1)

PROHIBITED STATUES (Yerushalmi Halachah 1 Daf 18a)

(a)

(Mishnah) (R. Meir): It is prohibited to derive benefit from any statue as there is a concern that it is worshipped (at least) once a year (rather than being there merely as an ornament).

(b)

(Chachamim): It is only prohibited if it is holding the image of a stick a bird or a ball; (otherwise, it can be assumed to be an ornament rather than for worship.)

(c)

(Rabban Shimon ben Gamliel): Whatever it is holding prohibits it.

(d)

(Gemara) (R. Chiya bar Ba): (R. Meir's reasoning is) because they are worshipped in the city of Rome twice in seven years.

(e)

Question: If so, only statues worshipped in Rome should be prohibited?

(f)

Answer (R. Yosi): Since that type is prohibited in one place, it is prohibited everywhere.

(g)

About what is the dispute between R. Meir and the Chachamim? If it is certainly a statue of kings that is built to be worshipped, all agree that it is prohibited; if it is certainly just a statue of that signifies the king's majesty and power, all agree that it is permitted; the case here is if its purpose is unclear - R. Meir assumes it to be for worship and Rabbanan assume it to be merely to show majesty and power.

(h)

(Ashayan Nagra citing R. Yochanan): Why are images made merely for decoration prohibited? Because the idolaters burn incense before them when they are set in place.

(i)

(R. Yochanan): It is permitted to look at them when they fall down. What is the source? (Tehillim 37:34), "and you will witness the destruction of the wicked".

(j)

(Tosefta in Maseches Shabbos): Captions underneath images or portraits on a wall may not be read on Shabbos. And even on a weekday, one may not look at an image that was made for idolatry. What is the source (for this second law)?

(k)

Answer (Beraisa in Sifra): The pasuk states (Vayikra 19:4), "You shall not turn to the idols" - do not turn to serve them; (meaning that a person transgresses as soon as he turns to them to begin serving them.)

1.

(R. Yehuda): (The pasuk is teaching) - Do not turn to look at them.

2)

THE DEATH OF THE RIGHTEOUS (Yerushalmi Halachah 1 Daf 18a)

(a)

When R. Nachum bar Simai (known as Nachum the Holy of Holies) passed away, when taking his body for burial, they covered all of the images on the walls with mats. They said that just as he was careful not to look an image of an idolater even on a coin, so he should not see them even in his death.

(b)

(R. Shimon ben Lakish): The only thing taken from Tzadikim at their death is their ability to speak (but they are still able to see and hear, so you must cover the images).

(c)

(R. Zeira): The dead person hears his praise (during the eulogies) as if it is in a dream (meaning, without complete clarity).

(d)

Why was he called Nachum the Holy of Holies? Because in all of his days, he never looked at the image on a coin. Why was Rabbi Yehuda Hanasi called 'our holy teacher'? Because in all of his days, he never looked at his Milah (place of circumcision).

1.

When R. Acha passed away, the stars became visible in the daytime. (It became dark, displaying the great suffering of the world.)

2.

When Rav Chanan passed away, all of the statues of kings (in his town) fell down.

3.

When R. Yochanan passed away, the statues (of beautiful people) fell down. They said that this alluded to the fact that there was no-one of more beautiful appearance in the world than R. Yochanan.

4.

When R. Chanina of Baras Chavran passed away, the waters of Lake Kinneret near Tiveria split. They said that (this was in remembrance of a miracle that happened) when he went up to Yerushalayim to join in the declaration of a leap year (that the Lake Kinneret split for him).

5.

When Rav Hoshiya passed away, a well-known date palm in Tiveria fell down.

6.

When R. Yitzchak ben Eliashiv passed away, the doorframes of 70 houses in the Galil fell down. They said that this indicated that it was in his merit that they had stood until then.

7.

When R. Shmuel bar Rav Yitzchak passed away, all of the cedar trees of the Land of Israel became uprooted. They said that this was a remembrance of the way he used to take a twig of a Hadas (a type of cedar) and dance with it in front the brides and the Rabbis would object, feeling that it disgraced the Torah that he embodied.

i.

