BEITZAH 21 (20 Nisan) - Dedicated by Mr. Martin Fogel of Carlsbad, California, in memory of his father, Yaakov ben Shlomo Fogel, on the day of his nineteenth Yahrzeit.

1)

COOKING AND BURNING ON YOM TOV (Yerushalmi Halachah 5 Daf 11b)

משנה ב''ש אומרים לא יחם אדם חמין לרגליו אלא א''כ היו ראויין לשתייה ובית הלל מתירין

(a)

(Mishnah): Beis Shamai say - A person may not heat up water to wash his feet unless the water is drinkable. Beis Hillel permit it.

ועושה מדורה ומתחמם כנגדה

(b)

(All agree that) a person may make a bonfire and warm himself near it.

גמרא פתר לה תרין פתרין על דעתין דב''ש והוא ששתה מהן

(c)

(Gemara): There are two explanations of the Mishnah -

1.

According to Beis Shamai, he needs to actually drink the water.

על דעתין דב''ה והן שיהו ראויין לשתייה

2.

According to Beis Hillel, it must merely be drinkable.

ועושה מדורה ומתחמם כנגדה

(d)

The Mishnah had taught: (All agree that) a person may make a bonfire and warm himself near it.

דברי הכל והוא שיהא קומקום כנגד המדורה

(e)

All agree that he must have a kettle positioned near the bonfire (so that the fire is considered to have been made for the purpose of heating that water to drink).

[דף כד עמוד ב (עוז והדר)] פתר לה פתר אוחרן על דעתהון דבית שמאי והוא שיהא קומקום כנגד המדורה על דעתון דבית הלל אפילו אין הקומקום כנגד המדורה

(f)

There is another explanation - According to Beis Shamai, he must have a kettle positioned near the bonfire. According to Beis Hillel, it is permitted even without a kettle.

חמין שהוחמו בי''ט וכן חמים שהוחמו מערב שבת לשבת רב ושמואל

(g)

Water that was heated on Yom Tov or water that was heated on Erev Shabbos for Shabbos - it is a dispute between Rav and Shmuel -

חד אמר מרחיץ בהן פניו ידיו ורגליו וחורנה אמר מרחיץ בהן גופו איברים איברים

One says that he may wash with it his face, his hands and his feet. The other one says that he may wash his body limb by limb.

ולא ידעין מאן אמר דא ומאן אמר דא

But we do not know who said each statement.

מן מה דתני שמואל מרחיץ בהם פניו ידיו ורגליו הוי רב דו אמר מרחיץ בהן גופו איברים איברים

(h)

From the fact that Shmuel taught that a person may wash his face, his hands and his face with them, this shows that Rav says that a person may wash his body limb by limb.

חד פיליסופיס שאל לבר קפרא אבלט שאל ללוי סריסא מותר לשתות ואסור לרחוץ

(i)

A philosopher asked Bar Kafra/Abalet asked Levi Serisa - why is it permitted to drink water heated on Yom Tov but prohibited to wash with it?

א''ל אם תראה סריס מתחבק עם אשתך שמא אינו רע לך

Bar Kafra/Levi: If you would see a sterile man hugging your wife, would it anger you?

א''ל אין

2.

Philosopher/Abalet: Yes.

א''ל ומכי הוא (לך)[לה] כלום

3.

Bar Kafra/Levi: But does he lessen your wife in your eyes? (If she is adulterous with him, a child will not be born of it!)

א''ל שלא תתפרץ

4.

Philosopher/Abalet: She should not behave immodestly.

א''ל והכא שלא יתפרצו

5.

Bar Kafra/Levi: Here also, they prohibited using it for washing lest people become used to heating up without any reason. (This does not apply to water for drinking as it is only done in small quantities.)

כיון שיצא אמרו לו תלמידיו ר' לזה דחיתה בקנה לנו מה את משיב

When he left, the students said to him (Bar Kafra/Levi) - Rebbi, you pushed him away with a stick, but what do answer us?

