TOSFOS DH ul'Taimeich Zavin Shavi Chamsha b'Shisa

(SUMMARY: Tosfos discusses why such an adult's sale is valid.)

(a)

Implied question: Also adults, their sale is not a sale in such a case (of Ona'ah, i.e. overcharging)! It is Bitul Mekach [according to Rav], or he returns the Ona'ah [according to Shmuel]! (We explain according to Maharsha.)

(b)

Answer #1: [What is worth] five for six is not precise.

(c)

Answer #2: It is precise. This is fine, according to what R. Tam explained that Ona'ah does not apply to land.

(d)

Answer #3: The case is, he explicitly said "I know that it is not worth so much." (Ona'ah is only when he deceives about the value.)

(e)

Answer #4: [The Halachah follows Shmuel, who says that] the sale is not totally Batel, since [the Ona'ah] is not more than a sixth.

2)

TOSFOS DH Bodkin l'Kidushin ul'Geirushin

(SUMMARY: Tosfos gives another consequence of checking.)

(a)

Explanation: This checking is after he reached [the required number of] years, but before the years, hairs are mere Shuma, like we say in Nidah (48b);

(b)

Consequence: This checking helps also for if she [later] accepted Kidushin money from another man. If we find Simanim after [the first Kidushin], the latter Kidushin is invalid;

1.

If we do not find Simanim, it is a Safek, for we are concerned lest [the hairs] fell out regarding a Safek Torah law like here, like it says in Nidah.

(c)

Implied question: If she accepted Kidushin money from someone else, we are concerned for both acts of Kidushin, like Shmuel, who said in Kidushin (79b) that if her father was Mekadesh her on the road, and she was Mekadesh herself in the city, we are concerned for both acts of Kidushin!

(d)

Answer: There, he says so only on the day that completes six months [after becoming a Na'arah. She [surely] became a Bogeres some time during the day;

1.

However, here that she reached [years proper for] adulthood a long time ago, [Shmuel] would not say so.

3)

TOSFOS DH ul'Geirushin

(SUMMARY: Tosfos resolves this with the Gemara in Nidah.)

(a)

Explanation: If hairs are not found, it is not a divorce. We do not rely on the Chazakah [that one brings Simanim immediately upon reaching tithe] to be lenient. The same applies to Chalitzah and Mi'un.

(b)

Implied question: Regarding Mi'un, we say in Nidah (48b) that a Ketanah who reached her years need not be checked, for there is a Chazakah that she brought Simanim!

(c)

Answer: That is when we did not check. However, when we checked and did not find, she can do Mi'un, and we are not concerned lest [hairs] fell out, since there was no Bi'ah [from when she reached her years], like we say in Nidah (52a).

(d)

Pesak: However, nowadays we are not experts about recognizing pores (so we cannot rely on checking to show that she is a minor).

4)

TOSFOS DH v'Chi me'Acher d'Vadaknuha l'Kidushin l'Geirushin Lamah Li v'Chulei

(SUMMARY: Tosfos questions the question.)

(a)

Question #1: What was the question? Is it a Chiyuv to check for Kidushin? (Above (DH Bodkin), Tosfos connotes that we must check only when a second man is Mekadesh her.) However, for divorce he must check if he is an adult to divorce!

(b)

Question #2: [If the Makshan asks that in any case, we need not check for divorce, why did he mention checking for Kidushin? He] should have asked as follows. For what law do we check for divorce? In any case she is divorced!

1.

If he was a minor at the time of Kidushin, even divorce is not needed. If he was an adult [at the time of Kidushin, also] now at the time of divorce he is an adult!

(c)

Suggestion: If it was a Safek (we did not check for Kidushin, we would rely on Chezkas Penuyah and say that she is still single! Therefore, we must check for Kidushin.)

1.

Note: We explain according to Nimukei ha'Griv. Others delete these words, or say that the end of this Tosfos belongs elsewhere.

(d)

Rejection: (We would not rely on Chazakah.) We are stringent about a Safek Torah law. [We find that] we are concerned lest [hairs] fell out, like we say in Nidah (52a)!

(e)

Poor answer: We [must] check for Kidushin, i.e. if hairs were not found, she is [Vadai] not Mekudeshes, and we are not concerned lest they fell out.

(f)

Rebuttal: If so, the Halachah does not follow this teaching of [Rav Nachman in the name of] Shmuel!

5)

TOSFOS DH l'Chalitzah Le'afukei mid'R. Yosi

(SUMMARY: Tosfos explains why we do not establish Rav Nachman even like R. Yosi.)

(a)

Question: We should say that [Rav Nachman] discusses a man! There, even R. Yosi agrees (that only an adult Yavam can do Chalitzah)!

(b)

Answer: [Rav Nachman] connotes that he discusses both a man and a woman, similar to Gitin and Kidushin, which discuss both a man and a woman.