(R. Zeira to the dissenting Rabbis): Allow him to continue. Does this elder not know what he is doing? (He is coming to teach us that this is appropriate.)

ii.

So when R. Shmuel bar Rav Yitzchak passed away, a fire came down from heaven, separating him from those accompanying him, and there were three hours of thunder and lightning. This showed everyone that he deserved all of this in the merit of his custom to gladden the brides. A Heavenly voice came out and said, "Alas, R. Shmuel bar Rav Yitzchak, the bestower of kindness, has passed away."

8.

When R. Yasa bar Chalfta passed away, blood flowed through the water pipes of Ludkia. They said that it was because he exerted himself so much in the Mitzvah of Milah (circumcision).

9.

When R. Abahu passed away, the pillars of Kisarin dripped water like tears (to display the suffering in the world because of his passing). The Kusim, who hated R. Abahu, scoffed and said that they were tears of joy because of his passing.

i.

(The Jews to the Kusim): Are you, the Kusim, more distant (from feeling the pain for R. Abahu) than the pillars who do feel it?!

10.

When R. Abahu was dying, he was shown thirteen rivers of Aparsamon (sweet smelling oil) that were flowing by. He asked, "Who is all of this reward intended for?" They told him that it is all for him. He said, "All this is for me? The pasuk says (Yishayah 49:4), "And I said, 'I toiled in vain (and consumed my strength for nothingness and vanity. Yet surely my judgement is with Hash-m, and (the reward for) my deed is with my God.')

(e)

Before the righteous pass away, Hash-m shows them their reward whilst they are still in this world. They are satisfied and their souls are drawn out of them towards this pleasure and they appear as if they are sleeping. It is compared to a king that made a banquet and on the tablecloth, he made images of all of the delicacies that will be served in the banquet. When all of the guests arrive, he shows them the images and they already feel satisfied and fall asleep.

(f)

At the time that they passed away, Zavdai bar Liyui, R. Yosi bar Pitras and R. Yehoshua ben Levi each said a pasuk about themselves that showed this idea that the righteous are shown their reward when it is time for them to pass away...one of them said the pasuk (Tehillim 32:6), "For this, every pious one should pray to you (at a time of befalling)..." (which refers to the time of death); one said the pasuk (Tehillim 5:12), "And rejoice with all who take refuge in You, (forever they will sing)..." (even at the time of death); and one said the pasuk (Tehillim 31:20), "How great is Your goodness that You have hidden away for those that fear You..."

(g)

(R. Yaakov bar Idi citing R. Yehoshua ben Levi): (This is related in Maseches Sotah Yerushalmi) It once happened that the elders entered the attic of Beis Gadyei in Yericho. A Heavenly voice came out and said to them, "Two of you, Hillel the Elder and another, are worthy to have the Divine spirit rest on you". They cast their eyes on Shmuel HaKatan.

(h)

On another occasion, the elders entered the attic of Yavneh and a Heavenly voice came out and said to them, "Two of you, Shmuel HaKatan and another, are worthy to have the Divine spirit rest on you". They cast their eyes on R. Eliezer and they rejoiced that they had come to the same understanding as the Divine spirit (when they had assumed in the first story, that Shmuel HaKatan was the other outstanding one).

(i)

One of the family of the Nasi passed away. When they came to bury him, the burial cave opened up and the people were in danger of falling in. R. Yosi went into the Study Hall and taught, "Fortunate is the person whose death and burial are peaceful (and does not cause damage and danger to people)". (This statement had negative implications for the man who had passed away.)

(j)

Later, when R. Yosi himself passed away, a tower collapsed in Tiveria and the House of the Nasi rejoiced that this occurred when R. Yosi passed away (as it showed that it is a sign of honor when such a thing occurs upon someone's death). R. Zeira said to them - these cases are different (for two reasons); firstly, when your relative passed away, it endangered people, which certainly is not a merit for him; but on the other hand, the tower falling when R. Yosi passed away did not endanger anyone. Secondly, for your relative, no idols were destroyed (in his merit); but R. Yosi had the merit of an idol being destroyed when he passed away.

