THREE DISPUTES OF R. ELAZAR BEN AZARYAH (Yerushalmi Halachah 8 Daf 12b)

[דף יב עמוד ב] משנה ג' דברים ר' אלעזר בן עזריה מתיר וחכמים אוסרין

(a)

(Mishnah): There are three cases where R. Elazar ben Azaryah permits and the Chachamim prohibit.

פרתו יוצאה ברצועה שבין קרניה

1.

A cow may go out wearing a strap between its horns (as it is an adornment not a load).

ומקרדין את הבהמה בי''ט

2.

One may scratch (Kirud) an animal on Yom Tov (with a metal comb).

ושוחקין את הפילפלין בריחים שלהן

3.

One may grind peppercorns with their millstones.

ר' יהודה אומר אין מקרדין את הבהמה מפני שהוא עושה חבורה אבל מקרצפין

4.

R. Yehudah says - one may not scratch (Kirud) an animal (with a metal comb) because it wounds, but one may scratch (Kirtzuf) with a wooden comb.

וחכמים אומרים אין מקרדין אף לא מקרצפין

5.

The Chachamim say - One may not scratch, neither with a metal nor a wooden comb.

גמרא ר' בא רב ושמואל תריהון אמרין דברי חכמים אפילו להמשיך בה אסור

(Gemara - R. Ba): Rav and Shmuel both said - the Chachamim prohibited even leading a cow using the strap between its horns.

ר' בא בשם שמואל אם היתה קרנה קדוחה מותר

R. Ba quoting Shmuel: It is permitted if its horn is pierced (and the strap is fixed through it).

R. Yosa: I raised this difficulty before R. Ba, and he said that it only permitted for a donkey with a nose ring (but not a cow).

R. Zeira quoting Shmuel: An ox that is prone to cause damage may go out with a bit in its mouth. Our Rabbis of the Diaspora would also allow this.

R. Acha / R. Yaakov bar Idi quoting R. Yochanan/ R. Yaakov bar Acha quoting R. Tanchum bei R. Chiya: A donkey that is prone to cause damage may go out with a bit in its mouth.

ר' אילא רבי יהודה בשם ר''ש בי ר' חייה כלב יוצא בסוגר שלו אם להכות בו אסור [דף כו עמוד ב (עוז והדר)] אם בשביל שלא לאכול אפסרו מותר

R. Ila/ R. Yehudah quoting R''S bei R. Chiya: A dog may go out wearing its collar (to which the leash is attached). If the owner puts it on to be able to hit it, it is prohibited; if he puts it on to prevent its halter (rope tied to its mouth in order to lead it) eating into its neck, it is permitted (as it is there to protect the dog).

(h)

(The Mishnah had taught that R. Elazar ben Azaryah permitted a cow to go out wearing a strap between its horns). Genivah said that R''EBA merely discussed and taught over (the Halachah of permitting the cow to go out in this way. However, he did not actually rule this way and he certainly did not behave this way himself.)

Question (R. Yona Butzrayah): If he was merely discussing the Halachah, why would the Mishnah teach that the Chachamim were so unhappy with him?

Conclusion of question (R. Yuda bar Pazi of Bardalaya from a Beraisa): The Chachamim said to R''EBA - Either leave us (i.e. we will excommunicate you) or remove the strap from between its horns! (This certainly seems to be saying that he actually had taken his cow outside in this way.)

Question (R. Yosi bei R. Bun): Did he continue to disagree so persistently that they had to give him this ultimatum?

Conclusion of Question (R. Chananya): But did it not once happen that his cow went out in this way and (he was so distraught over the stumbling block that he had caused that) his teeth became blackened by all of his fasting?

Answer (R. Idi of Chutra): It was his wife's cow. From where do we know that a person's wife is referred to as a calf? As the Pasuk states (Shoftim 14, 18), "If you would not have 'ploughed with my calf', you would not have deciphered my riddle.''

In Bavel they say that it was R. Elazar B''A's neighbor who took out her cow with a strap.

Question: Would a person be punished for the transgression of his neighbor?

R. Kiris of Irmah: This teaches that whoever is able to protest [a sin] and does not, the sin is hung upon him.

SCRATCHING AN ANIMAL AND GRINDING PEPPERCORNS (Yerushalmi Halachah 8 Daf 12b)

(a)

Question: What is Kirud?

