Question: Rav Papa said in the name of Rava that a Bechor does not have before division. How can he come to take Bechorah through the rights of the other [Safek Bechor]?

Question: Because [the father] is believed to say who is the Bechor, is he believed to disqualify, and say that [this son] is from a divorcee or Chalutzah (i.e. if the father is a Kohen, the son is a Chalal)?!

ויש לומר כיון שנאמן לבכר בכל ענין האמינו הכתוב ואפילו על אחד מבניו הקטנים נאמן לומר שהוא בכור ואם כן עושה בניו הגדולים ממזרים שמאיש אחר הם

Answer #1: Since he is believed to say who is the Bechor, the Torah believed him in every case, and he is believed even to say about one of his small sons that he is the Bechor, and if so he makes [those who were Muchzak to be] his older children Mamzerim, for they are from a different father;

והכי נמי נאמן לומר שהוא בן גרושה

Similarly, he is believed to say that a son is from a divorcee.

Answer #2 (R. Eliyahu): "Yakir" refers also to "Ben ha'Senu'ah", i.e. he will identify who is the son of the hated wife, i.e. her marriage is despised (forbidden), like it explains in Yevamos (23a), e.g. Chayavei Lavim; a Kohen married a divorcee;

Disclaimer: "Just like he is believed to say" connotes that we learn from this that he is believed to identify the Bechor.

Pesak: Bahag rules that the ruling below (128b) like R. Yehudah, it is like R. Aba sent, i.e. only when he disqualifies through identifying the Bechor. However, the Halachah does not follow R. Yehudah that he is believed to say "this is a divorcee's son."

Rebuttal (Ri): It says in Yevamos (47a) that a man came in front of Rav Yehudah and said "I converted by myself." [Rav Yehudah] told him "you are believed to disqualify yourself (your conversion was invalid. You are still a Nochri), but you are not believed to disqualify your children";

ופריך והתניא ר' יהודה אומר יכיר ומשני אמר רב נחמן בר יצחק דהכי קאמר לדבריך כותי אתה ואין עדות לכותי ופסק התם הלכה כרב נחמן בר יצחק

[The Gemara] asks from the Beraisa in which R. Yehudah says "Yakir...", and Rav Nachman bar Yitzchak answers that [Rav Yehudah] means as follows. According to your words, you are a Nochri, and a Nochri cannot testify. The Gemara rules like Rav Nachman bar Yitzchak.

משמע דאי לאו דאין עדות לכותי היה נאמן לפסול אע''ג דליכא הכרת בכורה:

Inference: If not that a Nochri cannot testify, you would be believed to disqualify, even though there is no identification of the Bechor.
