FENCING OR BREACHING (Yerushalmi Halachah 5 Daf 10b)

רב אמר בפוחת מעשרה או מוסיף על עשרה.

(a)

(The Mishnah taught that if he closed the gate, fenced it in or breached the fence in any way, it is a chazakah.) Rav said - The Mishnah refers to if the breach was more than ten tefachim and he partially closed it up (thereby preventing people from coming comfortably through it); or if the breach was small and he expanded it to more than ten (thereby allowing people to comfortably come through it).

שמואל אמר אפילו פרץ מקום שאינו ראוי לפרוץ וגדר מקום שאינו ראוי לגדור הרי זה חזקה

(b)

Shmuel: Even if he breached in a way that was not beneficial or fenced in a way was not beneficial, it is a chazakah.

והתני המוכר לחבירו ונתעצל לוקח ולא החזיק בה וירד המוכר והחזיק בה [דף יא עמוד א] ביטלה חזקה את המכר ואת המתנה:

Support - Beraisa: A buyer (or receiver) does not acquire unless he made a chazakah on it; so if the seller or giver instead made a chazakah (in one of the above ways) the sale or gift is annulled.
