PERHAPS THE IDOLATER MIGHT HAVE EXCHANGED IT (Yerushalmi Halachah 3 Daf 12b)

(a)

(Mishnah in Maseches Damai): If a Jew deposited tithed produce with a gentile, it is assumed that the gentile exchanged the produce with his own produce and one must tithe them again.

1.

(R. Shimon): It is Damai (doubtful).

(b)

Question (R. Chananya to R. Mani): When the Jew is returned the produce, does the first opinion consider its obligation so certain, that one could use that produce to separate for other produce that is certainly obligated?

(c)

Answer (R. Mani): Yes, it is considered fully untithed.

(d)

Wasn't R. Chaninah correct when he stood firm (to his opinion that it cannot be considered like Tevel as a leniency to even use it to separate for other produce that is obligated)?

(e)

If a Jew deposited wine with an idolater that only had one seal - there is a dispute between R. Chananya and R. Mana - one prohibited it and one permitted it.

1.

They disagree over deriving benefit from the wine, but it is certainly prohibited to drink it.

(f)

(Rav): CH'BY'T is prohibited; Ch'M'P'G is permitted. CH'B'Y'T - C is Chatichas Dug - a piece of fish, B is Basar - meat. Y is Yayin - wine and T is Techeiles - turquoise colored thread are all prohibited if they only had one seal; CH is Chiltis - a spicy plant, M is Murias - fish juice (with wine added), P is Pat - bread and G is Gevina - cheese - are all permitted if they had one seal.

(g)

(R. Yudan): Rav's reason is that anything where there is a concern that the idolater exchanged the item with an actual prohibited item (rather than having a prohibited thing mixed in to it), such as fish, meat, wine and techeles, even one seal will not help.

(h)

(R. Yaakov bar Acha/ R. Shimon bar Ba/ R. Elazar citing R. Chaninah/ R. Ba/R. Chiyah citing R. Yochanan/ R. Zeira citing R. Yehoshua ben Levi): (Disagreeing with Rav) Any item with one seal left with an idolater is permitted except for wine and Hadrian pottery (see earlier daf 29-7(a)).

(i)

(R. Zeira citing R. Yirmiyah): The Halachah follows R. Meir in the case of Hadrian pottery (that it is prohibited to derive benefit from it).

1.

(Chachamim): There is no prohibition to derive benefit from Hadrian pottery.
