Implied question: Here [Rav Papa] establishes this according to everyone, both according to the opinion that [Shibud is] mid'Oraisa, and according to the opinion that it is not mid'Oraisa.

ובפרק קמא דקדושין (דף יג: ושם) אמרינן גובה מן היורשים שעבודא דאורייתא ואינו גובה [מן הלקוחות כו']

And in Kidushin (13b) he says that one collects [a Milveh Al Peh] from heirs, for Shibud is mid'Oraisa, and he does not collect from buyers...!

Answer #1: Rav Papa said only that one collects a Milveh Al Peh from heirs, and not from buyers. Here the Gemara explains it according to the opinion that Shibud is not mid'Oraisa; (Maharsha - above, Tosfos said that here it is explained according to both opinions! This is fine according to Tosfos Kidushin 13a DH Amar, whose text here says that Shibud is not mid'Oraisa.)

והתם למאן דאמר שעבודא דאורייתא והוי כמו איכא דאמרי מילתא דהכא ודהתם

There, the Gemara explains it according to the opinion that Shibud is mid'Oraisa. It is like two versions, one here and one there.

Support: We find like this in Bava Metzi'a (112a). They asked Rav Sheshes whether or not one transgresses Bal Talin for a Kablan (if he does not pay that day). Does a craftsman acquire improvements that he makes to a Kli, or not?

ובהגוזל קמא (ב''ק דף צט.) משמע שלא שאלו ממנו אם אומן קונה בשבח כלי או לא

In Bava Kama (99a) it connotes that they did not ask him whether or not a craftsman acquires improvements to a Kli.

Explanation: The text does not say "from the time of Kesuvah", like Rashi explained, for it connotes that Edei Chasimah Karsei in a Kesuvah according to R. Elazar, and this is not true;

דהא אפילו אין בכתובה עצמה אלא עדי מסירה כשר כדאמרינן דאמר ר''א בין בגיטין בין בשטרות

Even if the Kesuvah itself has only Edei Mesirah it is Kosher, like we say that R. Elazar said [that Edei Mesirah Karsei] both for Gitin and [monetary] documents;

וקיימא לן כוותיה בין בגיטין בין בשטרות מההיא דזה בורר (סנהדרין דף כח: ושם)

And we hold like him both regarding Gitin and documents, from the case in Sanhedrin 28b. (Two Gisim, i.e. men who married two sisters, signed on a gift document. Rav Yosef suggested giving it in front of Edei Mesirah, according to R. Elazar. This was rejected only because R. Elazar admits that if invalid witnesses signed, it is invalid.)

He establishes himself like R. Yishmael, for R. Yishmael argues with [Ben Nanas] only because he holds that an Arev after the money was given becomes obligated, like it says "the Halachah follows [R. Yishmael] even regarding choking."