(k)

(R. Yaakov bar Idi citing R. Yehoshua ben Levi): (Returning to the earlier discussion in Maseches Sotah) When R. Yochanan ben Zakai passed away, he said, "Take out the vessels from the house because of the impurity (that they will receive upon my death) and provide a chair for Chizkiyah the King of Yehuda (who has come to escort me)".

(l)

When his student R. Eliezer passed away, he said, "Take out the vessels from the house because of the impurity and provide a chair for R. Yochanan ben Zakai". Some say that he saw (Chizkiyah) just like his Rabbi.

(m)

The House of the Nasi wanted one of the House of R. Pazi to marry one of their household. This member of the House of R. Pazi refused the honor, saying that he did not want to disgrace the House of the Nasi by joining their family (since he viewed himself as an unworthy person). When this person passed away, he said, "Take out the vessels because of the impurity and provide a chair for Yehoshafat, king of Yehuda". They said that this person (Yehoshafat) who pursued honor should come to greet this person (of the House of R. Pazi) who avoided it.

3)

IMAGES OF A STICK, A BIRD OR A BALL (Yerushalmi Halachah 1 Daf 18b)

(a)

The Mishnah above (daf 41-1(b)) taught that the Chachamim say that it is only prohibited if it is holding the image of a stick a bird or a ball.

(b)

(What is the significance of these items?) A stick - indicating rulership over the world; a bird - as referred to in the pasuk (Yishayah 10:14), "And my hand found the riches of the peoples like a nest"; a ball - as the world is shaped like a ball.

(c)

(R. Yona): When Alexander of Macedonia wanted to fly up to the heaven, he sat on an eagle in order to be lifted up and see across the land. He rose up higher and higher until he viewed the world like a ball and the sea like a bowl surrounding it. This is why they draw images of gods with a ball in their hands.

1.

Question: Why not draw it with a bowl in its hand?

2.

Answer: Even the idolaters say that their god does not rule over the sea. But Hash-m rules over the sea and the dry land, and therefore, He can save both in the sea and on the dry land.

(d)

(R. Zeira son of R. Abahu before R. Elazar): (Tehillim 146:5), "Fortunate is one that has the G-d of Yaakov as his helper" and the following pasuk states, "He makes the heavens and earth (the sea and everything in it)". What is the connection between these? It is analogous with a human king who has a minister to assist him in (running this country), but he cannot rule in another country nor can he help a friend to run another country. And even if he rules over the entire world, that is only over the dry land, but he does not rule over the seas.

1.

However, Hash-m is different - He rules over the sea and the dry land and even if a sword is resting on a person's neck, Hash-m can save him, as Moshe Rabbeinu said (Shemos 18:4), "And He saved me from the sword of Paroh". It does not say that he saved me from the hand of Paroh, but rather, from the sword of Paroh - to teach that even if a sword is on the neck of a person, Hash-m can save him from it.

(e)

(Beraisa): They added other items in an idol's hand that prohibit - a sword, a crown or a ring. A sword - indicates that it can kill any person that it wishes; a crown - that adorns it like a king; a ring - that it can seal life or death for any person.

(f)

If a ring has an image of an idol on it, one may not stamp with it.

(g)

(R. Yehuda): If its seal makes a depression (as it protrudes from the ring), it is prohibited to use; if it makes a protrusion (as it is a depression), it is permitted.

(h)

(R. Chaninah ben Gamliel): In my father's house they would seal with images of different faces.

(i)

(R. Elazar bei R. Shimon): All faces were used in Yerushalayim except for human faces (which are prohibited).

(j)

(R. Shimon ben Gamliel): Any idol that is holding an item of honor. A basket, an awl and straps are items of disgrace. A paper and a quill are items of honor.