6)

TOSFOS DH Le'afukei mid'R. Yehudah

(SUMMARY: Tosfos explains why we establish Rav Nachman unlike R. Yehudah.)

(a)

Question: What is the source that he comes to teach unlike R. Yehudah? Perhaps he discusses the checking of R. Yehudah (if the black exceeds the white)!

(b)

Answer: It is like the checking above, which is for two hairs.

(c)

Question: This requires investigation, whether or not R. Yehudah said his law only for Mi'un.

7)

TOSFOS DH Ad she'Yarbeh Shachor Al ha'Lavan

(SUMMARY: Tosfos defends this text.)

(a)

Version #1 (Rashbam): The text [says only "there is much black." It] does not say "more than white."

(b)

Version #2 (Ri): The text properly says "more than white", i.e. there is [seen] more black (hairs) than flesh, which is white;

1.

Since [R. Yehudah] mentioned black regarding hair, he refers to flesh as "white".

8)

TOSFOS DH R. Eliezer Omer Echad Bari v'Echad Mesukan v'Chulei

(SUMMARY: Tosfos proves that the text should say R. Elazar.)

(a)

Alternative text: R. Tam's text says R. Elazar and not R. Eliezer; this is R. Elazar ben Shamu'a.

(b)

Source #1: If the text were R. Eliezer, this would be difficult, since [the Mishnah] below (156b) teaches after this clause the argument of R. Eliezer and R. Yehoshua about Kinyan of a Shechiv Mera in a separate clause;

1.

If the text were R. Eliezer in both of them, they should be taught together! One who orally apportions his property - R. Eliezer says, whether he is healthy... [a Kinyan is needed]. This refers to a weekday, but on Shabbos, his words are fulfilled. R. Yehoshua says...

2.

Rather, since they were divided into two clauses, this teaches that the first [Tana] is R. Elazar ben Shamu'a.

(c)

Source #2: In the Gemara, R. Levi says "we acquire from a Shechiv Mera, and even on Shabbos, and there is no concern for R. Elazar's words;

1.

If the text were R. Eliezer, he holds below that on Shabbos, his words are fulfilled without a Kinyan!

(d)

Source #3: How do we understand what [Chachamim challenged him] "an episode occurred with Bnei Rochel...'? He could say to them that it was on Shabbos! Until here is from R. Tam.

156b----------------------------------------156b

(e)

Question (Ri): It says in Gitin (14b) regarding "take 100 Zuz to Ploni...", and we establish it there to discuss a Shechiv Mera, and R. Yehudah ha'Nasi said in the name of R. Yakov, who said in the name of R. Meir like R. Eliezer, that a Kinyan is needed;

1.

If the text says here R. Eliezer, R. Meir holds in the Gemara that R. Eliezer holds that on a weekday his words are fulfilled, and he does not need a Kinyan!

2.

There we discuss on a weekday, since it said "take 100 Zuz to Ploni...", which connotes that it is on a weekday!

(f)

Conclusion: This shows that the text says R. Elazar, and he holds that both on Shabbos and on a weekday, he needs a Kinyan;

1.

He argues with R. Eliezer and R. Yehoshua below. The text says "there is no concern for R. Elazar's words."

(g)

Remark: Also in Kidushin (26b) regarding the question of Tziburin (if Kinyan Agav requires that the Metaltelim rest on the land acquired), and below regarding one who is Mekayem thorns in a vineyard, the text says R. Elazar, and also in Shabbos (144b), where it brings the case of being Mekayem thorns in a vineyard.

(h)

Question (Rivam): A Tosefta (10:12) teaches that a Shechiv Mera who apportioned his property orally, whether on Shabbos or during the week, we fulfill a Mes' words, but not a Bari's words, unless they acquired through Kesef, a document or Chazakah;

1.

R. Eliezer says, property with Achrayus (responsibility to compensate the buyer if a creditor takes it, i.e. land) is acquired through Kesef, a document or Chazakah. Property without Achrayus (i.e. Metaltelim) is acquired only through Meshichah;

2.

R. Eliezer says, an episode occurred in which a man from Meron was in Yerushalayim, and he had much Metaltelim [that he wanted to give... He was Makneh Agav land.]

3.

What is the case? This refers to a weekday, but on Shabbos one may not do so. If he did, he did (it takes effect). R. Yehoshua says, this was said for a weekday, and all the more so on Shabbos. R. Meir says [that they argue like this];

4.

R. Yehudah says, R. Eliezer says, what is the case? This is on Shabbos, but on a weekday one may not do so. If he did, he did. R. Yehoshua says, this was said for Shabbos, and all the more so on a weekday.

5.

Inference: R. Eliezer taught all of this (including the Reisha, which is like our Mishnah)!

(i)

Answer (Ri): This is not difficult at all. "What is the case?" in the Tosefta refers to our Mishnah here, and not to the Reisha of R. Eliezer in the Tosefta;

1.

