SELLING A FIELD (Yerushalmi Halachah 8 Daf 14b)

משנה המוכר את השדה מכר את האבנים שהן לצורכה ואת הקנים שבכרם שהן לצורכו ואת התבואה שהיא מחוברת לקרקע ואת מחיצת הקנים שהיא פחותה מבית רובע ואת השומירה שאינה עשויה בטיט ואת החרוב שאינו מורכב ואת בתולת השקמה

(a)

(Mishnah): If a person sold a field, the sale includes the stones needed for the field, the canes needed for a vineyard, the produce still attached to the ground, the thicket of reeds if the field is less than a Beis Rova area, the non-mud guardhouse, the carob tree that has not been grafted (as it is young enough to be considered secondary the field - grafting is usually done only to older carob trees.) and the young sycamore (that has not been pruned).

אבל לא מכר לא את האבנים שאינן לצורכה ולא את הקנים שבכרם שאינן לצורכו ולא את התבואה שהיא תלושה מן הקרקע

But it does not include the stones that are not needed for the field, the canes not needed for the vineyard and the produce that is detached from the ground.

בזמן שאמר לו היא וכל מה שבתוכה הרי כולן מכורין

When he said, "it and everything in it", everything is included.

בין כך ובין כך לא מכר לא את מחיצת הקנים שהיא בית רובע ולא את השומירה העשויה בטיט ולא את החרוב המורכב ולא את סדן השקמה לא את הבור ולא את הגת ולא את השובך בין חריבין בין שלימין

(b)

Whether or not he said this, the sale does not include the thicket of reeds if the field is a Beis Rova area, the mud guardhouse, the (young) carob tree that has been grafted, the older (meaning broad trunked) sycamore, the pit, the olive press, the dovecote, whether they are out of use or in use.

וצריך ליקח לו דרך דברי רבי עקיבה

(c)

R. Akiva: The seller must buy for himself (back from the buyer) a path to access his pit/press/dovecote.

וחכמים אומרים אינו צריך ליקח לו דרך

(d)

Chachamim: He does not need to buy it.

ומודה ר' עקיבה בזמן שאמר לו חוץ מאילו שאינו צריך ליקח לו דרך

R. Akiva agrees that when he actually said, "(I am selling the field) except for these (pit/press/dovecote)", he does not need to buy it.

מכרן לאחר ר' עקיבה אומר אינו צריך ליקח לו דרך

(f)

R. Akiva: If he sold only them (pit/press/dovecote, rather than the field), the buyer does not need to buy a path (since R. Akiva holds that he sells with a generous eye.)

וחכמים אומרים צריך ליקח לו דרך

(g)

Chachamim: He needs to buy a path (as a person sells with a stingy eye and therefore did not include a path in the sale of the pit/press/dovecote.)

במה דברים אמורים במוכר אבל בנותן מתנה נותן את כולן

(h)

When is this? When he sells it, but when he gives it as a gift, he gives everything (as he certainly gives gifts with a generous eye).

האחין שחלקו זכו בשדה זכו בכולן המחזיק בניכסי הגר החזיק בשדה החזיק בכולן

(i)

If brothers divided their father's estate, when they acquire their land in the courtyard, they also acquire all of the things listed (above). If a person took possession of the property of a convert (who died without inheritors), when he acquires the land, he acquires everything.

המקדיש את השדה הקדיש את כולן

(j)

If a person consecrated his field, he consecrated all of them.

ר' שמעון אומר המקדיש את השדה לא הקדיש אלא החרוב המורכב ואת סדן השקמה:

R. Shimon: If a person consecrated a field, (of all these things) he consecrated only the older carob and sycamore trees.

גמרא דבית רבי ינאי אמרי במחולקין לגפנים.

(Gemara) - D'Beis R. Yanai: (The Mishnah taught that if a person sells a field it includes the canes needed for a vineyard) This refers to canes set aside to leave under the grapevine on which to lean the vine branches.

Question (R. Chiya the Great): (If a person sells a pit) if the seller ordered large stones to use to build a wall around it, are they included in the sale?

רבי יצחק בר טבליי שאל היו שם טבליות של שיש מחולקות לכתלין

R. Yitzchak bar Tavlai: (If a person sells a house) if the seller ordered panels of marble to coat the walls, are they included in the sale?

רב יודן בר רבי ישמעאל שאל היו שם מלבנין מחולקו' לחלונות.

(o)

R. Yudan bar R. Yishmael: If the seller ordered frames for the windows, are they included in the sale? (Note: These last three questions remain unanswered.)