(k)

The status a scribes' inkwell held by an idol is questionable.

4)

BROKEN STATUES (Yerushalmi Halachah 2 Daf 18b)

(a)

(Mishnah): If one found broken pieces of statues, they are permitted.

(b)

If one found the figure of a hand or a foot, they are prohibited because such items are worshipped.

(c)

(Gemara) (R. Yosi citing R. Yochanan): (Why are broken pieces permitted?) Because most statues are made for beauty rather than for idolatry.

(d)

If so, even the figure of a hand or foot should be permitted? No, since idolaters serve such figures, there is proof that it was actually made for this purpose rather than being just a piece of a broken statue.

(e)

The pasuk states (Melachim II 17:30), "And the men of Bavel made (idols) of Succos-Banos" - meaning a hen and its chicks; "and the men of Kus made the figure of a foot" - a sign of blessing, like the foot of Yaakov and Yosef, as the pasuk states (Bereishis 30:27), "I have divined and Hash-m has blessed me [Lavan] for your sake [Yaakov]"; (and it later states (pasuk 30), "and Hash-m has blessed me 'L'Ragli' - by my foot".) And the pasuk (about Yosef) says (Bereishis 39:5), "And Hash-m blessed the house of the Egyptian [Potiphar] on account of Yosef".

1.

"And the men of Chamas made Ashima" - meaning that they made an image of a sheep, as the pasuk states (Vayikra 5:16), "And the Kohen shall atone for him through the ram of the guilt offering."

2.

(Pasuk 17), "And the Avim made Nivcha" - this was the image of a dog (that barks - 'Noveach'); "...and Tartak" - this was the image of a donkey. "And the Sefarvim burned their children in fire (to Adramelech and Anamelech the gods of the Serfavim)". (Adramelech was in the image of) a mule and (Anamelech was in the image of) a horse.

(f)

If an idol broke (without human intention), R. Yochanan said that it is prohibited to gain benefit from it and R. Shimon ben Lakish said that it is permitted.

(g)

What is the case? If it is known that the idol will be rebuilt, all agree that it is prohibited; if it is known that the idol will not be rebuilt, all agree that it is permitted...

1.

Rather, the case is when it is unknown - R. Yochanan said that it is as if it will certainly be rebuilt and R. Shimon ben Lakish said that it is as if it will certainly not be rebuilt.

(h)

(R. Yudan, father of R. Matanyah): If they are resting in the place in which they were broken, it is as if they will certainly be rebuilt; if not, it is as if they will certainly not be rebuilt.

(i)

Question (Reish Lakish to R. Yochanan): But the pasuk states (Shmuel I 5:5), "Therefore, the priests of Dagon (and all those who come to the house of Dagon) do not tread on the threshold of Dagon"; (when they found that Dagon's head and palms of its hands were cut off and laying on the threshold and its torso remained in its place. This is a question against R. Yochanan who said that when they rest in the place that they were broken, they will certainly be rebuilt. Here, only the head and palms were prohibited but the torso was not?!)

(j)

(R. Yochanan): The torso was still prohibited, but the pasuk is teaching that they showed more honor to the threshold (where the head and palms lay), than to the original place that they were.

(k)

(R. Yirmiyah citing R. Chiya bar Ba): We find that the Jews served idols even more strictly than the gentiles - the Philistines showed honor only to the threshold of Dagon, but the Jews showed honor to the threshold of every Temple of idolatry. This is learned from the pasuk that states (Tzefania 1:9), "And I will visit upon everyone who leaps over the threshold". (This indicates that there were Jews who would do this in every Temple.)

(l)

If one finds a broken idol on the road, Rav said that he should break each and every limb in order to permit it and Shmuel said that even that cannot annul its prohibition.

(m)

(R. Avin citing R. Shimon): (When the Mishnah prohibited the figure of a hand or foot), it is only when they were found on their base, but if not, one can assume that they came from a broken idol and they are permitted.