Rather, he discusses Rabanan, who say that no Kinyan is needed. He means as follows. If he did, he did, and we do not say that there is no Kinyan after death. (Maharshal, according to Rashash - this is according to R. Yehudah. According to R. Meir, this is forbidden on Shabbos, for it looks like business.)

i.

Since he can do only through a Kinyan, all agree that this Kinyan helps after death. It is as if he specified "from today, if I will not retract, [and it takes effect] after death."

ii.

He means as follows. He may not do without a Kinyan. If he did through a Kinyan, what he did he did, and also l'Chatchilah he can do through a Kinyan.

9)

TOSFOS DH Kevinasi l'Biti

(SUMMARY: Tosfos explains this unlike the Rashbam.)

(a)

Explanation #1 (Rashbam): This is Nushka (a metal clasp), which is she uses to close [her garment on] her neck.

(b)

Rebuttal #1 (Ri): It says in Shabbos (62a) that a woman may not go out with Kuliyar. The Gemara says what is Kuliyar? Rav said, it is Mekavnesa, which is Kevinasi here. Rashi explained there that it is Nushka;

1.

Why is it forbidden to go out with it on Shabbos? It is made only to be worn. Also, there is no concern lest she take it off to show [her friends], for she would expose her skin.

2.

Also, in Yoma (25a), regarding Kohanim, a Beraisa teaches that they stand in Kuliyar, i.e. in a circle!

(c)

Explanation #2 (Ri): The Aruch explained that Kuliyar is like a crown. In any case it has something sharp, for it says in Shabbos (156b) that she took Mekavna and [stuck it in the wall, and] it went in the eye of a snake.

1.

You should not explain that Kevinasi here is Nushka, even if you will distinguish between Mekavnesa of Shabbos and Kevinasi here, for it says in Yeshayahu (3:20) "u'Vatei ha'Nefesh veha'Lechashim", and Rashi explained there that Batei ha'Nefesh are Nushka, since it is put opposite where the Nefesh is (the heart);

i.

It is written there also "veha'Redidim" (3:23; the verses discuss matters that Hash-m will remove from Yisrael. Surely this is not the same as Batei ha'Nefesh written above), and the Targum is Kevinasi!

(d)

Rebuttal #2 (and Explanation #3): Also, a Mishnah in Kelim (29:1) teaches "ha'Sagus veha'Redid", and the Aruch explained that this is Redidim (of the verse, for which the Targum is Kevinasi), and it is called in Arabic Rida. It is a thin kerchief with which a woman covers her head;

1.

Note: This is another proof that Kevinasi is not Nushka. It seems that the Aruch indeed distinguishes Kevinasi from Mekavnesa.

2.

The Targum Yerushalmi of "va'Techas ba'Tza'if va'Tis'alaf" is Redida.

10)

TOSFOS DH Konim mi'Shechiv Mera v'Afilu b'Shabbos

(SUMMARY: Tosfos discusses what Chachamim permitted for a Shechiv Mera.)

(a)

Observation: Regarding one who commands due to [fear of] death, or one who writes all his property to others, this is fine. [Enacting to avoid] frenzy applies there, for even though the Kinyan does nothing, even so he is pained [if he cannot do a Kinyan].

(b)

Assertion: The same applies to one who writes some [of his property]. Even though he expects to live, for he cannot retract and he left [some property] for himself, even so [enacting to avoid] frenzy applies, like the Rashbam explained.

(c)

Assertion: Even on Shabbos he may be Makneh, like it says in Gitin (77b) that a certain Shechiv Mera wrote a Get to his wife. The next day (Shabbos) he became close to death. Rava said "is there a place where the Get rests [that he can be Makneh to her]? She should go and close and open [and acquire the place of the Get, and be divorced]!"

1.

Question: How could she acquire [the place]? One may not be Makneh Reshus on Shabbos!

2.

Answer: This shows that [Chachamim] were lenient about a Shechiv Mera. If so, it is permitted to be Makneh also here!

(d)

Proof: Surely they were lenient about a Shechiv Mera, for you can ask how could he divorce on Shabbos? A Tosefta in Beitzah teaches that we do not divorce on Shabbos! Rather, they were lenient about a Shechiv Mera.

11)

TOSFOS DH Zachin l'Gadol v'Ein Zachin l'Katan

(SUMMARY: Tosfos explains the reasons for the two opinions.)

(a)

Question: Why can't one be Zocheh for a minor? Zachin l'Adam she'Lo Befanav (one can be Zocheh for someone in his absence)!

(b)

Answer: Since Zechiyah is due to Shelichus, one who can make a Shali'ach, he has Zechiyah (others can be Zocheh for him). One who cannot make a Shali'ach, he does not have Zechiyah;

1.

The one who holds that one can be Zocheh for a minor, but not for an adult, he holds that since an adult can acquire, Rabanan did not enact Zechiyah for him, like [they did] for a minor.
