WRITING OVER HIS ESTATE TO OUTSIDERS (Yerushalmi Halachah 6 Daf 24b)

משנה הכותב נכסיו לאחרים והניח את בניו מה שעשה עשוי אבל אין רוח חכמים נוחה הימנו

(a)

(Mishnah): If a person wrote over all of his property to others without leaving for his sons, it takes effect but the Chachamim are displeased with him.

רבן שמעון בן גמליאל אומר אם לא היו בניו נוהגין כשורה זכור לטוב

(b)

Rabban Shimon ben Gamliel: If his sons were not acting properly, it is praiseworthy.

גמרא א"ר בא בר ממל הכותב נכסיו לאחרים והניח את בניו עליו הוא אומ' ותהי עוונותם על עצמותם.

(c)

(Gemara) - R. Ba bar Mamal: One who writes over his property to others thereby abandoning his sons, the pasuk says about him (Yechezkel 32:27), "and their sins were upon themselves".

כהדא חד בר נש אפקד ניכסיי גבי ר' בא בר ממל

(d)

It is like the case of a person who deposited possessions with R. Ba bar Mamal.

א"ל אין הויין בנוי דהנייה הב לון פלגא וסב פלגא אתון בנוי ונסבין פלגא.

He said to R. Ba - if my children are behaving well, give them half and the elderly sage (R. Ba) should keep half. The children came and R. Ba gave them half.

בתר יומין אתון בעיין מיעור עימיה אמר לון לא אמר לי אבוכון אלא אי הוין בניי דהנייה הב לון פלגא וסב פלגא. כדון אתון קקו פדיפטי הבו לי מה דיהבית לכון

Later on, the children came, claiming that they should have also received the other half. R. Ba said to them - Didn't your father tell me that you only receive the first half if you are behaving well. But now, you are acting like sinners, so you must give back the money!