אלו הקטנים שהן עושין חבורה קירצוף אלו הגדולים שאינן עושין חבורה

Answer: Using a metal brush that has fine bristles (like a small saw) which wound the animal. Kirtzuf refers to a using a wooden brush with thick bristles that do not wound.

וחכ''א אין מקרדין אף לא מקרצפין

(c)

The Mishnah had taught: The Chachamim say - One may not scratch, neither with a metal (Kirud) nor a wooden comb (Kirtzuf).

אין מקרדין שלא יבואו לידי חבורה ולא מקרצפין שלא יבואו לידי תלישה

(d)

One may not do Kirud, lest he makes a wound; one may not do Kirtzuf, lest he pull out hairs (a wooden brush can pull out hairs/wool).

The people of the House of Rabban Gamliel would grind peppercorns with peppercorn grinders.

R. Elazar bei R. Tzadok: My father once ate with Rabban Gamliel and they brought him Ingarin (beet water) that contained ground peppers. After he tasted them, he removed his hand from it (out of concern that the peppers were ground on Yom Tov).

אמר לו אל תחוש להם מערב י''ט הן שחוקין

Rabban Gamliel to R. Tzadok: Don't worry - they were ground before Yom Tov.

ויעשה רבי צדוק כשוגג אצל רבן גמליאל ויאכל

(h)

Question: Why could R. Tzadok not consider himself to be benefitting from an inadvertent Melacha, which would permit him to eat it in order to prevent Rabban Gamliel from being embarrassed?

אלא שלא להתיר מלאכה על ידי ר''ג

(i)

Answer: He refrained from eating, otherwise people would say that Rabban Gamliel permitted Melacha on Yom Tov.

THE TUMAH OF PEPPER GRINDERS (Yerushalmi Halachah 9 Daf 13a)

[דף יג עמוד א] משנה הריחיים של פילפלין טמאה משום ג' כלים משום כלי קיבול ומשום כלי מתכות ומשום כברה

(a)

(Mishnah): Pepper grinders are made of three separate utensils that are susceptible to Tumah - there is a receptacle, it is made of metal and there is a sifter.

גמרא התחתון משום כלי קיבול והעליון משום כלי מתכות והאמצעית משום כברה

(b)

(Gemara): The lower part is a receptacle, the upper part is metal and the middle part is a sifter.

THE TUMAH OF A CHILD'S WAGON (Yerushalmi Halachah 10 Daf 13a)

משנה עגלה של קטן טמאה מדרס ניטלת בשבת ואינה נגררת [אלא] ע''ג הכלים

(a)

(Mishnah) A child's toy wagon is susceptible to Tumas Midras (if the child is a Zav, the wagon becomes an Av HaTumah); it may be moved on Shabbos and it may only be dragged on Shabbos if it is resting on clothing (otherwise it will make a furrow in the ground due to its weight).

רבי יהודה אומר כל הכלים אינן נגררין חוץ מן העגלה מפני שהיא כובשת

R. Yehudah: No utensils may be dragged over earth except for a wagon, as it does not make a furrow - rather, it merely presses down the ground rather than moving aside the earth.

(c)

(Gemara - Beraisa): A person should not drag a bed, a chair or types of benches (over earth) as it will make a furrow. R. Shimon permits it (since the furrow is an unintended by product of his moving the item).

R. Ba quoting Rav Chinah/ R. Chaggai quoting R. Zeira/ R. Yosa quoting R. Ila: The Chachamim agree with R. Shimon in the case of a chair - since its legs press down into the ground, that it is permitted to transfer it.

ודכוותה מותר להחזירו

(e)

In the same way, it is permitted to return it.

(f)

Support (R. Yosa): We also learned in a Mishnah (in Maseches Kilayim) that it is permitted to move it on Shabbos (when a person hid a turnip or radish in the earth and part of the leaves are exposed, since he does not intend to move it).

R. Yosa bei R. Bun: The author there is R. Shimon, (not Rabbanan, so there is no support for R. Ila).

R. Yosa: Our Mishnah teaches this - No utensils may be dragged over earth except for a wagon, as it does not make a furrow.