אמר להן והלא כבר נאמר אך אשר יאכל לכל נפש הוא לבדו יעשה לכם

He said to them: The Pasuk states (Shemos 12, 16), "...except you may make for yourselves that which every person eats''. (One may therefore only heat water for drinking but not for washing.)

2)

THREE CASES WHEN RABBAN GAMLIEL IS STRINGENT (Yerushalmi Halachah 6 Daf 11b)

משנה שלשה דברים רבן גמליאל מחמיר כדברי בית שמאי

(a)

(Mishnah): There are three cases where Rabban Gamliel is stringent like Beis Shamai -

אין טומנין את החמין מיום טוב לשבת ואין זוקפין את המנורה ביום טוב ואין אופין פיתן [דף יב עמוד א] גריצות אלא רקיקין

1.

One may not insulate hot water on Yom Tov for Shabbos;

2.

One may not reassemble a metal candelabra that fell (as it involves the Melacha of construction);

3.

One may only bake thin loaves not thick loaves on Yom Tov.

אמר רבן גמליאל מימיהן של בית אבא לא היו אופין פיתן גריצות אלא רקיקין

(b)

Rabban Gamliel: In my father's house, they only baked thin loaves, not thick ones.

אמרו לו מה נעשה לבית אביך שהיו מחמירין על עצמן ומקילין על כל ישראל להיות אופין פיתן גריצות וחרי

(c)

They replied: What can be done with your father's house - they were stringent for themselves and lenient for all of Israel to bake thick loaves and Chari (see below).

[דף כה עמוד א (עוז והדר)] גמרא אבא בר רב חונה אמר הדא דתימר בשלא עשה לו עירובי תבשילין אבל אם עשה לו עירובי תבשילין מותר

(d)

(Gemara - Aba bar Rav Chuna) - This (dispute over insulating on Yom Tov for Shabbos) applies when there was no Eiruv Tavshilin made, but if it was made, all agree that it is permitted.

מה בין תבשיל ומה בין חמין

(e)

Question: What is the difference between hot water and a hot food? (The Mishnah implies that even Beis Shamai permit insulating a hot food.)

תבשיל דרכו לוכל ממנו חמין אין דרכו לשתות מהן

(f)

Answer: It is normal to eat from a hot food (on Erev Shabbos, so it is as if he has cooked it for Yom Tov); it is not normal to drink from the hot water (on Erev Shabbos).

ואין זוקפין את המנורה בי''ט

(g)

The Mishnah had taught: On Yom Tov, one may not reassemble a (metal) candelabra that fell.

הדא דאת אמר במנורה של פרקים אבל במנורה שאינה של פרקים לא בדא

(h)

This refers to a candelabra made of pieces; but one may stand up a fallen candelabra made of one piece.

כהדא תלמידוי דר' יוסי הוון יתיבין נפלת מנרתא קומיהון והוה כל חד וחד שמיט גרמיה וערק

(i)

The students of R. Yosi were also stringent like Rabban Gamliel - they were once sitting and a candelabra of parts fell down in front of them. Each student excused himself and left (as they did not want to rule whether it was permitted to reassemble the candelabra).

אין אופין פיתן גריצות אלא רקיקין

(j)

The Mishnah had taught: One may only bake thin loaves not thick loaves on Yom Tov.

מתוך שאת מייגעו אף הוא אינו אופה אלא צורכו

(k)

Reasoning: Since you are troubling him to make only thin loaves (which are hard to prepare), he will refrain from baking on Yom Tov for the weekday that follows and only bake that which is essential for Yom Tov.

ר' אחא שמע לה מן הדא (דברים כט) מה חרי האף הגדול הזה

(l)

R. Acha learned the meaning of Chari from the following Pasuk (Devarim 29, 23), "What is this great anger'' (so the bread is 'great' i.e. large).

ורבנן שמעין לה מן הדא (בראשית מ) והנה שלשה סלי חורי על ראשי

(m)

Rabbanan learned it from the following Pasuk (Bereishis 40, 16), "And behold, there were three baskets of Chari on my head''. (This shows that Chari must be good quality bread.)
