BAVA BASRA 2-8 - Two weeks of study material have been dedicated by Mrs. Estanne Abraham Fawer to honor the Yahrzeit of her father, Rav Mordechai ben Eliezer Zvi (Rabbi Morton Weiner) Z'L, who passed away on 18 Teves 5760. May the merit of supporting and advancing Dafyomi study -- which was so important to Rav Weiner -- during the weeks of his Yahrzeit serve as an Iluy for his Neshamah.

ADJACENT GARDENS AND FIELDS (Yerushalmi Halachah 2 Daf 1b)

משנה וכן בגינה מקום שנהגו לגדור יגדור

(a)

(Mishnah): This also applies to gardens - if the custom is to put up a fence, one can force the other to do so.

אבל בבקעה מקום שנהגו שלא לגדור אין מחייבין אותו אלא אם רצה כונס לתוך שלו ועושה חזית מבחוץ לפיכך אם נפל הכותל המקום והאבנים שלו

However, in a crop field, if the custom is not to build, we cannot force the other party to agree to build. But if one party wishes to build, he must build the wall entirely in his own half and he makes a sign on the outer side, on the top of the wall (to indicate that it is entirely built in his domain), so that if the wall falls down, he will receive the space and the stones.

ואם עשו מדעת שניהם בונים את הכותל באמצע ועושים חזית מיכן ומיכן לפיכך אם נפל הכותל המקום והאבנים של שניהם

If they both willingly built it, they build it in the middle and make a sign on both sides. Therefore, if the wall falls down, they share the space and the stones.

גמרא תני בגינה בין מקום שנהגו לגדור בין מקום שנהגו שלא לגדור כופין

(d)

(Gemara) - Beraisa: In a garden, whether the custom is to build a wall or not, one can force the other to build.

אבל בבקעה מקום שנהגו לגדור כופין שלא לגדור אין כופין

(e)

But in a crop field, one can force the other only if the custom there is to build.
