TURMUSIN BEANS (Yerushalmi Halachah 8 Daf 16b)

תורמוסין שלהן מה הן רבי אוסר גניבה מתיר

(a)

Question: What is the law concerning Turmusin beans boiled by an idolater? Rebbi (Yehuda Nesiyah, grandson of Rebbi) prohibits them (since they are not eaten raw) and Genivah permits them (since they would not be served at a royal banquet).

אמר רבי אני זקן והוא זקן אני עלת על ליבי לאסור והוא עלת על דעתו להתיר.

Rebbi: I am a Sage and he is a Sage; I understood it to be prohibited and he understood it to be permitted.

רבי מנא בר תנחום אזל לצור והתיר תורמוסין שלהן

R. Mana bar Tanchum went to Tzur and permitted Turmusin boiled by an idolater.

רבי חייא בר בא אזל לצור ואשכח לרבי מנא בר תנחום שהתיר תורמוסין שלהן אתא גבי רבי יוחנן א"ל מה מעשה אירע לידך אמר ליה אשכחית לרבי מנא בר תנחום שהתיר תורמוסין שלהן. א"ל ולא פגעת ביה.

R. Chiya bar Ba went to Tzur and discovered that R. Mana bar Tanchum permitted Turmusin. He came to R. Yochanan who asked him if any cases had before him. He told R. Yochanan what he had discovered. R. Yochanan asked him why he had not excommunicated him for disagreeing with the Chachamim.

א"ל אדם גדול הוא והוא יודע למתק את הים גדול

(R. Chiya): R. Mana is a great man who knows how to take water from the sea when it becomes sweeter.

אמר לו לאו בני חשבון מים הוא יודע ובשעה שהמים מקלסין את בוראן הן מתמתקין

(R. Yochanan): That is no proof of his greatness as he knows the time when the waters are praising their Creator, which is when the salty waters sweeten.

א"ר יצחק בר לעזר בא לומר גנייו ואמר שבחו.

(R. Yitzchak bar Elazar): R. Yochanan attempted to say something derogatory but he actually praised him.

א"ר יוסי בי רבי בון חשבון גדול הוא.

(R. Yosi bei R. Bun): It is a great thing to be able to know this.

רבי זכאי דאלכסנדריאה הוה ידע לה אמר ואילו בעית ילפתה מיניה.

R. Zakai of Alexandria knew it and R. Yosi bei R. Bun said that if he had wished, he could have learned this calculation from R. Zakai, but he did not want to waste valuable time that could be used for Torah study.

(f)

Question: If an idolater cooked flour by pouring boiling water on it (referred to as Chalut) may a Jew eat it?

נישמעינה מן הדא רבי אמי סלק עם רבי יודן נשייא לחמתא דגדר והתיר חלוט שלהן.

Answer: R. Ami went with R. Yehuda Nesiyah to Chamas Gader and permitted it to them.

Question (R. Ba bar Mamal): What is the difference between Chalut and Turmusin (that R. Yehudah Nesiyah ruled differently in them)?

א"ר יוסי חלוט מחוסר מעשה ידי האור הוא תורמוסין אינן מחוסר מעשה ידי האור הוא.

(i)

(R. Yosi): Chalut is not cooked over fire (so Chazal did not prohibit it if done by an idolater).
