 'if the damager improved - if it improved before it stood in Beis Din, [the victim] receives only like at the time of the damage. (We do not say that he became a partial owner at the time of the damage, and his share improved.) If it weakened, he receives only like at the time it stood in Beis Din.' (He became a partial owner at the time of the damage, and his share decreased - MAHARA FULDA, SEDEI YEHOSHUA.)
