PARABLES FOR THE LAW OF R. YONASAN (Yerushalmi Halachah 2 Daf 22b)

(a)

Rebbi gave a parable (for the law of R. Yonasan above in 118-b, that the dead inherit) - two brothers, who were partners, went to Mizrayim, one with 9 sons and one with one son, and the sons inherited from their fathers an area of 5 Beis Kur; each son should take a Letech (half a Kur).

1.

However, since the law is that it is returned to their fathers and then divided, we find that the son of one brother takes half and the nine sons of the other brother take half.

(b)

Rav Dustai ben Yehuda (also) gave a parable (to this) - two brothers, who were Kohanim and had agreed to divide equally any Terumah that they received in the threshing floor; one had 9 sons and one had one son. If they received 10 Kav of (Terumah), each son should receive one Kav. However, the law is that it is returned to their fathers and then divided, so ultimately, the son of one brother receives half and the other half is divided equally amongst the nine sons of the other brother.
