Weak defense (of our text): With difficulty, we can say that [the recipient is Yotzei] only when the giver has an Esrog other than the one that the recipient took, and [the giver] is not adamant if the recipient eats the Esrog;

אבל אי לית ליה לנותן אלא פריש או רמון לא יצא דמסתמא יקפיד אם יאכל הלה את האתרוג ודוחק

However, if the giver has only a quince or pomegranate, he was not Yotzei, for presumably, the giver is adamant if the recipient eats the Esrog. This is difficult.

Question: Why wasn't he Yotzei, even if he doubled the Tenai? The Tenai and the action (about which he stipulates) apply to the same matter (and they contradict each other). This is unlike the Tenai of Bnei Gad and Bnei Reuven!

כדאמרינן במי שאחזו (גיטין דף עה. ושם) ה''ז גיטך והנייר שלי אינה מגורשת על מנת שהנייר שלי מגורשת ופריך מאי שנא רישא ומאי שנא סיפא

This is like we say in Gitin (75a) that [if a husband said] "this is your Get, and the paper belongs to me", she is not divorced. [If he said] "Al Menas (on condition) that the paper belongs to me", she is divorced. [The Gemara] asks what is the difference between the Reisha and Seifa?

אמר רבא משום דהוי מעשה קודם לתנאי ולכך התנאי בטל ומגורשת

Rava said that it is because [in the Seifa] the action (this is your Get) precedes the Tenai. Therefore, the Tana is Batel, and she is divorced.

ופריך רב אדא בר אהבה טעמא דהוי מעשה קודם לתנאי הא לאו הכי לא מכדי כל תנאי גמרינן מתנאי בני גד ובני ראובן מה התם לא הוי תנאי ומעשה בדבר אחד כו'
