THE QUALITY OF WINE THAT MUST BE SUPPLIED (Yerushalmi Halachah 1 Daf 18b)

תני [דף יט עמוד א] מאה חביות אני מוכר לך חייב להעמיד לו יין יפה כרוב היין הנמכר באותו מקום

(a)

Tosefta: If a person said, "I am selling you 10 barrels", he must supply the buyer with the same quality wine as most wine sold in that place.

מאה חביות יין [אלו] אני מוכר לך חייב להעמיד לו יין יפה כרוב היין הנמכר באותו חנות

(b)

If he said, "I am selling to you 100 barrels of this wine", he must supply the buyer with the same quality wine as most wine sold in his store. (Note: The text is added by the Pnei Moshe and others from the Tosefta in Chapter 6.)

מאה חביות אילו אני מוכר לך אפילו חומץ הגיעו.

If he said, "I am selling you these barrels", even if they contain vinegar, the sale goes through.

רבי חייה בר ווה בשהיו הקנקנים ללוקח יכיל מימר ליה לשתייה מכרתיו לך.

R. Chiya bar Vava: (The Mishnah taught (see above Dapim 90-92 1. (g)) that if a person sold wine and it soured, the seller is not responsible.) The case is when the jugs belong to the buyer, as the seller can say, "I sold it to you to drink (not to store away in your jugs)".
