TRAPPING AND FEEDING CREATURES (Yerushalmi Halachah 1 Daf 13a)

משנה אין צדין דגים מן הביברין ואין נותנין לפניהם מזונות אבל צדין חיה ועוף מן הביברין ונותנין לפניהן מזונות

(a)

(Mishnah): One may not trap fish from the pools nor may one give them food; but one may trap wild animals and birds from their enclosures and one may give them food.

R. Shimon ben Gamliel: Not all enclosures are the same. The general rule is - anything that is lacking an act of trapping is prohibited; anything that is not lacking an act of trapping is permitted.

[דף יג עמוד ב] גמרא אמר רבי חיננא מתני' דלא כרבי יודה דתנינן תמן רבי יודה אומר הצד צפור למגדל וצבי לבית חייב הא לגינה ולביברין פטור

(Gemara - R. Chinana): The Mishnah does not follow R. Yehudah's opinion, as the Mishnah (in Maseches Shabbos) teaches - R. Yehudah says, one who traps a bird into a cupboard or a deer into a house is liable. However, one would not be liable if they were trapped into a garden or an enclosure.

(מחלפה שיטתיה דרבי יודה דתנינן אין צדין דגים מן הביברים ואין נותנין לפניהן מזונות הא לגינה ולביברין פטור)

(d)

(The opinion of R. Yehudah is switched, as the Mishnah teaches - one may not trap fish from the pools and one may not give them food. However, one would not be liable for trapping them into a garden or enclosure.) (Note: The Korban HaEidah removes this sentence from the text.)

The opinion of the Rabbanan is switched (i.e. the Mishnah also does not follow the Rabbanan's opinion), as the Mishnah (in Maseches Shabbos) teaches - the Chachamim say that one is liable for trapping a bird into a cupboard and a deer into a garden, a courtyard or an enclosure. However, our Mishnah teaches that one may trap a wild animal or bird from an enclosure and give them food. But one may (only trap from an enclosure but) not trap them from a garden or courtyard?!

Answer: One refers to a covered courtyard and one refers to an open courtyard.

והא תנינן גינה אית לך מימר גינה מקורה

(g)

Question: The Mishnah (in Maseches Shabbos) mentions 'a garden'. Is there such a thing as a covered garden?

אלא כאן בגדולה כאן בקטנה

(h)

Answer: Rather, our Mishnah refers to a large courtyard and the Mishnah in Shabbos refers to a small one.

R. Ula: R. Acha was asked - what is the correct text in the Mishnah of the words of R. Shimon B''G? 'For anything that is lacking trapping he is liable' or 'for anything that is not lacking trapping he is exempt'...?

אמר לון ולא בנעל לתוכה אנן קיימין אלא כל המחוסר צידה אסור ושאינו מחוסר צידה מותר

R. Acha answered: Are we not referring to when he locked it inside? So the correct text is 'for anything that is lacking trapping it is prohibited, for anything that is not lacking trapping it is permitted'.

R. Shmuel, the brother of R. Berachia: Anything which requires strategy to be able to trap it, is considered 'lacking trapping'; if it does not, it is not considered 'lacking trapping'.

שוחטין מן הנגרים ואין שוחטין לא מן המכמורות ולא מן המצדות

One may slaughter animals from the enclosures but not from the traps or nets (as perhaps they were trapped on Yom Tov and they are Muktzah).

R. Yosi bei R. Bun quoting R. Imi: One may not trap from inside a net that was woven in one direction, as it is not (secure in there and not) yet trapped.

Shmuel: One may trap fish from inside a large barrel. (Note: This entry follows the explanation of Rav Cahim Kanievski.)

Rav: One may trap from a enclosure that was made using boards to dam a river.

R. Yudan: It is permitted only if the boards were arranged to make a very small enclosure that prevents the fish to escape.
